One year after a being sued for allegedly infringing on a voice recognition technology patent, publishers Ubisoft, Electronic Arts, Sony Computer Entertainment, and Disney Interactive Studios have decided to settle the matter out of court, according to Gamasutra.<br />
<br />
On <a href="http://www.joystiq.com/2009/11/17/ubisoft-sony-ea-and-disney-sued-over-voice-recognition-patent/">November 10th, 2009</a>, Bareis Technologies, LLC filed a lawsuit claiming titles such as <em>SOCOM</em>, <em>Tom Clancy's EndWar</em> and <em>NASCAR</em> and <em>Phonics Quest</em>, infringed on a 1996 patent that outlined a process of speech recognition templates to be present on optical disks in order to access specific information and issue commands for control purposes. Originally, Bareis Technologies' patent was largely targeted towards accessing specific music tracks on audio CDs, making <a href="http://patft.uspto.gov/netacgi/nph-Parser?Sect2=PTO1&amp;Sect2=HITOFF&amp;p=1&amp;u=%2Fnetahtml%2FPTO%2Fsearch-bool.html&amp;r=1&amp;f=G&amp;l=50&amp;d=PALL&amp;RefSrch=yes&amp;Query=PN%2F5617407">no mention</a> of the concept being used to control game functions.<br />
<br />
According to the report, the U.S. District Court's Eastern District of Texas Tyler Division approved a motion applied by all defendants in the claim requesting a mutual dismissal on April 21, 2010. That, in turn, dismissed all counterclaims made in the process. He remained tight lipped about the identities of the two franchises, warning that if he exposes any more info, he'll "have to send Sam Fisher after you."<br />

Fortunately, Joystiq was able to get the scoop on these two games, and you'll <em>never</em> believe what they are. For the first time in ... hold on a second. Someone's at the door. Hello? In <a href="http://www.gamesindustry.biz/articles/christmas-market-brutal-for-new-ips-de-plater">a recent interview with Gamesindustry.biz</a>, Ubisoft's Michael de Plater, who served as creative director for <em>EndWar</em>, gave some context for the Q1 2010 release window for the developer's next strategy title, <a href="http://www.joystiq.com/tag/ruse"><em>RUSE</em></a>. It's fairly familiar territory -- de Plater explained, "it's a bit tough to launch a new IP exactly at Christmas when you're head-to-head with blockbuster sequels," and added that the RTS title was following in the footsteps of many <a href="http://www.joystiq.com/tag/delays">other <em>Modern Warfare 2</em>-fearing franchises</a>.<br /><br />That's just the thing, though -- de Plater mentions that the ol' Q1 shuffle is a popular move as of late. Ubisoft has reported that sales for its fiscal first quarter of 2009-10 (April through June) were down just over 50 percent from the same period a year ago. The publisher posted roughly $118 million (&euro;83 million) in sales last quarter; a <em>far cry</em> from the $240.24 million (&euro;169 million) cash injection from the first quarter of 2008-09. "We are currently experiencing a very sharp slowdown in our sales for Nintendo DS as well as sales of back-catalog titles, in the context of a market that is tougher than anticipated," CEO Yves Guillemot said. During today's conference call, Guillemot repeatedly singled out <em>Prince of Persia</em> and <em>EndWar</em> as the top under-performers of the company's recent back catalog.<br /><br />Unsurprisingly, Ubisoft has revised its second quarter target ... straight downward. The voice-controlled RTS <em><a href="http://www.joystiq.com/tag/EndWar/">EndWar</a></em> didn't garner the most media attention. But, with 1.5 million units sold, it certainly warrants a sequel. Ubisoft Shanghai is creating a follow-up using a "smaller team,"creative director Michael De Plater told <a href="http://www.videogamer.com/news/ubisoft_shanghai_working_on_endwar_sequel.html">VideoGamer.com</a>. With <em>EndWar</em>'s successful implementation of voice controls, the development team can focus on one of the most lacking aspects of the original: the presentation of the single-player campaign. "After the first one, now we have a really good understanding of what to do ... Giving more attention to the single-player is straightforward to address and will make the game a lot of fun."