Rein <a href="https://twitter.com/MarkRein/status/207893020354424832">took to Twitter</a> to broadcast the news. "Case over. Jury finds for Epic on all counts," he said. Silicon Knights hasn't issued a formal response as of yet, though we've reached out for confirmation.<br /><br />The suit arose over allegations from Silicon Knights that Epic Games was withholding pieces of its Unreal Engine 3 - pieces that were allegedly instrumental in the creation of <em>Too Human</em>. Due to the alleged delays, Silicon Knights says it was forced to implement its own game engine (known only as "Silicon Knights engine") to complete the project.<br /><br />Since <em>Too Human</em>, Silicon Knights went on to create the critically-panned <a href="http://www.joystiq.com/game/x-men-destiny"><em>X-Men: Destiny</em></a> and suffered major layoffs. Players will build a character from a series of classes including mercenaries or the cyberpunk-standard "hacker," load that character up with tech implants, and work through a non-linear storyline.<br /><br />A new CDP team, made up of <em>Witcher</em> vets, is working on the game, and staffing up for additional help. Insomniac head (and general nice dude) Ted Price took to the <a href="http://blog.us.playstation.com/2012/05/30/ratchet-clank-full-frontal-assault-coming-to-psn-this-fall/">US PlayStation Blog</a> this afternoon to announce "Ratchet &amp; Clank: Full Frontal Assault" for PlayStation Network, alongside plans to launch the game "this holiday season."<br /><br />Aside from the artwork you see above and the logo we've dropped in the gallery below, Price offered few details on the game. He said it'll be a "fun-sized" R&amp;C title (like <em>Ratchet &amp; Clank Future: Quest for Booty</em> before it), and that the game will return to "the series' classic feel, camera, controls, and weapons, while innovating and giving you a whole new way to play." What that <em>means</em> is another question altogether. The game's upcoming DLC pack "Close Quarters" also got a date and price: June 4, &pound;11.99/&euro;14.99/AU$23.95.<br /><br />As you might imagine, someone at Sony quickly realized the issue and pulled the info ... but not before Google Cache caught it in its icy, permanent grip. Rubin will report directly to chairman and CEO Brian Farrell.<br /><br />Additionally, senior vice president of Core Studios Dave Davis is exiting the company. Bilson, Davis, and the "Core Games" group at THQ lead the charge in recent years on THQ's rebranding (including the logo you see above) from a licensed-game publisher to one developing and publishing what Bilson and co. considered "core" franchises (Warhammer 40K, Saints Row, and Red Faction among others). The move is especially odd considering THQ's continuing initiative to develop "AAA 'Core' games for multiple platforms."<br /><br />As for Rubin's appointment, that's distinctly less odd - he helped create one of the game industry's most successful development studios. "Jason's proven track record in the industry speaks for itself, and he is one of the brightest minds in the business," Farrell said of Rubin's appointment. Amazon let loose the Instant Video app today on Xbox Live under the Video Apps marketplace, allowing Amazon Prime owners streaming access to "over 17,000 Prime Instant videos" and both Prime and non-Prime customers to purchase access to "a library of over 120,000 movies and TV episodes."<br /><br />As you might've guessed, Microsoft's Kinect functionality is also part of the service, allowing you to shout "Xbox Play/Stop/Pause/etc." as much as necessary before it <em>finally works</em>. The app is also locked to Xbox Live Gold accounts, so, uh, no dice for you Silver folks. "Frustration" seems not strong enough a word to describe his feelings toward Rhode Island Governor Lincoln Chafee - Schilling called <a href="http://www.joystiq.com/tag/lincoln-chafee,38-studios">Chafee's commentary</a> surrounding 38 Studios "devastating," and claimed it "scared off private investors."<br /><br />Schilling also said that he could lose $50 million due to the studio's failure - money which he earned as a professional baseball player, and which he later invested into 38 Studios. That money, as well as approximately $50 million of a <a href="http://www.joystiq.com/2010/07/27/schillings-38-studios-leaving-massachusetts-for-rhode-island/">planned $75 million loan</a> co-signed by the state of Rhode Island, was eaten by 38's long-in-development MMO, "<a href="http://www.joystiq.com/game/project-copernicus">Project Copernicus</a>."