Nyan Cat creator Christopher Orlando Torres and Keyboard Cat's owner Charles Schmidt have filed a copyright and trademark infringement lawsuit against Warner Bros. and 5th Cell over their creations' appearances in the Scribblenauts series.<br />
<br />
The <a href="http://www.iptrademarkattorney.com/schmidt-v-warner-bros-meme-copyright-complaint.pdf">complaint</a>, filed on April 22nd, alleges that developer 5th Cell did not seek permission to include either copyrighted character in their published products or in related promotional material. The original Nyan Cat and Keyboard Cat videos have each been viewed tens of millions of times on YouTube, making them "extremely valuable for commercial uses," according to the complaint.<br />

"Plaintiffs claim that Warner Bros and 5th Cell's trademark infringement was willful and intentional and are requesting an award of treble damages and requesting the case be deemed exception under 15 U.S.C. &sect; 1117(a), thereby entitling Plaintiffs to an award of reasonable attorneys' fees," intellectual property-focused attorney blog Milord &amp; Associates <a href="http://www.iptrademarkattorney.com/2013/04/los-angeles-copyright-trademark-sue-attorney-keyboard-cat-nyan-cat-meme-viral-videos.html">notes</a>.<br />
<br />
Plaintiffs Schmidt and Torres additionally seek an injunction against the sale of <i>Scribblenauts</i> products until the matter is resolved.<br />
<br />
The <i>Scribblenauts</i> series allows players to summon <a href="http://scribblenauts.wikia.com/wiki/Category:Internet_Memes">a wide variety of memes</a> during gameplay, for both practical purposes and comedic effect. According to <a href="http://www.ign.com/articles/2013/04/25/next-scribblenauts-is-a-dc-superheroes-game">IGN</a> sources, the game is currently mired in redesign and may even lose the <em>Scribblenauts Unmasked</em> moniker altogether, though the game is assuredly focused on the DC Comics license.<br /><br />The original design called for a game where Max would embark on adventures to help out DC super heroes, but that may not be indicative of the final product. One scenario detailed includes Max trying to bypass a hungry Killer Croc to infiltrate Wayne Manor through the sewers below. For 5 bucks, you can download the universal app <em>Scribblenauts Remix </em>(so that's what that <a href="http://www.joystiq.com/2011/08/03/scribblenauts-remix-domain-registered-by-wb/">title</a> is!) featuring the signature gameplay -- writing words to summon objects, then using those objects to solve puzzles. The app is apparently based on <em>Super Scribblenauts</em>, meaning you can punch up your items with adjectives. It even has new iOS-exclusive levels.<br />

WB apparently hasn't written off the <a href="http://joystiq.com/tag/scribblenauts"><em>Scribblenauts</em></a> series, if a recent domain registration is any clue. <a href="http://twitter.com/supererogatory/status/98803211812610049">Superannuation</a> found a <a href="http://whois.domaintools.com/scribblenautsremix.com">registration</a> for the site scribblenautsremix.com.<br />
<br />
The use of the word "remix" in the potential game's title would suggest that the new game is based on material from the first two; i.e. remixed content instead of entirely original material. But we don't know more than that -- and, since that was just an extrapolation based on the title, we don't really know anything. Though we might expect more <em>Scribblenauts</em>, which seems like a good thing. 5th Cell's focus on original IP has worked out quite well for the independent developer, selling millions of copies of its innovative titles. During a <a href="http://joystiq.com/tag/dice-2011">DICE 2011</a> presentation on the studio's development strategy, general manager and COO Joseph Tringali shared that it has sold 3.5 million units in the <em>Drawn to Life</em> series and 2.5 million of <em>Scribblenauts</em> games. We'd known previously that the original <em>Scribblenauts</em> was the <a href="http://www.joystiq.com/2010/02/15/scribblenauts-was-the-5-ds-game-of-2009/">fifth best-selling DS title of 2009</a>.<br />
<br />

