This is BS. They're assuming that, if funds were deposited into that account for that TWO YEAR PERIOD, then they were for the sole purpose of hacking the PS3. Yes that is something that can be decided in court, but they're presuming so (and setting the venue for the case based on that presumption) without ever having heard the case.

Sony seems to think CA will be a friendly venue for them, so I hope the case goes to NJ. This could set a huge precedent for who owns your hardware, you or the manufacturer. What's to stop them from changing the TOS for a console to insist that you send it back once they release a new revision? Or to remotely disable it in that case?
