Konami and Harmonix have settled their dispute originating in a <a href="http://www.joystiq.com/2008/07/10/konami-lodges-patent-suit-against-harmonix-mtv-over-rock-band/">2008 lawsuit</a> launched by Konami, reports <a href="http://www.bloomberg.com/news/2010-09-17/viacom-fiskars-uwajimaya-news-corp-pilgrim-intellectual-property.html">Bloomberg</a>. According to a filing in federal court in Texas this week, the two parties agreed to dismiss "all claims and counterclaims" in the suit, which alleged that Harmonix's <em>Rock Band</em> infringed upon patents owned by Konami.<br />
<br />
Additionally, a <a href="http://www.joystiq.com/2009/02/13/konami-counter-sued-by-viacom-over-rock-revolution/">2009 countersuit</a> by parent company Viacom on behalf of Harmonix was dropped yesterday in a filing in federal court in Boston. At first, we assumed that the company was rewarding customers for freeing up much needed shelf space. Alas, it is not so. Rather, it seems that <em>Rock Revolution</em> has been relegated to but one, rickety step above landfill status. It has hit the very, <em>very</em> bottom of the bargain bin.<br />
<br />
We're not sure if this sale is going on at all Best Buy locations, but it <em>might</em> be worth checking your local store just for <em>posterity</em>. Bring a camera, because this may be the only time you will ever see a new, sealed game for five bucks. We're not suggesting you actually <em>buy</em> it, of course.<br />

Last July, Konami <a href="http://www.joystiq.com/2008/07/11/mtv-games-finds-konamis-rock-band-lawsuit-surprising/">filed a lawsuit</a> against Viacom, parent company of <em><a href="http://www.joystiq.com/tag/rock-band">Rock Band</a> </em>developer Harmonix, claiming the game infringed on patents it held for music titles utilizing guitar controllers. After six months of silence, Harmonix has decided to <em>sue back</em>, claiming <em>Rock Band </em>actually improved on Konami's patents -- and <a href="http://www.joystiq.com/tag/rock-revolution"><em>Rock Revolution</em></a> is, in fact, infringing on Viacom patents. Confused yet?<br /><br />The gist of Harmonix's counter-suit involves a claim <em>Rock Revolution</em> is actually more like <em>Rock Band</em> than Konami's <em>GuitarFreak </em>franchise, the design of which is likely the basis of the original suit. We naturally picture all of this unfolding <em>Phoenix Wright </em>style, but the reality is most likely far, far less interesting. <div align="left">We don't know what to make of Konami's DS version of <em>Rock Revolution</em>. The PS3/360 version is pretty <a href="http://www.joystiq.com/2008/07/21/witness-the-on-stage-rock-revolution-press-conference-failure/">easily summed up</a>: it's <em>Rock Band</em> + a ridiculous drum - a functional GUI. While <em>Rock Revolution</em> screams "me too" on the home consoles, it's a rather innovative concept for Nintendo DS. Shouldn't that be commended?<br /><br />Perhaps, but the ambitious concept is marred by lackluster execution. <em>Rock Revolution</em> DS gives players different ways of playing for the drums, guitars and yes, vocals. For better or worse, Konami has opted not to include a <a href="http://www.joystiq.com/2008/03/19/guitar-hero-on-tour-and-guitar-grip-ds-peripheral-revealed/"><em>Guitar Hero</em>-esque peripheral</a> with its game, relying exclusively on touch-screen controls for the guitar sections of the game. Unfortunately, this turns out to be a rather uninvolved process. Icons appear from the top left and right of the screen, with arrows pointing in the direction the player should swipe their stylus. <em>That's it</em>. Even in the more challenging difficulties, swiping the stylus up and down gets plain ol' tiresome after a while.<br /><br />The drums in <em>Rock Revolution</em> DS also mimic the console game's six-pad setup ... right down to the relentless difficulty. In this mode, color coded icons appear on the top screen, and players must hit the appropriate drum on the bottom screen. Unfortunately, this mode has inherited the console game's lackluster GUI, with an amateurish virtual drum design and illegible icons that make gameplay more difficult than it should be. The incredible disparity between easy and medium difficulties must also be noted: while the easy difficulty is borderline catatonic, the medium difficult sends a flurry of almost indecipherable notes that led us to near instant failure. Where's the middle ground? How will players make the transition from these wildly differing modes? </div>

