GameStop's employee checkout policy may be illegal [update]

I went to buy a DS game awhile ago, and they had 2 used copies. One in their GameStop premade cases without the instructions for games with a case, and one with the real case in mint condition and the instructions. The one without the real case? Yeah.. It was $6 more. Granted they probably had this one up a week before hand, and never changed the price, but this is just one of the few little things that shows the company really doesn't care about the consumer.

I understand why they have the policy for shoplifters but it really is just an excuse in the long run. They have those fake cardboard boxes/cases for pre-orders and coming soon games on the shelf. If they are able to make fake boxes and have the resources to do so for games that aren't even out yet, why wouldn't they just use the same box or something of the same.

I really don't mind the fresh plastic smell is there or not, but the fact that you pay for a new game that is technically used and played before, is really ridiculous and is actually illegal in many terms. GameStop isn't a rental service, so why should the employees have these advantages? I know they get paid crap, but they most likely get some discount to buy the game. Since most get paid crap too, we as customers get crappy service most of the time from people who really don't care about the company and just there for a paycheck. I have received played DS games as NEW, even a DS game that was "NEW" that had water spilled on it or something as it was completely obvious and the game didn't even work. I bought NHL 09 for PS3 NEW and it was scratched and then they had the nerve to tell me I couldn't return it because I opened their seal? Ridiculous.

Someone said that you buy used things as new from other places as well like Best Buy. Funny... I remember Best Buy and places of that kind constantly getting sued and in trouble for selling used TVs and Home Theatre systems as NEW. It IS illegal you know. I worked for an AV company myself and they did that, and we had the BBB threatened on us, why? Cause it's illegal! Just because they get away with it, doesn't mean it's right or legal too. There is a major difference between Floor models too. You get a floor model and you get it discounted! It's just when someone buys a TV and week or few days later returns it, then they sell it as NEW cause it's in new shape, and that's when things are against the policy. I think people are stretching to much when it comes to buying a Car or clothes. If you see something wrong with the car, they will fix it or take off from the price. If you see a stain or rip on the clothes, you don't have to buy it and can see it for yourself. So do I have to open my game right in front of them in the store every time I buy a new game, so I can return it if there is a problem or get it as used? Obviously, because if you take it home, they won't let you return it if you open it, unless you bought it was used.

The fact that they can open it and play it, then reseal it and sell as NEW is amazing. Especially how you can't open it and see that it was used or scratched, and can't return it as "new". On top of that, they will just take your "now used game since you opened it" and give you less than half price for it even if its less than a day old and just came out.. and then reseal it and sell it as NEW for full price! I understand where people are coming from defending the fact that its just plastic wrapping or that their store doesn't do it.. but even as working for the gas station... if you sell liquor pass the stopping hour, the gas station AND employee gets fined and in trouble. So saying its just the employee's fault isn't really fully true either, when it's open policy isn't followed or managed the way it should be.

I would give myself self-propsations to all my buddies and family. Then I would show them games and apps that they would want to play and not share until my DSi loses that fresh new DS smell. I would reply, "This is the 3rd time having a brand new DS with that fresh mint feel to it.. and the third time is a charm!" Hoping that Nintendo doesn't bring out yet another DS that I somehow must have in the end, cause I just don't have the money anymore.. Joystiq to the rescue?

I love the fact that I get excited about the game and the hype for it isn't over exceeding my expectations. The best thing about it is that it brings out the same gritty and grimmy scare to it that System Shock 2 had, that hasn't really been recreated since. Sure there has been scary games and good atmospheres in other games, but this game really sets a standard on captivating the enviroment and sounds are. Just like System Shock 2, the sounds add a great amount of detail to the area around you compared to other games. Not to mention that it even has a solid story to keep you guessing and going.

I don't mind that they gut cases at all, as long as my CD is in mint condition and hasn't been used by a Gamestop employee. I bought a Wii from Toys R Us and they had Marvel come with it as a bundle. The game was still in it's original form and I went to trade it in, and they wouldn't take it. They made me unwrap it to make it "Used" becuase they couldn't do it they said, and I got a lower price becuase of this. It's somewhat understandable from his excuse, but was just really weird and shady to me.

Like I said before, I have a problem with them selling DS Games as NEW when they are in those cheap Gamestop cases with permanent marker writen in for the game's name. Sometimes it won't even have an instruction manual. When I went to buy Starfox for DS, I ended up buying the USED game becuase it had it's original case. I took the new game up to the counter at first and they never gave me the real case, this confused me and made all my DS purchases at other stores unless they are used. Still shop at Gamestop becuase it's the closest store for all my other gaming goods though.

I think this crap is ridiculous. When I go into my Gamestop store, They have NEW DS games in their crappy used boxes with the permament marker to mark what game it is. They said the game hasn't been touched, and was just stored and didn't have any more cases left. I want to know why I won't be getting an instruction manaul or the real case that it came with if it was new? I find this a lot with DS games around a lot of Gamestops by Cleveland, OH. It's dirty and I hate not getting the real case for a NEW game, so they lose my business.