<br /><br />While De Plater is quick to highlight faults being addressed for the sequel, he remains proud of his team's accomplishment with the first game. While still under the "Tom Clancy" moniker, he considers <em>EndWar</em> an original IP. Considering the challenges that surround launching a new IP, De Plater is more than happy with sales numbers. "We still sold more than <em>Red Alert 3</em>, sold more than <em>Company of Heroes</em>, sold more than <em>World in Conflict</em>. It's still, along with <em>Halo Wars</em>, the biggest new RTS in the last four or five years. Speaking with <a href="http://www.vg247.com/2009/07/15/natal-could-add-minority-report-type-feeling-to-console-rts/">VG247</a> at the Develop Conference in Brighton, UK, <em><a href="http://www.joystiq.com/tag/Endwar/">EndWar</a></em> development boss Michael de Plater said that he thinks Microsoft's <a href="http://www.joystiq.com/tag/project-natal">Project Natal</a> could reinvigorate the console (<a href="http://www.joystiq.com/2009/07/15/bill-gates-reckons-natal-should-head-to-pc-too/">and PC?</a>) RTS market. Comparing Natal's potential "power" and "precision" to menu scrolling in the film <em>Minority Report</em>, Plater anticipates Natal's combination of voice and gesture control to potentially be "really powerful and immersive."<br /> <br />During <a href="http://www.joystiq.com/tag/@E32009/">E3 2009</a>, Ubisoft showcased the upcoming RTS <em><a href="http://www.joystiq.com/tag/RUSE/">RUSE</a></em> on Microsoft's touch-screen-enhanced Surface table. While Plater knows the <a href="http://www.microsoft.com/surface/Pages/HowToBuy/HowToBuy.aspx">$12,000 home furnishing</a> isn't going to be a regular household accessory, Project Natal has the potential to work with software in a similar fashion. Ubisoft's <a href="http://www.joystiq.com/tag/endwar"><em>Tom Clancy's EndWar</em></a> producers likely had that thought running through their heads when they decided to release two new maps for the grand total of <em>nothing</em>. That is correct: the "Veteran Map Pack" is now available as a free download from the PlayStation Store and Xbox Live Marketplace.<br /><br />Russia's Cosmodrome and the Strategic Petroleum Reserve in Richton, Miss. are the pair of new battlegrounds in question, letting players visit the former Soviet Union's equivalent of Cape Canaveral and the place where they make Vaseline. What? Oh, it's not <em>that </em>kind of petroleum? Sadly, player-requested voice commands such as "Make me a sammich!" and "Get bent!" have not been included along with the maps. <em>Those </em>we'd pay for.</div>

Ubisoft has given <a href="http://www.joystiq.com/2009/01/06/i-am-alive-i-am-first-person-i-am-not-a-jade-rayond-game/">first-person</a> disaster-survival title <a href="http://www.joystiq.com/tag/i-am-alive"><em>I Am Alive</em></a> an enigmatic March release window. That puts the launch anywhere from six to ten weeks from now, a very short amount of time considering we've seen approximately <em>zilch</em> in terms of gameplay footage. After being hyped up so much <a href="http://www.joystiq.com/2008/07/15/ubisoft-to-declare-i-am-alive-in-spring-2009/">at E3</a>, there's been little to no promotion for the game. Ubisoft is deploying new downloadable content tomorrow for <em>Tom Clancy's EndWar </em>(via <a href="http://xboxlive.ign.com/articles/936/936874p1.html">IGN</a>)<em>. </em>The Escalation Pack includes four new maps, three new unit upgrades, and 10 new Achievements and Trophies for Xbox Live and PS3, respectively. The pack will be 800<img border="0" src="http://www.blogcdn.com/www.xbox360fanboy.com/media/2007/11/microsoftpointslogosmall.gif" alt="" /> ($9.99) and will be released simultaneously for both consoles.<br /><br />Additionally, a free title update is also due out tomorrow (only for Xbox 360; the PS3 patch is expected sometime in 2009). In addition to this, it's apparently going to be <em>awesome</em>, what with giant firefights breaking out right in front of the US Capital Building, France's Eiffel Tower, and even the Kremlin. Seriously though, why not? If the world just <em>has</em> to be embroiled in a massive war, said war might as well take place in some dramatic places, right? Really, need we say more?