Forced with making up for lost time in the battle for rhythm game supremacy, Konami is evidently taking the curious path of removing bullet points from the back of <em><a href="http://www.joystiq.com/tag/Rock-Revolution/">Rock Revolution</a>'s</em> future box art. First, despite a corporate lineage that includes <em>Karaoke Revolution</em>, Konami axed the expected vocal portion, leaving just guitar and drum tracks. (Wouldn't want to cannibalize those <em>Karaoke Revolution</em> sales, would we?)<br /><br />Now, Konami has axed the axe, telling MTV that they'll only be offering the unwieldy drum kit in mid-November, about a month after the standalone game launches October 14th. The full peripheral lineup from the <em>Guitar Hero</em> and <em>Rock Band</em> games should work just fine with <em>Rock Revolution</em> but, something tells us Konami's going to have a tough time leading this revolution. Konami has told our cruel overlords at Joystiq that North American gamers need not worry, as <a href="http://www.joystiq.com/tag/rock-revolution"><em>Rock Revolution</em></a> is "still on track for a fall 2008" release, despite <a href="http://www.joystiq.com/2008/08/20/gc-2008-rock-revolution-late-to-the-stage/">rumors that say otherwise</a>. They also detailed some stuff about drum compatibility.<br /><br />If you're playing Konami's title with another drum set, the game will automatically configure to that specific set. For example, when using the <em>Rock Band </em>drum set, the game will switch to four on-screen notes and five when using the <em>Guitar Hero: World Tour</em> set. Konami has detailed how its <a href="http://www.joystiq.com/2008/05/16/konamis-rock-revolution-drums-revealed/">seven-input drum set</a> will be <a href="http://www.joystiq.com/Instrument-Compatibility-Matrix/">compatible</a> with <em>Rock Band</em> 2 and <em>Guitar Hero: World Tour</em>'s kits, which have four and five inputs, respectively. We've been informed that the game will "reconfigure" itself depending on the set being used with the game. For example, instead of seven lines of music, it will adjust to four when using the <em><a href="http://joystiq.com/tag/rock-band-2">Rock Band 2</a> </em>drums and five for <a href="http://joystiq.com/tag/guitar-hero-world-tour"><em>GH:WT</em></a>. An associate producer for Konami's <a href="http://joystiq.com/tag/rock-revolution"><em>Rock Revolution</em></a> confirmed that the game would be delayed until early 2009 during the company's Leipzig press conference, <a href="http://wii.ign.com/articles/900/900429p1.html">IGN</a> reports. We've contacted Konami to find out if the representative meant that the title will be available for Europe in 2009 (this is a European press event after all), or if the game has actually been delayed from its <a href="http://www.joystiq.com/2008/05/15/konami-jumps-on-the-band-wagon-with-rock-revolution/">original Fall '08 release</a> in North America as well. We may have to deal with the rock status quo for a while until the <em>Revolution</em> arrives. According to IGN, Niais Taylor, associate producer of Konami's <a href="http://www.joystiq.com/2008/08/06/rock-revolution-track-list-revealed/"><em>Rock Revolution</em></a>, provided an "early 2009" release window for the music game during a demo of the drum kit (which the Wii version does not use). However, there is a bit of potential confusion.<br /><br /><em>If</em> this unspecified release period is worldwide, or for the US, then the game has been delayed from its previous "2008" release. However, if this is the European release date -- which seems likely, since this information was presented at the <a href="http://nintendowiifanboy.com/tag/leipzig-08">Leipzig Games Convention</a> -- then the European release, at least, is on track and we don't have any more information about the US release. Clarifying its stance on <a href="http://www.joystiq.com/Instrument-Compatibility-Matrix/">rhythm game compatibility</a> issues, Microsoft's <a href="http://gamerscoreblog.com/team/archive/2008/08/19/560611.aspx">Gamerscore Blog</a> announced today that all the instruments for <a href="http://joystiq.com/tag/rock-band-2"><em>Rock Band 2</em></a>, <a href="http://joystiq.com/tag/guitar-hero-world-tour"><em>Guitar Hero: World Tour</em></a> and <a href="http://joystiq.com/tag/rock-revolution"><em>Rock Revolution</em></a> will be "cross-compatible" on Xbox 360.