But just for logical reasoning, had Jason not taken the offer like the others, the iphone holders would of done something with it eventually, most likely caught by the police , regardless of the leak, the fate of the employee would of been set as soon as he lost it.

And no way, he's bound to be fired, doesn't matter what company or whatever in this case.

What about the middle man however? If Jason does get charged, I'd like to see this man go with him at least. (Is there any confirmation on the gender?)

There should be more people in this case other than Jason, he is being used as a scapegoat here so that Apple can send a warning to all other journalists.

The employee who let it get stolen so carelessly?

The guy who actually stole it and sold it?

Irrelevant to the matter?

I'd also like to point out that while Jason is the scapegoat here, there are at least 3 people connected to this case, the employee, the seller to Gawker Media, and Jason.

Why is the employee not on the table here? Jason is just in the spotlight here , merely as a warning to any possible cases where this happens again. Regardless of whether or not he has the law technically on his side, that doesn't make the story right.

The new iPhone will sell just as good as anything else they made, all of you Apple nerds should rejoice that this one teeny tiny time, there was a mistake in security and you got to see a brand new product out in the open months before release!

Are you personally upset that when your cult leader announces it it won't be the same? Well guess what? There will be plenty more opportunities to go "What could the latest revolution be?!" It's not like they wait more than a year before giving you new toys.
