GameStop's employee checkout policy may be illegal [update]

There are two completely different issues here trying to be forced into one. It seems a lot of people believe that the 'gutting' of new games is done solely so the employee can take it home. This is false. One copy of a game is gutted and displayed, as mentioned above, for loss prevention reasons. The rest remain sealed in their original plastic. This is only sold if it is the final copy of the game.
Why not use the display cases to display new games? Well, this does happen quite often. As a Gamestop employee, I use every resource I have NOT to gut a game, because I agree; I too enjoy the freshness of popping open a newly purchased game. However, for all of those high market games like Prinny: I can be the hero? the game is not always displayed beforehand. I do agree that fake box art should be used whenever possible, however the company does not provide it. Shame on Gamestop, it is a cheap alternative.
Many have brought up the issue of the new car. It has miles on it, it can be haggled on, etc. Ever try to haggle on a new game? EVERY Gamestop has a "apply discount: shopworn" button on their POS. Has anyone asked if they can get a shopworn discount on the gutted game because it has been opened? Every time a customer asks me for it, I gladly let them have the discount. I suppose it is easier to complain on the internet. Our society typically does embrace those who are too lazy to think outside the box. Taboo suggestion to simply ask for a discount on something that is shopworn...foolish me.
As of late, Gamestop's have been receiving fewer copies of new games. Yes, the economy is poor, this is reflecting on Gamestop as well. The less reserves a store gets, the less copies of the game it will receive. This means that if no one reserves a game, they MIGHT get 1 copy. Guess what? That copy gets gutted. They sell the game. They get 1 more copy in 3 days later to replenish their inventory. Guess what? This game gets gutted too! A store reserves 30 copies of a game. They receive 45 copies of the game because they reserved a lot. 1 copy gets gutted. They sell 40 copies of the game over 3 days and get replenished with 20 more. No one has had to purchase the gutted copy. I've heard so many times, 'Yeah, that game will be awesome!' Well sir, would you like to put $5 on the game (which will ensure you a sealed copy, seeing as they are held aside for reserve customers). 'No, I'll just be lazy and wait for it to come out.' Congratulations, YOU just caused one more person to get a gutted copy of a game. The lucky winner might even be you! If you want a game, and KNOW you want a game, reserve it, whether it be through Gamestop, BB, Wal-Mart, Amazon, etc. It will ensure inventory, not only for you, but also for others. Oh wait, that takes action, not just idle complaining...
As far as the policy that allows employees to take home games...it officially states that it must be a used copy. Does this mean that new games don't get taken? Absolutely not. It happens. It's wrong. Does it happen at every Gamestop? No. Do the employees get reprimanded? Yes. If it is happening at a Gamestop, chances are that Gamestop has not provided you a very accommodating shopping experience. For that, I apologize. But take heart; the store manager will be fired in four to six months. I can almost guarantee it. District Mangers don't deal with managers that don't produce solid experiences to their customers. You want it to happen faster? There is a survey at the bottom of EVERY receipt that allows you to express your anger and rage. The store is ranked on the responses of these surveys. You have the power to impact how your local Gamestop runs its business. Oh wait, another taboo suggestion of ACTUALLY taking action rather than complaining and doing nothing. So silly of me...