<br /><br />38 Studios' Baltimore-based subsidiary, Big Huge Games, was <a href="http://www.joystiq.com/2012/05/28/kingdoms-of-amalur-reckoning-2-was-in-pre-production/">working on a sequel</a> to this year's <a href="http://www.joystiq.com/game/kingdoms-of-amalur-reckoning"><em>Kingdoms of Amalur: Reckoning</em></a>. The project was depending on private investment to go into production - to the tune of $35 million from an unnamed publisher - which Schilling said was pushed away by Chafee's statements.<br /><br />"Curt was committed to us as a community and as people, he wanted the best possible work environment for the team he cared so much for, and as a result none of us wanted to let him down," one former 38 Studios employee, speaking under condition of anonymity, told us. "He had invested so much into us financially and personally, we were not about to betray that trust. We were not going to take the chance of speaking to the press and accidentally ruining any chances with outside investors. Unfortunately, it didn't matter if the employees spoke and ruined things with the investors as the Governor beat us to it."<br /><br />Last week, 38 Studios <a href="http://www.joystiq.com/2012/05/24/38-studios-and-big-huge-games-lay-off-entire-staffs/">laid off its near-300 person staff</a> in Rhode Island, as well as its approximately 100-person studio in Baltimore, Big Huge Games.<br /><br /><strong>Update:</strong> Governor Lincoln Chafee <a href="http://www.wpri.com/dpp/news/local_news/providence/web-extra-chafee-responds-to-schilling">responded this morning</a> to Schilling's comments in a short Q&amp;A session with Rhode Island reporters. "As a business person, he was new at it, and so I always had some reservations," Chafee said. "I have to verify everything, I can't just take it as a leap of faith," he told one reporter asking about the alleged $35 million that 38 Studios was on the brink of acquiring to create a sequel to this year's <em>Kingdoms of Amalur: Reckoning</em>. "Hope springs eternal, but I won't misrepresent to the Rhode Islanders how dire the situation is," Chafee added. "I understand that being involved in this very risky industry that, when things aren't going well, there's gonna be blame. Now, WB and developer Eurocom are bringing the world of Hogwarts to Kinect with a much more "traditional" Kinect experience; minigames. It's called, of course, <em>Harry Potter for Kinect</em>.<br /><br />The game follows the whole Harry Potter saga, with Harry, Ron, Hermione ... and you(r face scanned onto a player-created character!) "The game failed, the game failed," Rhode Island Governor Lincoln Chafee told attendees of a press conference this afternoon.<br /><br />According to "experts" speaking with Chafee's office, <em>Reckoning</em> needed to sell over 3 million copies "just to break even," never mind profit. The action RPG was released this past February to <a href="http://www.joystiq.com/2012/02/07/kingdoms-of-amalur-reckoning-review/">critical praise</a> and <a href="http://www.joystiq.com/2012/03/09/kingdoms-of-amalur-reckoning-sold-330-000-in-the-us-last-month/">modest initial financial success</a>. Following reports that 38 Studios <a href="http://www.joystiq.com/2012/05/23/38-studios-employees-unpaid-since-may-1/">stopped paying staff on May 1</a>, and just an hour before a scheduled press conference in Rhode Island addressing the recent 38 Studios financial debacle, both the Providence, RI-based 38 Studios and the Baltimore, MD-based Big Huge Games are no more.<br /><br />"Big Huge Games was home for my wife and me for our adult lives so far. I'll miss it terribly, but so proud. Good night and good luck," former Big Huge Games lead world designer Colin Campbell said <a href="https://twitter.com/CCampbellArt/status/205755573495533568">on his Twitter account</a>. Big Huge's latest release was the moderately successful <a href="http://www.joystiq.com/game/kingdoms-of-amalur-reckoning"><em>Kingdoms of Amalur: Reckoning</em></a>. The studio was picked up by 38 Studios back in 2009, and it crafted the first entry in 38's ambitious new universe: Amalur.<br /><br />The recent financial tumult arose following a <a href="http://www.joystiq.com/2012/05/15/38-studios-whiffed-last-loan-payment-received-nearly-50-millio/">defaulted payment</a> from 38 Studios to the Rhode Island state government on May 1, indicating much larger financial issues that could ultimately lead to Rhode Island taxpayers owing <a href="http://www.joystiq.com/2012/05/15/if-38-studios-collapses-rhode-island-taxpayers-owe-112-6-milli/">up to $112.6 million</a> between 2013 and 2020. It's unclear whether today's layoffs mean 38 Studios is unable to pay back the approximately $50 million its owes Rhode Island of a planed $75 million loan. If that's the case, <a href="http://www.joystiq.com/2012/05/16/rhode-island-owns-38-studios-intellectual-property/">Rhode Island will take over ownership</a> of the Amalur IP, <a href="http://www.joystiq.com/2012/05/23/analyst-estimates-amalur-ip-worth-20-million-38-studios-employ/">valued at around $20 million</a>.