In these screenshots, including one tweeted by Hideo Kojima and two from <a href="http://blog.esuteru.com/archives/2333811.html">Hachimaki</a>, you can see <em>Scribblenized</em> versions of Old Snake, <em>Gradius</em>'s Vic Viper, and <em>Love Plus</em>'s Manaka Takane. On January 27, Konami will release 5TH Cell's DS adventure game as "Flash Puzzle: Maxwell's Peculiar Notebook." ("Fushigi" means anything from "strange" to "mysterious" -- we've gone with <a href="http://www.andriasang.com/e/blog/2010/11/09/scribblenauts_japanese_release/">Andriasang</a>'s translation here.)<br />

Ironically, it seems to be a localization of the first <em>Scribblenauts</em>, which means it'll lack the <a href="http://joystiq.com/game/super-scribblenauts">sequel</a>'s adjective function, making it impossible to create a "mysterious" notebook in-game. But Konami already has to translate the 22,000 word dictionary for this (budget!) release, so it's understandable. It's probably been working quietly on the game since before <em>Super Scribblenauts</em> even came out.<br />
<br />

Warner Bros. Interactive will have demo stations for the adjective-enhanced adventure in its booth (#4545). Those who go to check it out will get an adjective of their own, thanks to  a $5 Best Buy coupon to turn their own copies of Super Scribblenauts into <em>cheap</em> copies. The publisher released this charming artwork today as well, depicting some adjectivized objects found within the game. A plaid kappa! A wooden cat, in a furry cup, maybe? A tiny, striped, winged elephant! Start flexing those ... whatever muscles you would use to exercise your imagination. Warner Bros. Interactive today announced <em>Super Scribblenauts</em>, the sequel to last year's <a href="http://www.joystiq.com/tag/scribblenauts">similarly titled puzzle-platformer</a>. The DS game will hit store shelves sometime this fall. Check out the first three (tiny, tiny) screenshots from the game in the gallery below.<br />

As hinted at by the <a href="http://www.joystiq.com/2010/03/06/nintendo-power-scribblenauts-sequel-coming-this-fall/">April issue of Nintendo Power</a>, players will be able to modify the game's catalog of summonable items using <a href="http://www.youtube.com/watch?v=mYzGLzFuwxI">adjectives</a>, leading to complex creations such as "gentlemanly, flaming, flying zombies and purple, obese, winged elephants." That sounds <em>wonderful</em>, but we're more excited by the announcement's surreptitious reference to "upgraded controls." Does that mean we'll actually be able to walk to said lavender pachyderm without accidentally jumping into that adjacent pit of lava? We can only hope!<br />

Echoing <a href="http://www.joystiq.com/2009/07/10/scribblenauts-could-come-to-other-platforms/">previous statements</a> about the developer's openness toward additional platforms, creative director Jeremiah Slaczka told the UK's <a href="http://www.officialnintendomagazine.co.uk/article.php?id=16763">Official Nintendo Magazine</a> that a Wii version of the vocabuladventure is possible. All you need to do is ask for it (and buy the upcoming DS sequel)!<br />
<meta charset="utf-8">"I think a Wii version could happen," Slaczka said. "It's all about the fans - if the fans speak up and continue to buy and play the second one like they did the first one, I don't see why we couldn't make a case for a Wii version." As evidenced by the image above, the latest issue of Nintendo Power reveals a sequel to 5th Cell's <em><a href="http://www.joystiq.com/tag/scribblenauts">Scribblenauts</a></em> for the Nintendo DS. According to a report from <a href="http://www.gonintendo.com/viewstory.php?id=116446">GoNintendo</a>, the magazine feature additionally details the game's release window ("fall"), that it will receive "10,000 more words" and "120 new and improved levels," and will have a focus on the use of adjectives. Thankfully, the report also notes intentions to improve the game's controls -- a major setback of the first outing. We've shot an email to the developers and will hopefully have more information on the game sometime soon. As expected, the list is dominated by Nintendo's evergreen first-party lineup; however, at number five was a third-party title, 5th Cell's <a href="http://joystiq.com/tag/scribblenauts"><em>Scribblenauts</em></a>. WB announced earlier this month that the bizarre adventure puzzle game <a href="http://www.joystiq.com/2010/02/03/noteworthy-scribblenauts-ships-a-million/">shipped</a> over a million copies. It sold "over 900k for sure," 5th Cell creative director Jeremiah Slaczka told Joystiq. <br />

