For example, if someone posts a picture of some illicit, illegal material, is it not the responsibility of the webmaster to take it down? Sure, they may not be the original host, but when you're not taking action to take it down, it's still pretty wrong. Not 3.5 million wrong, not 1 year of jail wrong, however.
I also agree that they need a better trial. To have any bias in a trial of this magnitude is pretty poor.

Apr 23rd 2009 4:33PM (Joystiq)Search engines use crawlers, a tool that just searches and searches for pages and indexes them all. It has no real control over what happens. Sure, we can take a link out, but the crawler will find much more to replace it.
The pirate bay, however, hosts their own trackers and has search engines to index their torrent trackers. This is completely different.
In either case, they deserve a fair trial, no matter how guilty or not guilty we think they are. Although if they get a better trial, maybe the prosecution could actually explain things a bit better and be more organized...