<br /><br />We expect to hear more at a scheduled press conference this evening held by Rhode Island Governor Lincoln Chafee.<br /><br /><strong>Update:</strong> <a href="http://blogs.wpri.com/2012/05/24/38-studio-lays-off-its-entire-staff/">WPRI</a> got ahold of the internal memo to employees at 38 Studios, which reads: "The Company is experiencing an economic downturn. To avoid further losses and possibility of retrenchment, the Company has decided that a companywide lay off is absolutely necessary. These layoffs are non-voluntary and non-disciplinary. This is your official notice of lay off, effective today, Thursday, May 24th, 2012." Led by Ron Gilbert, <em>The Cave</em> sees an eclectic cluster of impromptu spelunkers - including a scientist, a monk, a knight and a time traveler - finding their fortunes (and perhaps more) in the titular, mysterious and, err, "sultry" subterranean network. That's right: The Cave can speak.<br /><br />The rest of the protagonists are silent, but up to three can venture into The Cave at a time. After picking your trio, you guide them all deeper into the seamless network of underground rooms, switching control between each to solve puzzles and exploit their unique abilities. The knight, for instance, can activate a guardian angel that protects him from flames and falls, while the hillbilly can hold his breath underwater forever. (Take that, Guybrush Threepwood!)<br /><br />The game can be completed with any combination of characters, but certain endings and unique areas are locked to individual characters. Having the knight in your group, for example, will open up the medieval castle and its puzzles for play. And yes, there just happens to be a castle buried deep within in <em>The Cave</em>. With a "New Grog" vending machine (among other inharmonious objects) cropping up in the network's lower bowels, we think it's safe to say that Ron Gilbert's touch is evident throughout the game.<br /><br />He also programmed the whole thing himself, we think. Outlook is not good."<br /><br />We're informed that 38 Studios' MMO, "Project Copernicus," announced by Rhode Island Gov. Lincoln Chafee as <a href="http://www.joystiq.com/2012/05/18/rhode-island-governor-gives-38-studios-copernicus-mmo-a-june-20/">launching in June 2013</a>, did have that date as its internal target. However, "Whether this is realistic or not is up for debate."<br /><br />Gov. Chafee said in a <a href="http://www.joystiq.com/2012/05/23/ri-gov-chafee-working-to-prevent-38-studios-shutdown-unaware-o/">press conference today</a> that he would do what he could to prevent the studio from shutting down. Will the studio still exist within a month? In a sudden press conference late today, he said the studio had not received any outside investment nor any of the <a href="http://www.joystiq.com/2012/05/18/38-studios-successfully-pays-1-125-million-to-rhode-island/">new tax credits it has applied for</a>. <a href="https://twitter.com/nbc10_brian/status/205420137581514754">NBC10</a> reports that, when asked if 38 Studios would be closing, Chafee said he would do what he could to prevent it.<br /><br /><a href="http://blogs.wpri.com/2012/05/23/38-studios-loses-ceo-and-high-profile-vp-linkedin-suggests/">WPRI</a> reported today that CEO Jennifer MacLean removed the title of chief executive from her LinkedIn profile and listed her departure as having occurred in March. John Blakely, senior vice president of product development, also revised his LinkedIn profile to show that he left the company this month. After an illustrious career at Capcom during which he designed the <em>Ghosts 'n Goblins</em> games and produced the <em>Mega Man</em> series, Tokuro Fujiwara founded his own studio, Whoopee Camp, where he directed <em>Tomba!</em> and its sequel for publisher Sony Computer Entertainment.