"The DS is a very different market than console, I think treating it as such helps," Slaczka said about cracking the DS market. "I think it's one of the toughest markets to sell on because the demographic is so broad: gamers, non-gamers, kids, adults, boys, girls. And unlike the Wii, it's even more limiting in power. Making a game that appeals to everyone is tough." According to WBIE, which, as publisher, has an admittedly biased view of the situation, <em>Scribblenauts</em> has now reached "blockbuster status."<br />

Keeping in mind that the reported figure is one million units <em>shipped</em> (and not necessarily <em>sold</em>), it's still an impressive number for a third-party DS game -- especially one as <em>weird</em> as an adventure game that features puzzle solving through the use of one's vocabulary. <em>Muramasa</em> appealed to me in a way that <em>Odin Sphere</em> didn't, thanks to an emphasis on combo-heavy sword action instead of planting and whatever. And the RPG elements that are left, like the sword upgrades and cooking, are not only fun, but simple enough that I can get right back into the game after a long break and still know what is going on.<br />

What started out as tepid fascination in <em>DJ Hero</em> quickly turned into a deep, passionate love. I initially thought it was just another rhythm game knock-off with an obtuse peripheral and a too-high price point. However, as my turntabling improved, my fondness for the game multiplied. Based on the game's lackluster sales, I'm guessing most people shared my outright hesitance -- but once you invest a bit of time and patience into <em>DJ Hero</em>, I guarantee you'll get hooked. (And <a href="http://www.joystiq.com/2009/10/06/dj-heros-full-track-list-revealed/#continued">that soundtrack</a>! Opening its rationalization with the arguable statement that Infinity Ward's <a href="http://www.joystiq.com/tag/modern-warfare-2"><em>Modern</em> <em>Warfare</em> <em>2</em></a> has "something intelligent to say about contemporary military conflicts," <a href="http://www.time.com/time/specials/packages/article/0,28804,1945379_1944169_1944171,00.html">Time Magazine's "Top 10 Games" of 2009</a> list recently declared the title its "Game of the Year." <em>MW2</em> was closely followed by <em>Batman: Arkham Asylum</em> and <em>DJ Hero</em>, while the recent <em>Uncharted 2</em> and <em>Assassin's Creed 2 </em>landed on the bottom of the list.<br /> <br /> The seemingly annual Flash/iPhone game choice this year turned out to be <em>Geo Defense Swarm</em>, while <a href="http://www.joystiq.com/2009/12/07/review-the-legend-of-zelda-spirit-tracks/">Link's latest adventure</a> sat out the ubiquitous DS spot -- a spot filled by <em><a href="http://www.joystiq.com/tag/scribblenauts">Scribblenauts</a></em>, it would seem. <small>Click to download in Santa-size</small></center>We thought the <a href="http://www.joystiq.com/tag/Scribblenauts/"><em>Scribblenauts</em></a><em> </em><a href="http://nintendo.joystiq.com/2009/10/30/celebrate-halloween-with-scribblenauts/">Halloween wallpaper</a> was a one-off, an excuse to promote the game a bit more in the period immediately following its release. But, to our delight, 5TH Cell has delivered the Christmas present we didn't dare hope for: new <em>Scribblenauts</em> artwork by character designer Edison Yan. It's a Christmas miracle! Well, okay, it may not be miraculous, but it's <em>really nice!</em> We don't even care if it <em>is</em> a promotional effort to remind people to put <em>Scribblenauts</em> on their holiday shopping lists.<br />
<br />
There are also two new Christmas-themed screenshots in our gallery. In retrospect, it was a pretty clever idea to make a game that includes multiple holiday-themed items as part of its nature.<br />

