If they don't set precedent someone else can come along and TRY and claim Scrolls and then if successful would be able to sue for a portion of the profits of any future Elder Scrolls game sales, whether it be Oblivion, Skyrim, etc.

Also to those who say they are trying for a money grab, they can't hope to get more then litigation costs because Mojang hasn't released a product or caused any harm to their product yet, and I'm sure they know it.