<br /><br />"Sony and MonkeyPaw have a good working relationship," MonkeyPaw CEO John Greiner told Joystiq. "I think they appreciate the titles we've brought to the Store. And they value the support we give the games. Having a plethora of Japanese content is a distinct advantage PlayStation has over Xbox. But the games still need to be brought Stateside. So our model helps Sony spread their Japanese edge and we help Japanese developers get their titles to a wider audience. Hence, Sony is willing to work with us on titles that may not have otherwise been licensed out. Support is key."<br /><br />MonkeyPaw has been working on acquiring the <em>Tomba!</em> rights for a year. <font color="#500050">"</font>We often have to chase down multiple right holders," Greiner said. "In this case, Sony and Whoopee Camp had rights that needed to be negotiated." The deal didn't necessarily include the sequel, however. "<i>Tomba! 2</i> is a possibility but we need to really sell <em>Tomba! 1</em> well before we can extend our relationship," Greiner explained. "It's the first time to work with Fujiwara-san so we're trying to make a good impression. So much so that the game was purchased more than 3.5 million times in its first 24 hours available, making it the "fastest-selling PC game" of all time, according to Blizzard. On top of that 3.5 million, another 1.2 million copies were scooped via the <a href="http://wow.joystiq.com/2011/10/21/blizzard-announces-world-of-warcraft-annual-pass/">WoW Annual Pass</a> (which included a free copy of <em>D3</em>).<br /><br />Blizzard's wording on this claim is especially interesting, pointing out that "more than 4.7 million gamers around the world were <em>poised to storm</em> Sanctuary on day 1 of <em>Diablo 3</em>'s release." Blizzard CEO and cofounder Mike Morhaime addresses the <a href="http://www.joystiq.com/2012/05/15/diablo-3-servers-are-now-back-online/">Diablo-sized elephant in the room</a> soon after, saying, "We also regret that our preparations were not enough to ensure everyone had a seamless experience when they did so. I want to reaffirm our commitment to make sure the millions of Diablo III players out there have a great experience with the game moving forward, and I also want to thank them for their ongoing support."<br /><br />Beyond the day-one sales, Blizzard revealed that by the end of its first week on sale, more than 6.3 million copies were in the hands of gamers worldwide. Take-Two's latest <a href="http://ir.take2games.com/phoenix.zhtml?c=86428&amp;p=irol-newsArticle&amp;ID=1698793&amp;highlight=">earnings report</a> gives the game a "fiscal year 2014" date, which puts it between April 1, 2013 and March 31, 2014.<br /><br />The previous release window announcement put it in the previous fiscal year - and that announcement was, itself, a <a href="http://www.joystiq.com/2011/11/08/xcom-delayed-beyond-q1-2012/">delay</a> from a proposed March 6, 2012 release date. The first will be an Xbox exclusive (360 with the option for its successor) in fall 2013 (versions for other systems would follow one year later) with followup games on Xbox successor, PS3 successor, and PC in 2015, 2017, and 2019. Four DLC expansions, code-named "Comet," are included in the deal, due fall 2014, 2016, 2018, and 2020.<br /><br />In the contract, Activision reserves the right to take over the "Destiny" property if Bungie fails to meet its requirements; however, it stipulates that it will not begin more "Destiny" projects until Bungie has completed its work.<br /><br />The contract also gives Bungie the freedom to put five percent of its staff to work on a prototype for a new game referred to as "Marathon," with the team size allowed to grow after certain operating income. There are also rules governing how much of the company's staff can work on Bungie.Net, <em>Halo Reach</em> DLC and other projects.<br /><br />That takes care of the next eight years or so of video game news. The Gearbox Software-developed game was previously given a "fall 2012" launch window, and was planned as a Wii U hardware launch title (the game is also planned for Xbox 360, PlayStation 3, and PC), though no hard date was ever given before. In fact, despite the February 12 date announcement, the game's Wii U version still doesn't have a date. The Wii U logo has been moved to the bottom left-hand side of the unit, while the plus and minus buttons have been moved to the right. Chafee said, "What I understand is Copernicus is June of '13."<br /><br />Considering we've literally never heard any information on the Amalur-based MMO (aside from the fact that it's an Amalur-based MMO), it's a bit hard for us to believe that the game will arrive by next year. "I said from the beginning that it was a risky enterprise," Chafee told press of the troubled business deal between 38 and Rhode Island.