I find it hard to imagine what the gameplay will actually be when two characters are "doing" it on-screen. Am I waggling, button-bashing, stroking my click-wheel or what? ;-)

Apple's threat of legal action was based on *copyright infringement* NOT passing off, which is what you're talking about.
There is NO copyright in style, so Apple was wrong.
