Sounds like one (or more) of the app screeners at Apple should be getting fired right about now. One of the problems of having such a huge store and trying to police it all is that things sometimes fall through the cracks. I'd hope that the screeners would look twice at something with such a visible and famous property plastered on it to make sure it's legit, but guess that's not the case. Hope they do something about it ASAP to prevent anyone else from wasting their money. At least it's just crapware, rather than malware.

The headline is overly sensationalist, seemingly designed to make a parallel to the iTunes app store for iDevices that just isn't there. Rather than "unapproved", it's more appropriate to say "unsigned". According to the technical details, Apple will issue developers certificates on request, which must be used to cryptographically sign the apps that are released. Unless there's a massive turnaround before it ships, there will be no approval process for software, no censorship like in the iTunes store. It's a security measure, and you can bet that companies like Steam, Blizzard, etc. will get some quick compatibility updates to their products ready before the OS update even ships.

Even if a game isn't updated to work with the new OS security, you can still just change that setting and it'll work fine (barring other OS-upgrade glitches). A lot will ride on how easy/obvious it is to change that setting, so let's hope that Apple doesn't screw it up.
