@fallen1 - I'd call Apple customer service and ask them. If the iPod didn't ship with the new apps, they will probably do for you what they did for me: credit the amount of the update purchase to your credit card so you can buy the update without paying extra.
I guess you could exchange it for a new, physical iPod and get the apps that way, but it seems like a pain.
It worked for me. I bought my iPod Touch on January 2nd at an Apple Store. I went to another Apple Store today on the basis of this post and asked about the update being covered by the price protection. The sales clerk asked for my receipt, then entered the transaction as a return, crediting $21.78 to the card I bought the iPod with. Then I went home and bought the software update for that amount. Easy.
If the WiFi at my apartment was working I could actually use the new apps. But I did write myself a nice Note on it.
After the fist-pumping kid won the first round, I started watching the behavior of the contestants as they came on stage. Without exception the guys who acted like rock stars won. Psychology!
The exception was the mild face-warming round where neither contestant particularly rocked out. I can't remember which of them won either. Or what song they played. I think I ate a Pop Tart during their round.
