Beyond the beautiful smiling faces of the group's membership, expect to meet a variety of folks from the game industry: developers, journos ... maybe even Super Mario himself! (Sorry, we couldn't help it.)<br /><br />If that excitement isn't enough for you, there's also a ton of arcade games running on quarter plays and a great selection of delicious beer. That said, it probably goes without mention that this is a 21 and up event. As part of "Operation: Game Over," over 3,500 of accounts have been removed from various gaming services run by "Microsoft, Apple, Blizzard, Electronic Arts, Disney, Warner Bros. and Sony."<br /><br />The purge was done with the consent of each company. Xbox Live is the only service explicitly mentioned in the press release, though each company certainly has recognized services, including PlayStation Network, Origin, Game Center, Battle.net, etc.<br /><br />The press release notes that New York law requires sex offenders to provide the state with email addresses and screen names, which can then "be made available to certain websites so they can purge potential predators from their online networks." This marks the first time the law has been applied to gaming services. Vice president and deputy general counsel Rich Wallis noted that the company is "supportive of Attorney General Schneiderman's efforts to make the Internet, including online gaming environments like Xbox LIVE, safer for everyone."<br /><br />This isn't the first time that A.G. Schneiderman has delved into the world of video games. Look, we're gonna be upfront about this, we're a little biased -- okay, <em>I'm</em> a little biased -- toward any news involving the New York Game Critics Circle (I'm the standing member for Joystiq), but we're putting together an awards show and it's gonna be <em>totally boss</em>. On February 2, a gaggle of us are taking over New York University's Cantor Film Center and holding an awards show to honor the best games of 2011 -- what we consider to be 2011's best, anyway.<br />
<br />
Founding member (and occasional NPR correspondent) Harold Goldberg is heading up the proceedings with some assistance from various NYGCC members, while an unannounced, well-known voice man is on tap to MC the event. The first annual awards show will take place on February 2 and we've dropped the entire list of nominees after the break. It'll also be open to the public with limited seating, which we'll have more info on in the coming weeks.<br />

According to a report published by <a href="http://www.bloomberg.com/news/2011-05-04/sony-said-to-be-subpoenaed-by-new-york-over-data-breaches-1-.html">Bloomberg</a>, an anonymous source have revealed the latest entity to whom Sony Corp. must answer regarding last month's <a href="http://www.joystiq.com/game/psn-outage-2011">PlayStation Network security breach</a>: New York Attorney General Eric Schneiderman. The source says Schneiderman has subpoenaed Sony to gather information about the breach, specifically regarding Sony's six-day delay in telling PSN users about the exposure.<br />

The reported request sounds a heck of a lot like <a href="http://www.joystiq.com/2011/04/30/congress-sends-inquiry-to-sony-about-psn-security-breach/">the inquiry filed</a> by the United States House of Representatives Subcommittee on Commerce, Manufacturing, and Trade, which a Sony representative has <a href="http://www.joystiq.com/2011/05/04/sony-responds-to-congress-with-open-letter-suggests-anonymous/">already responded to</a>. We suggest they save time with a quick copy/paste, and then get back to making it so we can play <a href="http://www.joystiq.com/game/portal-2"><em>Portal 2</em></a> online again. Ah, the July 4th weekend. The perfect time for grilling hot dogs, setting off fireworks, jumping in the pool, and ... hockey? That's what 2K Games wants you to think about -- it's sending an <a href="http://joystiq.com/tag/nhl-2k11"><em>NHL 2K11 </em></a>recreational vehicle on the road this summer, giving you a chance to play the new game in a town near you. The RV started at E3 a few weeks ago in LA, and after a quick stop in Santa Monica next week, it's off to the wild roads of the United States and Canada (the full schedule is after the break).<br />

In an interview with <a href="http://www.vg247.com/2010/04/22/interview-crysis-2-author-richard-morgan-part-1/">VG247</a>, science fiction author Richard Morgan had some interesting things to say about his writing role on <em><a href="http://www.joystiq.com/tag/crysis-2">Crysis 2</a></em>, the upcoming shooter set in a crumbling New York City. It's an industry role with a "soft" template, he explained, and it's not one without some familiar challenges. We're still dealing with a sequel and a superguy shooting aliens, after all.<br />

