#39, that's slightly different. Charter Cable is a redistributor of HBO's content. HBO remains at all times the owner of the content. However, as a subscriber, I am allowed to record my HBO programming for personal consumption.

In theory, Charter could create a backup copy for its own personal consumption, but could not distribute it to its subscribers. That would be the same as you or I recording off HBO (legal) and then distributing it (illegal).

#11, Um, actually, you are allowed to make a copy for personal use. That's copyright law.

If you've ever read a contract (employment contract, EULA, etc.), you'll notice there is always a clause near the bottom that states that is any portion of the contract is unenforceable, only that portion is voided and not the whole contract.

You see, contracts are written to be scary more than they are written to be legally binding. You can never sign away a legal right. This is why individuals who agree not to hold a party unaccountable can then turn around and sue.

Um, what about developer support?

Just because the phone has an accelerometer doesn't mean the SDK can access said accelerometer. I've had camera phones for several years now and the only "killer app" I've seen for is stupid picture frames.

There's also a market penetration issue with a $500/$600 phone.

This smells like fanboyism to me...

I understand holding a minimum number for a huge shopping day like Black Friday, but New Year's Eve?

I can't imagine Best Buy turning down the giftcard-toting masses in order to hit the big New Year's Eve shopping blitz.

And just after PS3 is getting press for being unpopular? Seems fishy to me...

Kudos to Microsoft for promoting co-op.

I'm sick of every FPS being just another remake of Quake. Multiplayer deathmatch stopped being entertaining 10 years ago...
