People getting books, DVDs, even games, for free, and the publisher doesn't see a penny of it. They even let you read all of a book, they don't cut out the end because you didn't buy it new.

It's actually listed under "fundamental concepts" on the wiki article.

More succinctly - "The test is always whether a consumer of the goods or services will be confused as to the identity of the source or origin"..