"I hate the Big Mac aesthetic of pop culture," Morgan said, "which is, you know, sequelitis: 'We're going to give people exactly what we gave them last time, because they liked it, so let's do exactly the same.'" Avoiding that aesthetic and eating healthy, as it were, requires some fresh ingredients. "If we can beat that Big Mac mentality and keep delivering fresh stuff, and something fresh gives the consumer something really fresh to do, then I'm happy, because when I'm doing fresh stuff that's when I'm most awake. With the Crytek experience so far, I'm very awake."<br />
<br />
We like the Big Mac explanation, but it's still big talk before <em>Crysis 2</em> launches this holiday. Cuomo is <a href="http://www.ag.ny.gov/media_center/2010/jan/jan27a_10.html">investigating</a> several well-known retailers, including <a href="http://joystiq.com/tag/gamestop">GameStop</a>, for deceptive advertising practices. According to the office's announcement, GameStop and 21 other businesses are directing consumers to fraudulent discount programs where they unknowingly share credit card information with a third party. These third-party programs then place recurring charges on customers' accounts. "Well-known companies are tricking customers into accepting offers from third party vendors," said Cuomo, "which then siphon money from consumers' accounts."<br />
<br />
Online movie ticket company Fandango has already agreed to stop the practice and pay $400,000 to a consumer redress fund. The Attorney General's office rightly warns that consumers should take care in reading all fine print when signing up for any kind of discount offer.<br />

Are there any Joystiq readers out there that have run into this problem with GameStop? (You might want to check your credit card statement before you answer that.)<br />

<div style="text-align: left;">According to a report by <a href="http://www.informationweek.com/news/government/state-local/showArticle.jhtml?articleID=221900336">InformationWeek</a>, the state of New York is in the planning stages of a revamped emergency broadcast system capable of sending alerts to Xbox Live (and presumably other console online services) in the event of a natural disaster, terrorist attack or other not-so-good event. The state's deputy chief information officer says the idea makes sense "<span id="articleBody">considering the amount of time our youth spend on video games."<br />
<br />
No specifics of how the system would <em>actually work</em> were provided, but we'd hope those who heed the warnings would get Achievement points for doing so. After all, it'd mean taking precious time away from griefing other players in <em>Modern Warfare 2</em>.<br />

<strong>Update:</strong> Activision shot us an email to point out that "Activision has not given any retailer permission to sell <em>Modern Warfare 2</em> prior to the Nov. 10 street date. The company fully supports the Nov.10 street date." It seems that a whole mess of folks are breaking street date and selling the game early. If you snagged a copy already, enjoy!<br /><br />Poor, poor GameStop. As the gaming public's anticipation for <a href="http://www.joystiq.com/tag/modern-warfare-2"><em>Call of Duty: Modern Warfare 2</em></a> approached critical mass, they faltered in their loyalty, and took their business to small "mom and pop" game retailers who had broken the game's street date. Fortunately for the retail juggernaut, Activision showed compassion for its plight, and agreed to let certain GameStops in a few Northeast states start selling the game before Tuesday in order to help combat these <em>vicious</em> local businesses.<br /> <br /> We've been receiving tips all morning from folks living in New York and Pennsylvania (and <a href="http://kotaku.com/5399552/northeast-us-gamestops-selling-modern-warfare-2-early">Kotaku reports Ohio as well</a>) stating that they were able to find the game on sale at their local GameStop. If you live in one of those Northeastern states, you might want to go ahead and call your local 'Stop to see if it's one of the stores which was granted special permission. New York doesn't want you distracted while steering that 2,500 lb. hunk of <strike>metal</strike> plastic, according to a recently passed bill brought to our attention by <a href="http://www.bizjournals.com/buffalo/stories/2009/07/13/daily46.html">Buffalo Business First</a>, banning all kinds of behind-the-wheel diversions. If you often enjoy a quick round of <em><a href="http://nintendo.joystiq.com/tag/retro-game-challenge">Retro Game Challenge</a> </em>or <em><a href="http://playstation.joystiq.com/tag/patapon">Patapon</a> </em>while at a stop light, know the cops would be able to confiscate your handheld and totally erase your game<em> </em>saves. Okay, we made that up. Offenders would actually get a $150 fine.