IMO *some* games, like Gears 3, MW3, etc. could be priced at $60 because of the budget required to make them and the fact that gamers have already shown the willingness to en mass purchase the game at $60.
However, even a studio leader like Cliffy B. has said that developers and publishers are only hurting themselves and their own games by insisting that *all* games be priced at $60 at launch. Not all games are worth that much money. Developers and publishers need to realize that and start to differentiate the price points between truly blockbuster AAA games and lesser games. Then they, like you wrote, need to aggressively drop the price throughout the game's lifetime so to discourage gamers from buying the product used because a used copy is so much cheaper than a new copy.

Sep 11th 2011 4:32AM (Joystiq)Also, there are no actual faces used in the NCAA Football game other than the coach on the sidelines and the refs. Every player has a helmet on. No court is ever going to rule that just because a video game character is 5'11 210 or whatever the real life player that it may be similar to should get paid. Furthermore it's not like the NCAA or individual schools release players 40 times with metrics to allow EA to convert them in to a virtual football player's speed in the video game.
Even if these athletes were to some how win this (and they won't) they still have an NCAA problem. In order to play athletics at an NCAA school an athlete must sign over to the college the right to use their name and likeness. They can't get paid unless the NCAA decides to remove that requirement, and there's no way they're going to do so. At best the athletes will win money they can theoretically get after playing. At that point NCAA schools will claim that's their money because the player signed over to the school all rights to their likeness.

The Joystiq article left out some very important details that are in longer articles about this lawsuit.
In making her ruling Judge Wolfson relied on the Supreme Court decision in June concerning the California law that attempted to restrict video game sales to minors. In that ruling the Supreme Court decided that video games were NOT corporate speech, they were "expressive works" or "artistic work" that are entitled to full First Amendment protection.
Given the US Supreme Court ruling in June, this former quarterback's appeal, as well as the lawsuit by former quarterback Sam Keller, are both toast.

Sep 8th 2011 1:42PM (Joystiq)The original plan for this game was highly ambitious and, allegedly, Frontier found that they couldn't make the game the way they wanted to make it because of the console technological limitations.
It was supposed to be a "choose your own adventure" game where your actions decided how the story played out. According to what I originally read about the game (and the trailer I saw several years ago) it wasn't just going to have two endings like some games already do, it was supposed to have multiple ways the story could play out.
I also think this game got held up because Frontier worked on Kinectimals.