<br /><br />Sony <a href="http://www.joystiq.com/2008/08/18/scea-universal-compatibility-for-ps3-rock-band-2-gh-world-to/">announced</a> yesterday that PlayStation 3 would feature full cross-compatibility among the three games as well. Rhythm games have certainly been keeping the tempo up for financial growth in the industry. <a href="http://www.gamedaily.com/articles/news/music-video-games-account-for-32-of-industry-growth-in-08/?biz=1">GameDaily</a> notes UBS analyst Ben Schachter's report, showing "music-themed games" have made up 15% of software sales year-to-date and 32% year-over-year growth so far.<br /><br />The <em>Guitar Hero</em> franchise is already up 82% this year, with <em>Guitar Hero: On Tour</em> taking in $15 million in <a href="http://www.joystiq.com/2008/08/14/july-npd-everyone-sees-red-nintendo-still-on-top/">July alone</a>. Meanwhile, <a href="http://joystiq.com/tag/rock-band"><em>Rock Band</em></a>, across all platforms, took in $47 million in July ... and that doesn't even count any DLC sales. Remember back around Christmas, when we were promised a <em>Rock Band</em> patch which would allow people to use <em>Guitar Hero III</em> controllers? You know, the patch which was going to allow PS3 owners the same features as the Xbox 360 version? Sure, it never appeared, but it seems that Sony is making sure that such a thing never happens again. Michael Shorrock, director of 3rd party relations, has posted up some info on the PlayStation.Blog stating that <em>Rock Revolution</em>, <em>Rock Band 2</em> and <em>Guitar Hero: World Tour</em>'s instruments will all be compatible with each other. <br /><br />Not only that, but <em>Guitar Hero: World Tour</em> and <em>Rock Band 2</em> will support <em>SingStar</em> microphones. This is great for those of us who are interested in picking up all of these games, but are a little less interested in having our living rooms full of plastic drum sets and guitars. The good news doesn't end there, though. That patch we mentioned at the beginning of this post may still see the light of day. Shorrock says they're "still working hard to ensure compatibility between the <em>Guitar Hero</em> and <em>Rock Band</em> titles currently on the market, and we hope to have an announcement on that shortly."<br /><br />Thanks to Sony for pre-emptively solving what could have been a very messy Christmas. Universal peripheral compatability just makes so much sense. Now comes the hard decision. It's about time someone stepped in and took an active role in fixing this nonsense. SCEA Director of Publisher Relations Michael Shorrock has announced on <a href="http://blog.us.playstation.com/2008/08/18/ps3-music-peripheral-compatibility-update/">PlayStation.Blog</a> that Sony has reached an agreement with <a href="http://www.joystiq.com/tag/Activision/">Activision</a>, <a href="http://www.joystiq.com/tag/Neversoft/">Neversoft</a>, <a href="http://www.joystiq.com/tag/Harmonix/">Harmonix</a> and <a href="http://www.joystiq.com/tag/Konami/">Konami</a> to ensure that all the instrument peripherals for <em><a href="http://www.joystiq.com/tag/rock-band-2">Rock Band 2</a>, <a href="http://www.joystiq.com/tag/guitar-hero-world-tour">Guitar Hero: World Tour</a> </em>and <a href="http://www.joystiq.com/tag/rock-revolution"><em>Rock Revolution</em></a> will work across all games for PlayStation 3.<br /><br />In case you're too stunned to comprehend what should've been no-brainer functionality from the start, your PS3 <em>Rock Band 2</em> drum set should now be guaranteed to work with <em>GH:WT</em> and <em>RR</em>, and likewise for every game's guitar and drum peripherals. Said Shorrock, "We're still working hard to ensure compatibility between the <em>Guitar Hero</em> and <em>Rock Band</em> titles currently on the market, and we hope to have an announcement on that shortly."