What you're saying would violate the First Sale Doctrine. To summarize, this doctrine states that once you purchase a CD/DVD/etc. you are free to do with that copy what you would like (sell/play/use as a coaster). You own both the license for that copy and the physical copy of the game itself. However, the license is attached to the physical copy so no making copies and selling the physical item.

To simplify things, once you buy the game, it's out of the developer's hands. To charge some sort of "licensing fee" after the sale would be double-dipping. Can you imagine car companies trying to charge a "reseller's fee" when someone tried to sell their used car? It doesn't make any sense, does it?

Believe me, I'm all for seeing developers make great games and succeeding, but violating the First Sale Doctrine and double-dipping sales is not "earning" anything from me (including my dollar).

I think that Apple may run into some problems with the gift cards though. Gift cards can be used to purchase products sold at Apple stores, even iPhones. Unless they feel like fully refunding people who purchased gift cards with the sole intent of using that gift card to buy an iPhone, I suggest they ditch this policy quickly. It's that, or they need to include a disclaimer notifying potential customers that gift cards may not be used to purchase iPhones.
