YouTube - Legally

What you don’t understand is YouTube is the exception to the rule. –They where the first to incorporate a social network around the videos… in a way that could only resemble Myspace but with videos. Do you really think the cable companies can make something that innovative? The Answer: NO.
It’s the same reason no one has been able to make a better ipod. It’s just not that easy; especially when the leader has done such a good job at combining design and function. (Bill Gates once said to Steve Job’s it doesn’t matter that your better because where first.) As it turns out that holds true in the world of the web too, not just in software.
I would bet every dollar that I have, that you couldn’t make another YouTube. Even with a great team of web designers you wouldn’t even come close. I would bet money on that. Why, for the same reason Google bought YouTube – because they couldn’t bet them with there own video site.

Here is my example of how a good thing turns bad – and it’s in no way the intention of the maker.
What’s to stop someone from putting up a web blog (that in no way ties back to the user) with copyrighted tracks and letting the users of songbird just download those tracks to there hard drive to listen to however they please. –and transfer to there Zune & ipods for free… More music then I would ever buy, and all free.
Now you begin to see how this is a product that in no way did the makers intend for it to be illegal but the same way a person takes a gun to the bank to make a withdrawal, I can’t stop them. The same way YouTube can’t stop thousands upon thousands of people from uploading copyrighted material. But they can take down the content once I receive a complaint – isn’t that being a Masters of their Domain –
The QUESTION is; who is at fault the user or the system?
If it's not the user I guess Mozilla should prepare for the lawsuits to hit the doors soon.

Gerry you do rasie a good point - the fact that Napster was just a search engine, and not actually hosting the files is a really good point because youtube actually host the copyrighted material. it does make there infraction much worst in that sense, but seeing how they have worked out some deals with some of the music companies I’m sure they will be able to get around the whole problem.
Especially since they are now giving the names of the people who uploaded the copyrighted material right to the companies so they can sue them directly.
Interesting move on you tube’s part, shows that they are not supporting the copyright problems as Napster was, in-fact Napster went as far as to say they could not track down the people putting up the illegal content.
So for GooTube I’m sure they will be able to turn the business into something that works within the law, and is able to function as a profitable Legal video uploading website.

Oct 15th 2006 1:11AM (Blog Maverick)The last thing anybody is thinking about when they upload a video is, I wonder if this is copyright infringement because I used that music I purchased from itunes music store in the back ground of my video blog.
Rob I’m not fighting the copyright laws I’me just saying suing people like the R.I.A.A is doing is not the answer to solving the copyright issues. Biting the hand that feeds you just doesn’t make much sense to me.
I would love to see a video upload site that could show the importance of why it’s important to pay for the content. A site that would allow people to get paid for their video uploads. Think Youtube, but with a paypal system incorporated into the website design. So people would be able to donate a dollar or even 3 dollars to a video up loader, as long as they don’t use any copyrighted material and follow the structure of the site. I think this would show people why it’s important to pay for things in a way.
When you create a video and try to get people to like it and donate to you, it brings home the whole concept of supporting an artist’s music or a movie. When you see what it takes to actually make content good enough to receive donations.
So no I’m not advocating giving your content away for free, I’m just saying can we not get crazy with over doing it on the copyright issue. Like is it ok if I give away a CD I bought. Is it ok if I make a copy and give it to my friend because that use to be fine but then the record companies started saying, oh no that’s not ok?
If I buy a copy of Windows XP and install it on my computer, and a month later my computer explodes or is burns in a fire can I give that disk to my friend for his computer, or can I now sell that CD on eBay, since it’s a code no longer being used or is that Wrong? I just feel like I paid for it, so shouldn’t it be mine. Or is it still Microsoft’s.