<br /><br />38 Studios is supposed to start paying back its $75 million loan - facilitated by the state of Rhode Island and supported by bond investors - by the beginning of 2013. It's unclear how 38 will afford those payments, but Chafee repeatedly pointed out 38's intention to seek private capital (read: more money from private investors - and <em>not</em> from the state). The state's interest lies in protecting the taxpayers, balanced with keeping 38 Studios solvent, since "taxpayers have had a very generous deal for 38 studios," Chafee said.<br /><br />"It's time for them to go out and get private capital funding," Chafee said. "That's the deal. It's a generous deal, but stick to it."<br /><br />Rhode Island officials believe that the total of the $49 million loaned to 38 has been spent. Chafee said that until late April, meetings with 38 suggested that they would make their May payment. "I want to make sure we're doing everything possible to make sure 38 doesn't fail," Chafee said. "We're in deep." Everything possible except giving them more money."There's not going to be any money from the state. They're not coming here for easy money."<br /><br />According to Chafee, "Basically, the access to private capital hasn't materialized."<br /><br />38 Studios' next payment is a debt service payment due November 1 of $2.6 million, and Rhode Island officials believe the studio will have the capital to cover it.<br /><br />38 Studios will then owe $12.6 million in full annual debt service in 2013, and "that's on their dime," officials said.<br /><br />Chafee said he recognized the risk involved in starting a new gaming studio, but the state would have benefited greatly from the studio's "huge success" had it done well.<br /><br />"I said from the beginning that it was a risky enterprise," Chafee said. Regarding how 38 Studios will function if it doesn't have the funds to pay its employees, Chafee reiterated, "Again, these are the ramifications of being in a risky business."<br /><br />Chafee doesn't plan on taking a gamble of this nature again: "Never, never ever. The head of the RIEDC, Keith Stokes, who approved the $75 million loan to 38 Studios in 2010, <a href="http://www.wpri.com/dpp/news/local_news/providence/edc-director-keith-stokes-resigns">resigned</a> late last night.<br /><br />If 38 Studios does close, Rhode Island taxpayers will have to repay the <a href="http://www.joystiq.com/2012/05/15/if-38-studios-collapses-rhode-island-taxpayers-owe-112-6-milli/">$75 million bond (plus interest) through 2020</a>, but they'll <a href="http://www.joystiq.com/2012/05/16/rhode-island-owns-38-studios-intellectual-property/">own the intellectual property of the developer</a>, which would likely be sold at auction.<br /><br />If the company does make the payment to the state, the <a href="http://www.joystiq.com/2012/05/15/if-38-studios-collapses-rhode-island-taxpayers-owe-112-6-milli/">next round</a> will be owed in 2013. And one such person was <a href="http://www.wired.com/gamelife/2012/05/ff_unreal4/all/1?pid=2550">Wired's Stu Horvath</a>, who describes the two minute demonstration as "breathtakingly photo-realistic" in an exclusive reveal. The demo apparently follows the demon knight seen above, as he wakes from a frozen sleep ... only to set everything on fire. That scamp!<br /><br />The demo runs on Nvidia's Kepler GTX 680 - a graphics card often <a href="http://www.joystiq.com/2012/03/22/nvidias-next-gen-kepler-tech-detailed/">described as "next-gen"</a> - and it follows the armored demon dude as he shows off his fancy, graphics-heavy castle. Just 14 Epic employees put together the demo, which apparently runs in real-time within the Unreal Engine 4 environment (a feat for modern game engines, including UE3). Don't be surprised if we see this demo show up in a future Epic game - the company's past demos for Unreal Engine lead to some of Epic's biggest games.<br /><br />Lighting is also improved, according to the piece, with "dynamic lighting" within the engine rather than being individually implemented after the fact. "The number of man-years that required was astounding," Epic design director Cliff Bleszinski said. But with all the additions, Epic's new engine requires much more horsepower; horsepower for which Epic is pushing the likes of Microsoft and Sony. "In the meantime, we will continue to talk with 38 Studios and develop additional information, and will resume the Board meeting at our regularly scheduled meeting on May 21. The game will introduce a brand new mode called Spartan Ops, which tells the story of the UNSC Infinity, the massive ship that serves as <em>Halo 4's</em> multiplayer hub (pictured). Spartan Ops will serve as an episodic continuation of <em>Halo 4</em>'s campaign, with weekly cinematic episodes that "center on the UNSC Infinity leaders and crew, and a new team of Spartans - Majestic Squad." During today's financial briefing call to investors, THQ president and CEO Brian Farrell said <a href="http://www.joystiq.com/game/devils-third"><em>Devil's Third</em></a> no longer fits the publisher's "profitability profile."