For instance, if you do something like, accuse the wrong person of murder, you should lose a major fraction of that 'health bar' or maybe the case entirely. And if you object at the wrong time, there's a smaller hit on the meter.
So it allows for varying levels of severity for mistakes.
I've also read, that the game comes with the 'psych-lock' feature, where if you point out contradictions, you unlock various parts of the witness' minds, which 'recharge' your health meter.
To offset this, the health meter is carried on through the entire episode, as opposed to previously only through each court day before resetting on the next.