<br /><br />No joke, the official <a href="http://www.gametrailers.com/player/42075.html"><em>EndWar </em>video</a> you see above features two talking birds named Walter and Polly who are sitting on a custom apparatus and talking into Xbox Live headsets while their "owner" instructs them on tactical <em>EndWar</em> maneuvers. We're not sure what to make of the video, but it did get us thinking. What other animals could be taught to play <em>EndWar</em>? We have a cat that can sorta meow the alphabet. Fans eager to engage in some voice-activated, real-time strategy on their favorite handheld systems ... will have little interest in the rest of this post! Ubisoft has detailed the PSP and DS versions of <a href="http://www.joystiq.com/tag/endwar"><em>Tom Clancy's EndWar</em></a> -- both of which launch alongside their bigger <a href="http://www.joystiq.com/2008/10/15/tom-clancys-endwar-demo-deployed-on-xbox-live/">console brothers</a> on November 4th -- and made it apparent that warmongers on the go are in for a markedly different experience.<br /><br />Developed by Funatics Software, the portable pair presents "turn-based strategy with a twist," allowing simultaneous move and attack phases which render the experience as intense and authentic as real-time strategy -- it says here. Other relevant features include three campaigns, over 20 units per faction, a two-player versus multiplayer mode, a mission editor, stylus controls on the Nintendo DS and, judging by the screenshots, <em>somewhat</em> less realistic graphics. Ubisoft is bringing yet another Tom Clancy game to the handhelds. This time, <em>EndWar</em> is getting the PSP treatment. The upcoming game takes place during World War III. Players take control of the U.S. Joint Strike Force, European Enforcers Corps or Russian Spetsnaz Guards Brigade in three separate (but intertwined) campaigns. Each campaign includes over 30 battle scenarios taking place on real-world battlefields including Paris and London.<br /><br /><em>EndWar</em> also features two-player versus multiplayer mode, including additional missions specifically designed for multiplayer battles. There's also a mission editor, which allows players to share and create custom battlefields and scenarios. If you read our <a href="http://www.joystiq.com/2008/07/21/joystiq-e3-hands-on-tom-clancys-endwar/">E3 hands-on</a> of <a href="http://www.joystiq.com/tag/endwar"><em>Tom Clancy's EndWar</em></a>, you'd know that we were rather surprised by how well the real-time strategy game's voice commands worked. Rather than function as a vector for our usual hate speech and bigotry, the Xbox 360 headset could now allow us to command our armies from afar and pick fights by proxy. It's just how we envisioned the future of warfare, minus the odd laser or two.<br /><br />You don't have to take our word for it, though, as Ubisoft has announced that a public demo is now available on the Xbox Live Marketplace. The sampler includes a single-player tutorial, as well as a one-on-one multiplayer map with matchmaking support. While <a href="http://www.joystiq.com/2008/09/19/ubisoft-announced-vip-endwar-demo/">some lucky gamers</a> have been enjoying the <a href="http://www.joystiq.com/tag/endwar"><em>EndWar</em></a> demo for some time now, it's finally the rest of the public's turn to try out Ubisoft's voice controlled real time strategy title. The demo includes both single player and online multiplayer, so there should be plenty for everyone. We gave the demo a quick try and the voice control is definitely cool, although we have to admit it's a bit confusing at first. Of course, the demo doesn't really lay out every voice command, though there is a limited tutorial of sorts (you might want to look at <a href="http://www.joystiq.com/2008/09/26/tom-clancys-endwar-unit-breakdown-trailer/">this video</a> for some pointers). Still, the voice control is surpisingly efficient. The RTS game places you in 2020 during World War III. You can play as three factions: the Russian Spetsnaz Guards Brigade, the European Federation Enforcers Corps and the United States' Joint Strike Force. Sounds like typical Tom Clancy fare to us. "So for Ubisoft turnover Europe is actually more important than the US now, and by more than 5 per cent. This is it, folks. The winners of the official Game Critics Awards for E3 2008 - as chosen by 36 representatives (including yours truly) from most of the leading video game outlets - have been revealed. Leading the pack with two wins each are <a style="font-style: italic;" href="http://www.joystiq.com/tag/Fallout-3/">Fallout 3</a> - winner of "Best of Show" and "Best RPG" - along with <a style="font-style: italic;" href="http://www.joystiq.com/tag/LittleBigPlanet/">LittleBigPlanet</a> - winner of Best Console game and Best Social/Casual/Puzzle game.