I worked at GameStop up until 3 months ago when I realized a lot of their policies could be deemed illegal. We were in fact allowed to open new games and check them out, for a few days only, and had to be sure they were returned in the same exact new condition. We even had a shrinkwrap machine in the backroom if need be.
Best story was when a new employee checked out a DS game and didn't delete his save data, we re shrinkwrapped it and everything, customer bought it, and went nuts.
"HOW IS THERE SAVE DATA ON IT IF ITS NEW? ARE ANY OF YOUR GUYS' NAME ALEX?"