Oct 14th 2006 10:13PM (Blog Maverick)No-one but the Copyright holders are concerned about someone using a clip of music that is not authorized for use in your home video clip that you uploaded to Youtube… This is the thing that seems to keep going completely over your head. It’s the same thing the music companies didn’t understand about the new free world.
I like this discussion because to me it’s just like the days of Napster and it shows how little big companies and rich millionaires have learned about the free world. Your job is to control everything its how you make money, so if it was up to you. You would tell me when and how I could play my Music CD, what I’m allowed to do with the CD I bought. You want to tell me if I’m allowed to give a copy to my friend, if I can put it on my ipod or not.
What’s really funny is when the CD price went to $18.95 there was no Mark Cuban there saying oh this is crazy they need to fix this, something needs to be done. But as soon as the little guy gets a chance to turn the tables on the Music companies and download stuff they would have paid for before but now get for free. Here comes Mark Cuban talking about how unfair it is and how copyright laws are just being violated. Ha… ha...
That’s what started this whole war, people are tired Mark, they are tired of being controlled by your little copyright vision of how the world should work. Instead of looking at how the world really is working, Music companies took a huge hit when they didn’t understand people just wanted a way to get there music online. Too busy fighting the war, to realize that the war was pointless. Not to mention totally unnecessary.
You want music online, ok here is Apple itunes, you mean to tell me the huge music companies couldn’t figure that out, I mean you needed apple computer to come alone and show you how to make music available online in a way that people will be willing to pay for it. (Well why bring that up you say? Ok good point, I bring it up because it’s the same thing with videos mark.)
Do a cross licensing deal with other content rights owners? Uhhh… NO…
Are you serious, your controlling me again, I mean I don’t care about the content rights and no one else does either, do you really think I’m going to track down some copyright owner of the music so I can get it approved first before I upload my video of me blowing boogers out my nose with Aerosmith in the background. LOL… Good luck with that. The second I have to jump throw all those hoops I just go to the john doe video uploading site down the block that lets me upload whatever I want.
Mark I’m 34 and I grew up in the time of Napster and in fact I was going to college at the time when Napster became the huge music force that would change how we looked at music forever. Today that same thing is happening to Movies and software. Trust me when I tell you the war is over, the free world is here to stay, most of everything I would buy I can find on the net for free. That’s a serious problem.
For a second I thought you where really on to something when you talked about doing your own video uploading site and going at the big dogs and showing people why it’s important to respect copyrights by making a service that would allow people to get paid for there user generated content.(As long as they didn’t infringe on copyrights by using material they didn’t create or have permission to use.) I said wow he is really going to change the net and make one of the biggest sites to change the net forever.
But today I see that once again I guess you just don’t get it. And well someone else will. Maybe even Google will build a better mouse trap with Youtube, with time. Let’s just wait and see what they do. They might just surprise you. Even if they don’t there will always be someone as long as there’s money to be made. I could go on but I think this is already too long of a comment... It’s just such a good discussion.

Oct 5th 2006 9:36AM (Blog Maverick)Lets be clear about something, the law says that you must provide a way for the copyright holder to inform you and remove content once notified by the copyright holder, which youtube does right away. (and something Bit torrent and napster, limewire, etc all never did or tried to do – not really anyway.) They have even begun using filters to weed out keywords and are working with big studios to insure a fair playing field environment.
Let’s also be clear about this – Napster was indeed illegal but it did feed an important need that the public seem to have about getting music online, the big music companies could have easily bought the company and turned it into a pay service like Apples itunes but instead they choose to go against the grain and fight it…. We all know how well that turned out.
Well today I hope studio companies are smarter then that, I hope these companies understand that this is the future and in the future it pays to focus you fights on things that make sense, going after someone’s video because they played a copyrighted song in the background is just stupid, especially when that song becomes more popular and makes people want to buy it because they heard it and liked it in a particular video blog.
Today NBC has its own user profile on youtube where they have begun reposting their own TV show content. The world is changing and it makes sense to work out something that works for everyone.

And I’m sure others will follow, people say it can’t be done but here it is being done right before your eyes.
So let’s focus on the real value of youtube, it controls the focus of a huge amount of viewers and in the internet world that’s everything, so why do you want to fight something that can be bigger then we ever dreamed? Why do you want to go against the changing future, against technology?
They use to say the radio would kill music sales. I still laugh at the thought of that idea. It’s funny but radio actually made music bigger then it ever was. Bigger then the music companies every dreamed of.
So are you that person standing at the top of the roof screaming how it can’t work, and how it’s too crazy, and it will never happen. Because if you are, last call at the bar was awhile ago and you really need to stop drinking and pull up your pants and come back inside now, I hope that’s not you. (Laughing out loud) seriously I hope not, because you sound crazy right now. Also…
Because your wrong, and if you think about it, companies will learn how to play nice, not because they want to but because it’s in their best interest. And it will make the whole thing better as we go forward into the future. Think outside the box. Youtube is the future and fighting youtube would just make someone else youtube, just like fighting napstar made limewire.
The future won’t wait for you to figure it out that it’s here, because the future is happening in real time.
Youtube is a goldmine period, and if you can’t see that cancel your subscription to the wall street journal because trust me you don’t need it…
And to Mark Cuban I think you’re a genius and if you’re telling me you really can’t see this then you need to call me because that just amazes me, I really need to hear you say it.. Email me and I’ll send you my cell number...