<br /><br />We're excited, but at the same time, we're a bit dismayed it took this long to sort out. To be clear, instrument compatibility has not been confirmed for Xbox 360 (although we do know <a href="http://www.joystiq.com/2008/07/16/360s-guitar-hero-world-tour-to-be-compatible-with-rb-instrument/"><em>GH:WT </em>instruments work with <em>RB2</em></a>) or Wii versions of the music games. Oh, poor Konami. You're a little too late to your own party. Actually, more like <em>way too late</em>. Embarrassing on-stage moments were at a minimum this <a href="http://e3-2008.joystiq.com/">E3</a> -- especially compared to last year's <a href="http://www.joystiq.com/2007/07/25/disney-press-conference-fails-audience-participation/">Disney</a> and <a href="http://www.joystiq.com/2007/07/19/watch-activision-alienate-E3-audience-with-jamie-kennedy/">Activision</a> debacles -- but there was one shining moment of facepalm during the <a href="http://www.joystiq.com/2008/07/16/joystiq-live-at-konami-e308-press-conference/">Konami press conference</a>. <br /><br />After rocking out on stage and playing real bass to The Ramones' "Blitzkrieg Bop" with a cover band, Lauren Faccidomo - senior product manager on Konami's Rock <span style="font-style: italic;">Revolution</span> - proceeded to fail out of the very same song in <span style="font-style: italic;">Rock Revolution</span>. It very well may have been one of the worst compare/contrast press conference ideas ever conceived -- not to mention, <em>Rock Revolution</em> looks like it drunkenly stumbled in from 2003. Here at Joystiq, we weren't too surprised when Konami decided to jump on the<a href="http://www.joystiq.com/tag/lawsuit/"> legal bandwagon</a> by <a href="http://multiplayerblog.mtv.com/2008/07/11/mtv-responds-to-rock-band-lawsuit/">bringing a lawsuit against the makers of <em>Rock Band</em></a> for patent infringement. After all, the rhythm game has made roughly <a href="http://www.joystiq.com/2008/03/20/rock-band-surpasses-6-million-song-downloads/">a gazillion dollars</a> and has component parts that bear at least a passing resemblance to Konami games like <a href="http://en.wikipedia.org/wiki/GuitarFreaks"><em>Guitar Freaks</em></a> and <a href="http://en.wikipedia.org/wiki/DrumMania"><em>DrumMania </em></a>(not to mention <a href="http://en.wikipedia.org/wiki/Karaoke_Revolution"><em>Karaoke Revolution</em></a>, which Harmonix helped develop, and the upcoming <a href="http://www.joystiq.com/2008/05/16/joystiq-hands-on-rock-revolution/"><em>Rock Revolution</em></a>). That said, we're not the ones being sued, so our relative shock at the suit doesn't really matter. That said ...<br /><br />"Konami's actions are extremely surprising," an MTV Games spokesperson told <a href="http://multiplayerblog.mtv.com/2008/07/11/mtv-responds-to-rock-band-lawsuit/">MTV News</a> regarding the suit. "Unfortunately, successful products such as <em>Rock Band</em> can often become targets for baseless litigation. We have substantial defenses to this claim and intend to vigorously defend it."<br /><br />The <a href="http://www.mtv.com/news/articles/1590762/20080711/id_0.jhtml">full interview</a> includes more details about the lawsuit and information on the actual patents that Konami claims are being violated. It used to be that we could just buy whatever interested us, and that was that. Now, as new peripheral after new peripheral gets manufactured (of <em>the same </em>instruments), there's a problem: we're running out of space. Not all of us live in big, swanky mansions (or even small, cozy houses for that matter). Another problem? Money. Faux guitars and drum sets don't come cheap, so buying multiple game instruments isn't very economical.<br /><br />Konami feels our pain, which may end up being <em>their</em> pain if people start avoiding <a href="http://www.joystiq.com/2008/05/20/producer-talks-rock-revolution-features-goals/"><em>Rock Revolution</em></a>. We think Konami might be in a lot of trouble, since <a href="http://www.joystiq.com/tag/rock-band"><em>Rock Band</em></a> and <a href="http://www.joystiq.com/tag/guitar-hero"><em>Guitar Hero</em></a> are already well-established in the gaming world. <em>Rock Revolution</em> is the new kid on the block, and if people already have closets full of peripherals and empty wallets, the game might suffer for it. Since <em>Guitar Hero</em> is currently the most owned of the bunch, Activision has no plans to make things any easier for its competitors. Harmonix, meanwhile, preaches universal instruments, but <em>Rock Band's</em> drum set might be too different from <em>Rock Revolution's</em> to even aim for compatibility. <br /><br />What do you think, though? For others, it seemed like this choice was just a hurried attempt to get in on some of the financial success the genre has been enjoying. For us here at Wii Fanboy, it was utter disappointment as we were hoping that <em>Rock Revolution </em>would instead be a new <em>Guitar Freaks</em>.