<br /><br />"The profitability profile for <em>Devil's Third</em> no longer met our internal threshold and we are currently in discussions with third parties regarding the future of this title," Farrell said. "There were a couple of unforeseen events that happened during the development of <em>Devil's Third. </em>One was the company that Valhalla was using for the engine went out of business, so we had to assist Itagaki and the team with a new engine - it took a fair amount of time and cost a fair amount of money."<br /><br />The other big issue was the appreciation of the Yen, which reduced <em>Devil's Third</em>'s potential for profit compared to other stuff in THQ's pipeline. "We think it's an excellent franchise; we've really enjoyed working with Itagaki-san, and we're going to explore other opportunities with him and others to make sure this product comes to market."<br /><br /><em>Devil's Third</em> is the first project from Tomonobu Itagaki's new development studio, <a href="http://www.joystiq.com/tag/valhalla-game-studios/">Valhalla Game Studios</a>. Rather than question the logistics of a budget re-release of a game that was never released in the first place, we'll celebrate the $19.99 price point under which it's coming out.<br /><br />Also joining the Nintendo Selects line are two bona fide Wii games, <a href="http://joystiq.com/game/super-smash-bros-brawl"><em>Super Smash Bros. Brawl</em></a> and the excellent <a href="http://joystiq.com/game/donkey-kong-country-returns"><em>Donkey Kong Country Returns</em></a>, at $30 each. Images sent to Joystiq by an anonymous tipster reveal an in-store display for Steam Wallet voucher cards in both $20 and $50 amounts. This bolsters the image that <a href="http://www.joystiq.com/2012/05/10/report-gamestop-to-start-selling-steam-vouchers-next-week/">made the rounds</a> last week, providing further evidence that the cards will indeed be going on sale at GameStops very soon.<br /><br />The upshot of all this, of course, is that GameStop will be selling gift cards for one of its major competitors, which is especially intriguing as the company has been working to build its own digital distribution platform for several years. We've contacted GameStop and will provide updates as this story develops.<br /><br /><strong>Update:</strong> GameStop has officially announced that it is indeed selling Steam Wallet cards as of ... <em>today</em>. They're available in $20 or $50 denominations. The developer is pushing back the release date of the next <a href="http://www.joystiq.com/game/tomb-raider-2012"><em>Tomb Raider</em></a>, from Fall 2012 into the first quarter of 2013. (Yes, the same quarter that now hosts another one of 2012's former heavy hitters, <a href="http://www.joystiq.com/2012/05/09/bioshock-infinite-delayed/"><em>Bioshock Infinite</em></a>.)<br /><br />"Our priority now is to make sure we fully deliver the very highest quality game," Crystal Dynamics Head Darrell Gallagher wrote. In a missive posted on the game's official forums, Gallagher shared the studio's push to make <em>Tomb Raider</em> "the best game of our careers." The delay will boost quality up to "a level that you deserve," he said.<br /><br />The shift in release date has also given us an unexpected sense of optimism. Developer "IceFrog," who's overseen the DOTA map since 2005, has gone to work for Valve on <a href="http://joystiq.com/game/dota-2"><em>DOTA 2</em></a>, while Blizzard has been working on its official variation of the game, previously called <em>Blizzard DOTA</em>.<br /><br />The mutual agreement means that Valve will get the rights to use the "DOTA" trademark commercially, so <em>DOTA 2</em>'s name won't change. Blizzard reserves the right for fans to <a href="http://www.joystiq.com/2010/10/25/blizzards-pardo-dota-belongs-to-community-not-valve/">use the trademark noncommercially</a>, but will give up the <em>DOTA</em> name for its official variant. That game will instead be called <em>Blizzard All-Stars</em>, "which ultimately better reflects the design of our game," said Blizzard executive VP Rob Pardo.