The control scheme, one of the major complaints about the puzzle-adventure title, was something that 5th Cell wanted to fix in a couple of ways. However, the developer ran into time and budget constraints.<br />
<br />
"We knew this was going to take a big hit from reviewers," Tringali said, "but we could only spend a limited amount of work on it. We discussed a secondary D-pad control option midway through development only to come to the conclusion it would take a single person 3-4 weeks to integrate it. On our self-funded schedule, that route was not an option."<br />
<br />
Tringali said that to free up time to tweak the controls, another feature, like online connectivity, might have had to be lost. That's 105,000 more copies than <a href="http://www.joystiq.com/2009/04/16/gta-chinatown-wars-sells-89k-units-in-march/"><em>Grand Theft Auto: Chinatown Wars</em></a> moved in its first month.<br />

We asked 5TH Cell creative director Jeremiah Slaczka if it met his expectations. "I didn't have any expectations," he told Joystiq. "I just hoped it'd do well. It's awesome for a completely new, original 3rd party IP on DS to do so well."<br />
<br />
Does this strong debut mean a sequel is guaranteed? "Way too early to tell that," Slaczka said. "We've only seen 2.5 weeks of sales." In an interview with <a href="http://www.gamasutra.com/view/feature/4157/fountain_of_scribbles_5th_cells_.php">Gamasutra</a>, 5TH Cell's creative director Jeremiah Slaczka revealed that the game <em>after</em> that will be the developer's first console game, a "pretty big" game for Xbox Live Arcade. "It's going to be really cool," Slaczka said. "We're very excited about it... it's totally not ready to be announced." Just think of how exciting it will be when it <em>is</em> ready! "Get your rooster hats ready!" a message posted on the game's "Wall" reads. "We have a very special announcement coming very soon..." We have no idea what's being announced, or even <em>when</em>, but it seems really early for a <em>sequel</em> announcement. Maybe another platform? Or maybe something <em>outside</em> the game, like a contest. In any case, if you like <em>Scribblenauts</em>, 5TH Cell is going to tell us all something that will probably be delightful. <br />

Warner Bros. says it's counting on <a href="http://www.joystiq.com/tag/scribblenauts"><em>Scribblenauts</em></a> to start a new puzzle franchise, getting a taste of the same success that a certain top-hatted DS puzzler has enjoyed. "What <em>Scribblenauts</em> offers is something akin to Nintendo's Professor Layton - an addictive and challenging game that has real mass-market appeal all wrapped up in a uniquely stylised package," said WB marketing manager Phil Lamb.<br />

He seems to be making a logical argument until dropping this bon mot: "Many forum users are saying the game is the biggest incentive they've had to revisit their dormant DS in a long time." We thought there was no way 5TH Cell would intentionally hide racist, or even racially charged, imagery in its game, so we contacted creative director Jeremiah Slaczka to figure out what happened.<br />
<br />
It turns out that like Zachary's discovery, the item was an unfortunate accident. Slaczka explained to Joystiq that "sambo" is used in the game as an alternate term for "fig leaf gourd," an ingredient in the Ecuadorian dish <a href="http://en.wikipedia.org/wiki/Fanesca">fanesca</a>. "Sambo" is the local term for the gourd. As for the watermelon-like appearance? "We reuse art," he said. "Fig leaf gourd looks a lot like a watermelon. It's just an alternative name in a giant list of tens of thousands of names."<br />
<br />
Slaczka noted, offering evidence to the contrary of calls of racism, that many of the human characters in the game, including the fireman, winemaker, and dancer, manifest as black, as does "Brandon," the in-game representation of a 5TH Cell "wordsmith" (one of the employees tasked with finding words for the database), who is of course black in real life. He also mentioned Isaiah, a major character in the developer's last game <a href="http://nintendo.joystiq.com/2008/09/30/ds-fanboy-review-locks-quest/"><span style="font-style: italic;">Lock's Quest</span></a>. <br />