<br /><br />The new law (much like <a href="http://www.joystiq.com/2009/05/06/honolulu-mayor-bans-mobile-electronic-devices-while-driving/">Hawaii</a>'s) doesn't just apply to games and, should it pass, will make a number of activities on your phone (text, surf the web, hold it up and look at it) illegal to do while driving. It's early 2009, we've just elected a new President, and there are quite literally a mountain of problems to be addressed on Capitol Hill. Our economy has been in substantial turmoil for roughly six months, with some problems stretching back for years. Many states are at or near bankruptcy. This economic crisis has, by now, hit every country on the planet to some degree. So, our legislators have spent the last two months rushing to put together proposals to regulate video games. No, no one's undivided attention has been on the economy during this complete mess. Instead, since the start of the year, it seems there has been an explosion of potential new video game regulations, from Jack Thompson's bill in <a href="http://www.joystiq.com/2009/02/06/jack-thompson-writes-bill-for-utah-tries-new-angle/">Utah</a>, to <a href="http://www.joystiq.com/2009/02/05/ny-strikes-again-with-another-video-game-bill/">New York</a>, to the <a href="http://www.joystiq.com/2009/01/13/and-the-band-fails-on-new-law-seeks-to-put-warning-labels-on-ga/">US Congress</a>, to <a href="http://www.gamepolitics.com/2009/02/04/australia-mmos-may-be-target-police-crackdown">Australia</a> -- just to name a few. New York is <a href="http://www.joystiq.com/2008/06/30/the-political-game-ny-video-game-bill-barks-doesn-t-bite/">quite notorious</a> for its <a href="http://www.joystiq.com/2009/01/29/new-york-bill-could-put-violent-games-under-lock-and-key/">hard-line stance</a> on <strike>the war against</strike> video games. In this latest episode of 'New York State versus gaming,' Assemblyman Steven Englebright (D) <a href="http://assembly.state.ny.us/leg/?bn=A04004">wants to pass a bill</a> which requires retailers to place epilepsy and game-induced seizure warnings "on every video game." Englebright has been trying to push this bill through for the past eight years, according to <a href="http://www.gamepolitics.com/2009/02/04/ny-bill-would-require-seizure-warnings-game-retailers">GamePolitics</a>; which is quite funny, considering that all retail game boxes already contain those very same warnings Mr. Englebright is fighting for. Thanks, New York, for working on yet another <a href="http://www.joystiq.com/2008/07/22/new-york-governor-signs-unnecessary-game-law/">redundant law</a>.<br /><br />But wait, hold the phone. Mr. Englebright's work wasn't all done in vain. There's still the business of games <a href="http://www.joystiq.com/2008/07/22/rumor-wipeout-hd-held-up-by-epilepsy-tests/">not sold at retail</a>. It's not exactly the same as keeping pornography behind that threadbare red curtain in the back of the video store, but it's close. GamePolitics <a href="http://www.gamepolitics.com/2009/01/28/ny-bill-might-keep-nasty-games-locked-container">reports</a> that New York assemblyman Brian Kolb (R) has submitted <a href="http://assembly.state.ny.us/leg/?bn=A02837&amp;sh=t">a new bill</a> -- which looks <em>awfully</em> similar to <a href="http://www.joystiq.com/2007/03/13/new-york-may-confiscate-unrated-games/">a bill he submitted in 2007</a> -- that would place some serious restrictions on games "advocating or glamorizing" a whole rainbow of illicit activities including "commission of a violent crime, suicide, sodomy, rape, incest, bestiality, [and] sado-masochism," among other things.<br /><br />The law would require New York retailers to apply warning labels to any game that contained such activities and, furthermore, all such games would need to be kept in a "sealed and locked container" inaccessible to customers -- something most retailers already do for <em>all</em> games. Retailers who do not comply -- or "non-custodial" adults who purchase regulated games for minors -- would be subject to a fine of up to $1,000.