<br /><br />Well, to help validate <em>Rock Revolution</em>, associate producer Keith Matejka spoke with GameTrailers. Don't those drums look an awful lot like the drum kit for another game? Still not jogging your memory? Well, try <a href="http://www.joystiq.com/2008/05/14/game-informer-reveals-guitar-hero-iv-drum-kit/">a convenient link</a>.<br /><br />The <a href="http://www.joystiq.com/2008/05/15/konami-reveals-rock-revolution/"><em>Rock Revolution</em></a> drum kit has six different face drums, of varying sizes, which tells us a lot about the demographic they're shooting for with this title: <em>music-loving Octopi</em>. Seriously, that's a lot of drums to be hitting on! In the <a href="http://www.joystiq.com/2008/05/14/game-informer-snags-first-pic-of-guitar-hero-iv-drums/">latest round</a> of the great "our drum kit is better - or at least <em>bigger</em> - than your drum kit" conflict of ought eight, Konami definitely comes out the clear winner with <a href="http://www.joystiq.com/tag/rock-revolution"><em>Rock Revolution</em></a>. However, we don't necessarily know if that's a good thing, based on our experience playing the title at its formal unveiling.<br /><br />Despite the fact that it will offer support for lead and bass guitars, Rock Revolution is very much a drum-centric game. Konami's fiscal year ending March 31 enjoyed a good rotation around the sun with $175 million in profit, an increase of 13% over the prior year. <a href="http://www.gamedaily.com/articles/news/konami-profits-up-13-in-fiscal-08/?biz=1">GameDaily</a> reports the publisher saw revenues of $2.8 billion, thanks to numerous titles in Japan, <span style="font-style: italic;">Dance Dance Revolution</span> on the Wii in North America and <span style="font-style: italic;">Pro Evolution Soccer 2008</span> in Europe.<br /><br />The company gave guidance that it expects revenues of $3.15 billion this fiscal year; probably due to a game called <a href="http://www.joystiq.com/tag/mgs-4"><em>Metal Gear</em></a> something and continued strong sales of its numerous franchises. How revolutionary.<br /><br />As far as specifics go, we know that <em>Rock Revolution</em> is being developed by <em>SingStar </em>creators <a href="http://www.zoemode.com/">Zoe Mode</a> and is planned for a Fall release on all major platforms. Details are light though, but we we can confirm the game will feature at least 40 tracks, the ability to record your own songs, online co-op, online versus, some money making DLC is planned and a behemoth of a drum set (which we're calling "the beast") will be included. Really, this drum peripheral has six pads, a pedal and looks like ... well, we aren't sure what it looks like but it looks daunting. However, while <a href="http://www.joystiq.com/2008/05/14/game-informer-snags-first-pic-of-guitar-hero-iv-drums/"><em>Guitar Hero IV</em>'s kit</a> still carries some basis in reality, <a href="http://multiplayerblog.mtv.com/2008/05/15/konamis-music-games-come-full-circle-with-band-centric-rock-revolution/#more-4067">the kit revealed by Konami</a> for the company's newly announced <a href="http://www.joystiq.com/2008/05/15/konami-jumps-on-the-band-wagon-with-rock-revolution/"><em>Rock Revolution</em></a> looks to be designed for players with extra appendages or other rhythm enthusiasts who are <em>not quite human</em>.