- The console PC requires a larger/better television than what would have been purchased anyway
-- WHAT?! No it doesn't, you idiots! Who the hell buys an entire large-screen TV for a game console!? Only the most rabid of wealthy geeks, that's who. This doesn't represent the average gamer, who plays on whatever TV is in their living room to begin with.
- The console gamer purchases three additional controllers
-- WHAT!? Many people stick with just one controller, but a lot purchase a second one for a friend. Very FEW people buy an additional two controllers, and far far less buy THREE additional controllers! This is a bullshit expense that is not indicative of an average console gamer. What's more, most Xbox 360 games don't even support 4-player local gameplay, except for party games and a handful of other exceptions.
- The console gamer goes through four dozen batteries per year
-- BULLSHIT! Buy rechargeable packs! Or better yet, rechargeable batteries!
All these things are their attempt to bump up the price of console ownership by HUNDREDS of dollars for worthless reasons.

Since the ESRB is a private institution, and Microsoft is a private company, they are legally allowed to do whatever the fuck they want as long they are not in breach of a CONTRACT that you agreed to ("Terms of Use").
You want to quote the Constitution? Fucking read the goddamn thing yourself! The first words of the quotation you yourself are citing state very clearly: "CONGRESS shall make no law, yada yada yada." See that word? CONGRESS. Compare that with what you wrote next:
"So that instantly makes the ESRB law null and void"
Do you see "CONGRESS" anywhere near there? Or, "GOVERNMENT"? Or anything similar to that at all? NO. It's ESRB, a private institution.
Private institutions are NOT required to protect your freedom of speech, because the Constitution only protects those rights from being abused by the GOVERNMENT, not by private individuals or organizations.
And... holy shit, I can't believe I wasted my time educating some smart-ass child on Constitutional law. But there you have it.