<br /><br />Of course, the ESRB <em>already</em> labels the content of every game sold in North America. That's not good enough for the New York legislature -- which <a href="http://www.joystiq.com/2009/01/13/and-the-band-fails-on-new-law-seeks-to-put-warning-labels-on-ga/">should be apparent</a> by now -- as the bill states that ESRB labels are "insufficient warnings" for concerned parents and that minors are purchasing violent games "with little or no resistance from retailers". This is in spite of the fact that it's actually <a href="http://www.joystiq.com/2008/05/09/kids-finding-it-harder-to-buy-m-rated-games/">harder for kids to obtain M-rated games</a> these days. New York Governor David Patterson has signed some of the most ... well, put it this way, if you like the government wasting time, then you're going to <em>love</em> the recently signed New York game bill. <a href="http://www.gamepolitics.com/2008/07/22/breaking-new-york-governor-signs-video-game-bill-law">GamePolitics</a> reports the legislation establishes an advisory council to conduct a study between games and real-world violence. It also requires -- here's the kicker -- new video game consoles to incorporate parental lockout features by 2010 and retail games to disclose ESRB ratings. News flash: All consoles already have parental lockout features built in and <a href="http://joystiq.com/tag/esrb">ESRB</a> ratings are prominently displayed on each game's box and disc.<br /><br />For its part, the Entertainment Software Association believes the law ignores "legal precedent, common sense and the wishes of many New Yorkers in enacting this unnecessary bill." It points out that the mandates required are already voluntarily in place and the bill unfairly singles out the video game industry. The ESA asks if New York would like to convene a government commission on books, theater and film as well. In voting overwhelmingly for the bill, New York became the first state to pass a video game law since June, 2006 when lawmakers in Oklahoma, Louisiana and Minnesota all sent restrictive game legislation to their respective governors for signature. The video game industry opposed all of those laws, of course, on constitutional grounds. Since Gov. David Paterson is expected to sign the New York bill into law, there's a natural assumption that the industry will also drag the Empire State into federal court.<br /><br />But maybe not.<br /><br />While earlier state laws placed content-based restrictions on video game sales, New York's proposed statute does no such thing. <div align="left">The poor <a href="http://playstation.joystiq.com">PSP</a> has spent <em>most</em> of its life getting kicked in the teeth by the rampaging DS in all major regions; even taking into account its recent strong performance <a href="http://www.joystiq.com/tag/another-week-in-japan">in Japan</a>, there's no doubt that Sony's machine has come in a firm second place. But look, here comes MTV's Stephen Totilo, and he's bearing good news for Sony executives everywhere: the PSP is the most popular handheld in New York City! Well, alright, on the New York City <a href="http://www.joystiq.com/2007/08/26/promotional-consideration-underground-brain-training/"><em>subway</em></a>. Okay, on the New York subway's "<em>C Train</em>". Hey, the little victories count as well!<br /><br />Totilo reached this summary through the simplest, most non-scientific method ever: over the course of a year, he mentally tallied up how many of each handheld he saw played on the subway, and eventually counted 67 PSPs, 44 DSes, 6 Game Boy Advances, and 0 <a href="http://en.wikipedia.org/wiki/Gizmondo">Gizmondos</a>. While he treats his findings light-heartedly (as you should), Totilo concludes that this preference for the PSP is due to the typical subway commuter being older and having a higher disposable income and being on the same subway train as Stephen Totilo.<br /><br />It's a very specific survey.</div>

Atari has dished out some new screens from upcoming title <a href="http://www.joystiq.com/2008/04/29/alone-in-the-dark-producer-demonstrates-wii-controls/"><em>Alone in the Dark</em></a>. Most of the shots feature protagonist Edward Carnby navigating dark and spooky environments. We even get a glimpse of old Ed's car, as he speeds around the abandoned streets bordering <a href="http://www.joystiq.com/2007/11/19/alone-in-the-dark-gets-on-the-adversite-bandwagon/">Central Park</a>. Personally, we like a good scare every now and then. The Center for an Urban Future, a Manhattan-based think tank, has a <a href="http://www.nycfuture.org/images_pdfs/pdfs/GettingInTheGame.pdf">report</a> on New York's growing games industry. <a href="http://www.gamedaily.com/articles/news/study-new-york-citys-game-industry-shows-potential/?biz=1">GameDaily</a> reports that Take-Two and Atari, along with 30 game development companies and some 55 firms related to the industry, have a presence in the city that never sleeps. The size of the community is way behind cities like Seattle, San Francisco and LA, but there are approximately 1,200 people working within the industry around NYC.