Sometimes I really wonder about the EFF - making pronouncements that are that painfully obvious doesn't do much to inspire confidence.
Of course Apple will end up taking on the litigation, since they required the use of the in-app upgrades and would like to continue to do so. Plus the harm to the app store would be massive without that kind of support. Finally, if one of the developers gives in, then it sets a nasty precedent that will make it much harder for Apple to win in a later case, when for example, they come after the iTunes app which also allows purchases.
I could see them optimizing the hard drive sleds to let them stack in more SSDs in the same space as 3.5" drives…
Rack-mountable will probably just mean smaller, I can't see an XServe form factor.
Clever would be to make the exterior case unnecessary so it could be bladed, but that would require some forward thinking in the server/corporate space - something that is very on/off at Apple. They could then sell blades with the same SKU as Mac Pro motherboards.
Thunderbolt would render a lot of the traditional space inside useless.
Hmm...let's see. We've failed to provide adequate infrastructure for how people actually live, so we are going to now fine them for doing what they need to do.
