I don't think that's true. There was a Supreme Court case in 2006 which allowed similar wording in AT&T contracts. That case helps set a precedent for these contracts.

That statement gives them wiggle room if they decide to ban. "Though we had no interest in banning users, they nevertheless did not abide by our request" -- or something like that. It would be stupid but, as companies have shown time and again, the stupid choice is often the most preferred.
