The industry is represented politicaly and legal be the ESA, Entertainment Software Administration. THere former boss was Doug Lowenstein. There current Boss is Mike Gallager I belive. They are the ones who fight these laws in court, so they should be the ones going after the industries enemies.

This is the point I make weekly, some times daily over at Game Politics. Why is the industry so unwilling to fight back? Why do they sit by, and let lies and misinformation rule the day?

I had hoped that Doug Lowenstien, former head of the ESA, depature from the industry would find his replacment actually in possession of a Pair of BALLS!!!!!

Alas, it seems all it did was enforce the same old same old for the industry, that is to say, doing NOTHING!!.

As others have said I was pointing out the Hypocracy of politicans to try and ban games when the news media, tv, movies, and others are as bad if not worse, a fact that has been key to the defeat of many video game laws. Also, I was pointing out the fact that the industry does not activly challange or counter many of the attacks made against it in anyway.

The Point, is that the only way to gain equality in my opinion, would be to turn there own arguments against them. When faced with having to deal with there own form of possible censorship and punishment, they would be keen to drop there efforts against games in short order.

Maybe my sarcasam was over your head, or my poor spelling abilities made it hard to comprehend. I can understand that.

But don't go insulting me when the fact is I'm the only one who seems to see the stupidity of the industry for not being wiling to stand up for itself.

Again dennis you prove exactly why people like thompson, larouche and all there ILK, need to be countered proactivly by the Industry, up to an including slander lawsuits.

Enough is enough, this BS has got to end. After 18, if someone shoots someone, any mention of games in the story should be an AUTOMATIC lawsuit.

THe industry should propose a new law. "The Truth in Media violence coverage Law", stating that any station, regardless of standing must fact check any claims made by quests on there show unless specificly stated as opinion, and also that anyone in violation of this rule will pay 50 grand to the industry and be forced to offer a full apology on AIR, or even require industry representation at any newcast that so much as mentions games.

That would put a stop to this bull shit.

They wanna try and pass the "Truth in ratings" Bs, lets turn it on them by aiming it right back at them. How bout "Truth in politics" act, which states that any one holding government office will be held accountable for any fraudulent statements they make, even in ignorance, up to and including being removed from office.

This is why I keep saying, any network that puts him on the air, should get a lawsuit from the ESA in 24 hours.

The fact is, Thompson should have been bankrupted and disbarred years ago. The reason he wasn't, and the reason he's even still being considered legitimate by the Main stream media, is that the game industry did not, or would not, confront the man either on air or in court. They simply sat by and let him assualt us, the industry, and games in general and never fought back. Now, Jack is facing serious legal reprocussions before the florida supreme court, but the fact is, this should have, and could have happened, years ago.

GP is right, doug, is a coward, who was content sit back and hide behind his lawyers and fight legislation and piracy, but never dared enter the one arena where games needed the most defense, the public arena.

So, good bye Doug, best wishs, and all that, the industry will be better off. Hopefully whoever replaces you, will have some F#$^ing Balls!

Actually, it's been tried and failed before, mainly due to issues with the 14 amendment and a lack of evidance. A supreme court ruling long ago cemmented that Violence is not the same as sexual content, so it has 0 chance to win. If the miller test failed in the past 5 times they tried it, I doubt it will work here .

If I were you jack, I'd remove myself from this debate before it winds up costing you your license, your reputation, what little is left, and your family. I'll never get America's opposition to a government-run system, nor will I ever understand why so many people are in favour of self-regulation. England, Australia, New Zealand, and other countries all get by fine with government-run bodies that use a universal system for movies, games, etc. When you see 18 on a game, you know exactly what it means. The only problem is with Australia, who seem to think that there should be no 18 rating for games.

Honestly, am I the only person who thinks what Jack Thompson is asking for is not unreasonable? The only thing that is unreasonable is the way that he's asking for it.

Last time I checked, Jack Thompson also called gamers terrorists, demanded he be put in charge of a mediation between the industry and it's critics, demanded he be given an advanced copy of an unfinished game, and was filling frivoulous lawsuits left and right. He also lies, slanders, and defames the industry on a regular basis.

Ok, for all those commenters saying this is no big deal, lemme go ahead and explain why this bill violates standing law and precident.

1. 1st amendment. While written in a sneaky way, it still attempts to use government authority to influence the content avalible in an expressive medium, ergo, it's a violation of free speech.

2. 14 amendment. Singling out games when unrated DVDs are sold on the shelf to kids every day is the hieght of hypocracy and violates the 14 amendment. Thus, another failure of this law.

3. The FTC has authority to control deceptive marketing practices, but HOt coffe was never used in any form of marketing or advertasment, and in fact, was never ment to be used in the game at all, which is why the FTC didn't fine or sanction Take Two for it. This bill is just Uptons way to getting back at the industry for the humiliation he suffered as a result of it. Lets also not forget what the Daily show did to he either.

This bill is utter garbage written by a pathetic hack politicans whose smarting from the politcal beating he took in the public eye. Give the industry five minutes in a courtroom, and the bill is dead as hell.

So those of you saying its no big deal, sit down, shutp up, and spend a few hours reading the law as it stands before you start to talk about it.
