As of the writing of this comment, IGN has had a KOAR backsplash advertisement to their main site. Gamespot does not (Gotham City Imposters). IGN gave it a 9.0. Gamespot (Kevin Van Ord) gave it a 7.5.
Given the GiantBomb/Gamespot fallout, I think something smells rotten in the state of Denmark.
I enjoy Rossi's columns so much that I think he needs to be defended, even though I don't comment all that often on this site.
1) Last time I read, most top-end raiding dps warriors were Arms because the spec did a lot more dps. 2) I understand that Rossi is an enormous fury fan, mostly for the Titan's Grip talent. He also likes arms a lot. 3) Rossi also knows a ton about tanking, having main tanked almost all content. 4) Regardless of his play preference, Rossi is one of the most knowledgeable players in all aspects of the warrior class. 5) above and beyond all of this, Rossi is an extremely intelligent player (and person) and very capable (talented) writer. His columns are always insightful, super logical, and very well written/articulated. He's my favorite writer on the staff.
In my mind, the list of top warriors goes like this: Landsoul > Ciderhelm = Rossi > other warriors.
So, I'm about 40 hours into Skyrim right now. Having a blast. I only put in about 25 hours into Oblivion (never got into the second Oblivion Gate). I've totally had the game music going through my head all day. The only problem is it's the Oblivion game music. You know, the outside world music with the strings and flute-like instrument. That's jacked up. My brain superimposes the Obliviion BG music over Skrym's much quieter and less intrusive BG music. Has this happened to anyone else?
Heroic Strike is not tied to the GCD, so it doesn't count as a GCD filler. Other than slam what other button is there to mash when raging blow and bloodthirst are on cooldown? Furthermore, low slam procs means that you aren't getting the full damage out of your Colossus Smash cooldowns. If what these guys are saying is true, it's a big deal.
You would be incorrect to side with Zenimax on this one and your legal analysis is incorrect. Zenimax would only have to sue to protect their trademark from "genericide," which happens when an arbitrary trademark (e.g. Xerox) being used in such a way that it refers to the product generally, rather than origin of the product (e.g. Xerox). See http://en.wikipedia.org/wiki/Genericized_trademark. This is not occurring with the trademark "Elder Scrolls."
What Zenimax seems to be arguing is that Minecraft's use the already generic word (scrolls) of their trademark ("Elder Scrolls") is likely to cause confusion among video game users (about the producers of the two games) even though the word scroll is necessary to describe an important gameplay component of the new Minecraft gameplay.
Zenimax's argument seems weak to me because the word scroll is descriptive and Minecraft doesn't have a lot of synonyms at their disposal.
Take a hypothetical example where a company (we'll call them Company A) owns the trademark "Acme Hamburger Store." Company B wants to create a burger joint and call it "Steve's Hamburgers." It would be absurd for Company B's use of the term "hamburgers" to infringe on Company A's trademark. In my mind the word scroll is as generic as the word hamburger.
