The missing screw holes and complete info on the back leads me to believe that this is a final product lifted straight off the production line. It also better explains how it ended up where it did.

As far as apple not having any legal influence there, they don't really need it. If it was lifted off the production line in china apple just has to say they are canceling their contract with the manufacturing company and the guy who stole It will "commit suicide" by jumping backwards out of a window after shooting himelf twice in the head.