<br /><br />The top publisher was EA (just like in <a href="http://www.joystiq.com/2008/07/31/the-joystiq-e3-2008-awards/">our own awards</a>) with five wins, while Sony took second place with an impressive three wins. In terms of platform concentration, the Xbox 360 barely edged out the competition with eight wins versus both the PC and PS3's seven (for those of you keeping track, the Wii only managed one win and that was for its version of <span style="font-style: italic;">Madden 09</span>). Please, listen to me."<br />"Downloading latest DLC."<br />"Oh ... just forget it."<br /><br />This doesn't happen in <span style="font-style: italic;">Tom Clancy's EndWar</span>. It may be a sad comment on the history of in-game voice commands, but the best compliment one can give to Ubisoft's robust interface is that it works. There's no need to plead with it in a robotic tone or a slowed pace, and no voice training is required beforehand. Despite slipping in an "uh" here and there while contemplating orders, <span style="font-style: italic;">EndWar</span> understood everything we said. While screaming commands into a headset <a href="http://www.joystiq.com/2008/07/15/tom-clancys-endwar-launching-oct-14/">Joystiq</a> found a moment to extrapolate release information from UbiSoft for the upcoming RTS, <em><a href="http://www.joystiq.com/tag/EndWar/">Tom Clancy's EndWar</a></em>. According to the rep <em>EndWar</em> will ship on October 14 in Europe and North America.<br /><br />What? Not familiar with <em>Tom Clancy's EndWar</em>? While barking orders into a headset and commanding our tanks to ineffectually <strike>annihilate</strike> agitate the enemy army, we received some release date intel for upcoming tanks-go-here-helicopters-go-there skirmish, <a href="http://www.joystiq.com/tag/endwar"><em>Tom Clancy's EndWar</em></a>. According to Ubisoft, the console-oriented, real-time strategy game will march onto shelves in the US and Europe on October 14th. It'll launch on PlayStation 3 and Xbox 360 first, followed by PSP and DS versions at a later stage. <strong>Update: </strong>Descending upon the footage with ninja swiftness (we assume) the video leak of <em>EndWar</em> has been pulled. With the beta ending in a few days we recommend that anyone attempting to do it again just let bygones be bygones and wait for some new, non-NDA footage. Or at least don't mention us 'cuz we think you're crazy!<br /><br />A <a href="http://www.joystiq.com/2008/06/18/nda-broken-endwar-beta-video-leaked-online/">few weeks ago</a> we reported an <em><a href="http://www.joystiq.com/tag/EndWar/">EndWar</a></em> beta tester leaked footage of the upcoming Tom Clancy RTS title -- non-disclosure agreement be damned. While reactions to our report of the leak were mixed, <a href="http://www.joystiq.com/tag/Ubisoft/">Ubisoft</a> ended the controversy by putting the kibosh on the video. A little over an hour ago the same tester took it upon himself to upload a new clip of the beta -- which ends on July 7 -- taking our joking advice to "get a capture card, buddy."<br /><br />While we don't condone the action or recommend that anyone leak footage of anything under NDA, we chuckled when our name came up. At least we know someone listens to the dog and pony show that is the <a href="http://www.joystiq.com/tag/fancast">Xbox 360 Fancast</a>.<br /><br />Also to give credit where it's due, it was our commander-in-chief (Rich) who threw out the capture card recommendation. Feeling down because you weren't selected to participate in Ubisoft's closed beta of <em><a href="http://www.joystiq.com/tag/EndWar/">Tom Clancy's EndWar</a></em>? Well, pucker up soldier! Today <a href="http://www.joystiq.com/tag/Ubisoft/">Ubisoft</a> has released more beta codes to gamers who have yet to hear back regarding the test, which ends on July 7. Still shrouded <a href="http://www.joystiq.com/2008/06/18/nda-broken-endwar-beta-video-leaked-online/">behind a curtain of NDA mystery</a>, the RTS console title began initial online testing of its multiple modes and three multiplayer maps on June 17 with a rumored 15,000 players.