<br /><br /><a href="http://www.igda.org/">IGDA</a> Executive Director Jason Della Rocca says that although one would think NYC would be an "ideal place" for game developers, he points out that even Boston has a larger community. He explains that five or six years ago there has almost nothing in NYC, but that some casual game firms and a couple major studios have changed that. (Forgive us for what we're about to write.) So, start spreading the news, game developers are longing to stay. I'm still anticipating its Fall, 2008 360/PC/PS3 release, assuming it ships on time. I think it could be an exciting third-person action/mystery. But I'm uncertain about if it will become a cohesive experience by then; I saw well-executed elements but I'm not sure if they will combine.<br /><br />And admittedly,<em> Prototype's </em>open-world scope is much too big to take in from a single demonstration. The fast, physical action and control look better than other games, with the player able to change fighting techniques and attacks at any moment. Developer Radical Entertainment didn't spill too much about the story, only repeating that you play an amnesiac with the ability to morph into other peoples' identities.<br /><br />I hope that plot can connect to the action. I think it could, especially because the character gains the memories and abilities of the identities he steals. And while the anti-hero is becoming a cliche, Radical stressed that you're not trying to save Manhattan from its plague of monsters. Celebrating this weekend's <em>Mario Kart Wii</em> launch, Nintendo is offering New Yorkers a free cab ride this Thursday, April 24. According to the press release, just head over to the Sheraton Hotel (811 7th Ave., between 52nd and 53rd streets) between 8:00 and 10:00 am or 12:00 and 2:00 pm to roam the city on Nintendo's tab.<br /><br />We at Joystiq would like to caution you, though, that just because the cab driver <em>looks</em> like Mario doesn't mean he's part of the deal. It's called <em>Spider-Man: Web of Shadows</em> and will once again feature the tried-and-true sandbox mechanic of a fully-explorable New York City. Other than that, we know that the game is being worked on by Treyarch and Shaba Games and will feature some kind of system that allows for customizable superpowers. Also, players will have some control in determining whether they want to be the boyscout do-gooder or a more selfish anti-hero type.<br /><br />Perhaps even cooler than the news of there being a new game is word that Activision will be holding auditions for folks to do the voiceover work in the game at their booth at the upcoming New York Comic-Con. A 20-year old male was arrested in Spokane, Washington this past weekend for stalking a 15-year old girl he met online playing <em>Halo</em> (the report does not specify which iteration). The accused was from Saratoga Springs, New York, which means by our estimations he drove <a href="http://maps.google.com/maps?f=d&amp;hl=en&amp;geocode=&amp;time=&amp;date=&amp;ttype=&amp;saddr=Saratoga+Springs,+NY&amp;daddr=Spokane,+WA&amp;sll=44.527843,-95.625&amp;sspn=32.673172,59.765625&amp;ie=UTF8&amp;z=4&amp;om=1">around 2,600 miles</a> in order to drive past the girl's house and send her a text message. <br /><br />According to Seattle news outlet <a href="http://www.komotv.com/news/local/12936862.html">KOMO-TV</a>, the parents of the girl caught his license plate number as he passed and called the police. He has been charged with a felony count of stalking. But, if you live in or around the New York city area, there's one place that's getting Wii shipments on a daily basis: the Nintendo World Store.<br /><br />New York City's Rockefeller Center is no stranger to crowds. But, it's been commented that multiple people have been lining up outside of the Nintendo World Store each morning, as the news of consoles being seen at the store each morning gets passed around, with "at least 20 [Wiis] lined up behind the main counter. Just Wii boxes waiting for the next person in line." Bag, please open and release cat.<br /><br />If you live in the city, you might want to check this out.
