I've got 2 360s waiting pickup by UPS on tuesday morning, one in packaging I salvaged off a friend when he got his repaired and another in a box I had to rummage around in the attic for - also had some packing foam handy, so was able to wedge it in nice and tight.
They feared that while it looked good, it didn't "stand out as something unique". The style is a lot closer to looking like something hand drawn, they use hand drawn textures that get scanned in and coloured in Photoshop along with comic book style outlines around everything. It's not exactly subtle but it works really well in the screenies from the mag.
PC Gamer UK has a 4 page spread on Borderlands, subscribers got their copies today. They've changed the art style, it's not in a sort of comic book / sketch cel-shaded style (think recent PoP) rather than the more generic brown / grey real world look they had previously.
I could've sworn that I saw something recently that stated that a judge here in the UK had ruled the flash carts themselves as legal, as they don't directly violate IP or copyright (or do anything else illegal) - if it were illegal to own something that *can* be used illegally, than everyone who owned a car would be in trouble.
This guy must've been selling pre-loaded carts, that's what tends to be the target of these raids.
If it is viral, than it might be like the Burnout: Paradise viral achievement, which I got in my first online game against a friend who had certainly not played with anyone but people we knew.
It sort of implies that random gamer tags act as "seeds" to help spread the achievement without people actually having to play a developer.
