So the markets are different, whatever. They could continue producing smaller quantities of legacy copies of the game, 'Greatest Hits' style, and price them near used copies as the market dictates. But instead they just whine and hope an answer is handed to them. Business is tough, and you need to evolve; they have become complacent and didn't look ahead. Now instead of being productive and fighting Gamestop, they are punishing the customer (always the right move). And if you think digital distribution tied to a single user is going to be good for distributors, just wait til it becomes mainstream and a big target for hackers...

I doubt they'd undercut, but if I could get the same game new instead of used for $2 more, I'd do it. Publishers should keep releasing cheaper versions of the game as the price comes down in the used market if they want to cannabalize sales. And even if it won't stop all used sales (obviously it won't), it will still give them additional revenue and hurt Gamestop's bottom line. I'm not saying it's exactly the same kind of market as cars or books, but there are still things they can do that would help without screwing the customer. They are just hoping that with idle threats, they can fear monger people into buying things, or maybe scam some legislation; they just need to sack up and deal with their issues the right way before they get worse.

I made a profile just to cast my vote for #36. Really nice art, good design, lots of color, and I don't even care that it's vaguely Ed-hardyish because it's not a bunch of skulls or something; the one shirt I'd actually buy. I hope it wins, but if it doesn't, #5 is pretty clean along with #4, and #95's got some nice perspective going on.
