1) I believe that's the implied threat of a "court imposed fee"; I don't remember if a hard value was actually given, but it's been implied that the 1000 is "getting off easy"..

No, they're likely not proceeding to court because this is the same shakedown that occurred with TW1, and apparently is the norm in Germany. They refuse to disclose information about the company and methods used, because they know that will quickly bring the roof down on them.
