It's also important to note that CNN's iReport service is user generated content, not something that CNN itself polices on a regular basis. In this case they stepped in and removed it, but in general, it is a lot like YouTube. Do you believe everything you see on YouTube?

As a responsible citizen of Time Warner's extended family, TUAW should have gotten at least this fact correct.

That aside, what we're talking about is the terms of service, your contractual agreement to access the service, not the EULA, which is your license to install the client. They are separate and distinct.

The terms of use, which you can "click through" except in a couple of very distinct scenarios:

- When you install the game.
- When the TOS is updated.
- When they patch the service.

You're required to scroll to the end before the button lights up. They assume that if you scroll through it, you actually take the time to read it. Ignorance isn't a defense.

I honestly wish it were more dynamic. I've seen other systems and platforms do it. Right now we've got battlegrounds which you have to level up to x9 to perform in, which limits the experience to small chunks of time as you're leveling up.

The goal would be that if someone who casually plays like me should be able to access PvP content any time regardless of my level.

The proposed solution would be that the system would be dynamic -- meaning players would enter a general queue for their selected battleground. It would then attempt to match people up from the pool in a x level radius (my suggestion would be 3-5.) In theory this could mean that you could have battlegrounds going on for levels 21 - 25 or 47 - 51. You could then also filter gear matching. I also suggested perhaps matching people on a win/loss record, such that the experience is more evenly matched.

Why the 10 level brackets don't matter - Sure, you could get gear based on your level range. Your honor is calculated based on your level as well. So why segment it into 10 level blocks?

All this talk of copyright. I don't think what anyone gets is that all of the data and images on any of these sites isn't owned by anyone but Blizzard.

After all, let's look at some facts:
1. Blizzard already has the "Armory" site and could very easily at any given time shut down any of the fan created database sites.

2. It's hard to sue someone without some associated "financial" hardship. Since the data is freely available, the only thing they'd be able to "claim" is advertising traffic.

3. It's the same data, regardless of which database you use. So seriously -- who the hell cares and why is this news?

They can continue to update iTunes, Quicktime, and Safari because they are offered for free. You can download these for free and you didn't pay for them nor does Apple recognize revenue from the software itself.

No matter what you say, his salary from the company still is only $1. The valuation of his options are a direct reflection on the stock price, nothing more. The fact is, he owns a lot of stock and people are investing in the company.