<br /><br />With six face pads of three different sizes, as well as a kick pedal, Konami's kit is certainly the most complex of the three. However, according to MTV Multiplayer blogger Patrick Klepek, the drums carry what sounds like a much more forgiving difficulty curve than those in <em>Rock Band</em>, which while great are almost unapproachable by rhythm game newcomers even on the easiest setting. By contrast, and according to his admittedly brief time with Konami's offering, the game doesn't penalize players for improvising during a song, and also features five difficulty settings with the lower two removing the foot pedal entirely. In a bid to capture itself some of the lucrative <em>Guitar Hero</em>/<em>Rock Band</em> pie, Konami has announced <a href="http://en.wikipedia.org/wiki/Guitar_freaks"><strike>Guitar Freaks</strike></a> <em>Rock Revolution</em> for the Nintendo DS and numerous home consoles. The game, currently in development at UK-based studio Zo&euml; Mode, was revealed at the opening of Konami's 2008 Gamers Day, and is expected to hit stores this October.<br /><br />Understandably, the DS version differs somewhat from the home console editions, relying solely on stylus-based play for each instrument, and with vocals being handled by the handheld's built-in microphone. If <em>Guitar Hero</em> is the result of crossing Konami's original <a href="http://en.wikipedia.org/wiki/GuitarFreaks"><em>GuitarFreaks</em></a> game with <em>Frequency</em>, Konami's newly-announced <em>Rock Revolution</em> is a hybrid of <em>GuitarFreaks</em> and <em>Guitar Hero</em>/<em>Rock Band</em> -- which looks as derivative as it would sound.<br /><br />Rather than localizing <em>Guitar Freaks,</em> Konami and developer Zoe Mode have created a new game that combines the graphical look of <em>Rock Band</em> with the vertical scrolling interface of the <em>Bemani</em> series. The new game features drum and guitar gameplay, but the Wii version is not slated to use <em>any</em> peripherals. Ever since this <em>Rock Band</em> game came out, other companies have been trying to compete. <em>Guitar Hero IV</em> will add <a href="http://www.joystiq.com/2008/05/14/game-informer-snags-first-pic-of-guitar-hero-iv-drums/">non-guitar</a> elements, and now Konami's ready to jump in the game with <em>Rock Revolution</em>. The company that initially put music gaming on the radar through games like <em>Dance Dance Revolution</em> and <em>Beatmania</em> is hoping to leverage the "Revolution" name to attract a hardcore audience.<br /><br /><em>Rock Revolution</em> will include both a lead and bass guitar, and what Konami promises is the "definitive drum experience." "<em>Rock Revolution</em> will be the most innovative and realistic rock game to hit the market, that will provide a quality drum peripheral and music that players will appreciate," said Anthony Crouts, Vice President of Marketing for Konami Digital Entertainment, Inc. "As the originator of music-based games, we are dedicated to bringing fans a truly preeminent music experience. With <em>Rock Revolution</em>, we put the emphasis on the drum kit, delivering an experience unlike any other."<br /><br />As expected, the game will feature DLC after the launch, with 40 songs to be included on the disc. You'll be able to record your own songs in a "jam session," and there will be a variety of online modes. The game is expected to release this Fall. The question is, will it be able to compete against <em>Rock Band</em>?<br /><br />

<br />When <em>Guitar Hero</em> first hit PS2, we thought: "Wow, this is like Konami's <em>GuitarFreaks</em> ... and that's been around since the original PlayStation. Why don't they release it here?" Well, our question was answered at yesterday's Konami Gamer's Night 2008 with the unveiling of <em>Rock Revolution</em>. Taking the "Revolution" suffix naming scheme of its other music genre (<em>bemani</em>) cousins, the game, from <a href="http://www.joystiq.com/tag/singstar/">SingStar</a> developer Zo&euml; Mode, is set for a fall release on PS3, Xbox 360, Wii, and Nintendo DS. We have the first screens of the HD offerings, along with some salient details:<br /><br />The PS3 and Xbox 360 versions will feature:<br />
<ul>
    <li>40 songs on the disc, with DLC tracks planned</li>
    <li>Record your own songs in a "Jam Session" (8 separate tracks)</li>
    <li>Online co-op, versus, and battle of the bands modes<br /></li>
    <li>Crazy big drum set with six pads, plus pedal</li>
</ul>
The Wii version adds the ability to play "air guitar" using the Wiimote and nunchuck; and the DS version includes a "Vocalist" mode using the built-in microphone.