We must admit, a random, potentially slightly embarrassing art/word pairing in the game seems a lot more likely to us than endemic racism expressed through antiquated epithets. "That was leaked by a hacker who does not know anything," Slaczka said. "It's more than that." Slaczka also revealed the last word to be added to the game's database: "Low Rider." Presumably this was added at the insistence of his friends, all of whom love a low rider.<br />

There's this part I love in the movie <em>Ratatouille</em> where a critic says, "The world is often unkind to new talent, new creations. The new needs friends." It's something I always try to keep in mind and it's moved me to first, before we do anything else, celebrate what a staggering accomplishment <a href="http://www.joystiq.com/tag/scribblenauts"><em>Scribblenauts</em></a> is.<br />
<br />
It's a game where you solve simple puzzles with almost any object you can dream up (as long as it's not libations, licensed or lascivious) and every item acts the way you'd expect: bears chase honey and dogs chase cats. It's a game where you can spend hours just messing around to see what creatures can beat God in a fight (zombies: no; vampires: yes). As a technical achievement and as a toy, it's really brilliant. <em>Scribblenauts</em> is a thing of wonder.<br />

Friendly reminder for <em>Scribble</em>-natics in the tri-state region: the Nintendo World store will begin selling <a href="http://www.joystiq.com/tag/Scribblenauts/"><em>Scribblenauts</em></a> today at 11AM as part of a special <a href="http://nintendo.joystiq.com/2009/09/03/special-scribblenauts-launch-at-nintendo-world-store-sept-13/">early launch</a>. For those who don't want to wait until their retailer of choice gets the game sometime this week, now is the time to get on the LIRR, Metro-North, MTA, ferry or paddle boat and head on over to Rockefeller Plaza.<br />
<br />
The 5th Cell team should be on hand for autographs (hopefully for longer than an hour) and demos of the game. <em>Scribblenauts</em> will allegedly only be sold between 11AM-2PM, so take that into consideration. We sincerely urge you <em>not</em> to go through the illicitly obtained list, looking for particular nouns of interest and internet memes -- why not save that fun for the actual game? However, everyone should absorb the final tally of words present in the final build of the game: 22,802.<br />

Also, if the list is legit, then "Plumbob" finally made it into the game -- as per <a href="http://www.joystiq.com/2009/06/05/scribblenauts-passes-our-ten-word-challenge-with-flying-colors/">our suggestion from E3</a>. For those in the New York area, pencil in on your calendar that <em><a href="http://www.joystiq.com/tag/Scribblenauts/">Scribblenauts</a></em> will launch two days early at the Nintendo World Store in Rockefeller Plaza. <em>Scribblenauts</em> creative director <a href="http://www.joystiq.com/2009/07/28/scribblenauts-rooster-hat-becomes-real-gamestop-pre-order-bonu/">Jeremiah Slaczka</a> will be there to autograph copies of the game, and there will also be "premium item giveaways" -- which had better be the infamous "<a href="http://www.joystiq.com/2009/07/28/scribblenauts-rooster-hat-becomes-real-gamestop-pre-order-bonu/">rooster hat</a>."<br /><br />The event kicks off at 11AM, but for those who've got their h-e-a-r-t set on picking up a copy of the game, it may be prudent to arrive earlier. We have no idea how big of a launch this will be, but in a city of 10 million-plus people, there's surely a <em>long</em> line in the making. It's best not to tempt fate. The company previously planned to release the title on <a href="http://www.joystiq.com/2009/07/17/wb-pencils-in-september-25-uk-release-date-for-scribblenauts/">September 25</a>, then "October" (according to GamesCom press materials). Somehow, we doubt localization concerns are to blame. The North American version is still on track for September 15, which is <em>so soon!</em><em> So</em> soon, in fact, that you could probably order one from the US and get it shipped to the UK before October 9. Just throwing that out there.<br /><br />In other <em>Scribblenews</em>, a bunch of fun downloadables are available at the <a href="http://games.kidswb.com/scribblenauts/index2.html#/?cc=en&amp;page=downloads">website</a> now.
