I don't think the previous commentors read the whole article. This is not a loss of consumer rights.

Basically, they wanted to have OtherOS and STILL have access to the PSN. Sony has the right to refuse PSN access to those who do not agree to the current ToS.

....I...I think he's confused on what "free" means.
The F2P games I've seen are, actually, free to play - but you have in game purchases to augment the game, usually making it easier, or as design choices for your character.
Whereas paying for a game, and then playing it doesn't....make anything free.....
It seems like he put the challenge out so publicly for the sole purpose of giving himself some good PR in an attempt to make Bethesda look bad for declining.
I don't think Bethesda should sue him in the first place, but this just seems like a ridiculous idea.
