Publisher Devolver Digital brings <em>Duke Nukem 3D</em> to the Steam store today in what it's calling the <em>Megaton Edition</em>, which collates the 1996 shooter with three expansion packs for $9.99 - in case you missed <em>DN3D</em> being <a href="http://www.joystiq.com/2012/12/12/make-it-an-atomic-holiday-with-free-pc-mac-duke-nukem-3d-from-go/">festively free</a> on GOG last year.<br /><br />The three bundled-in expansions are Duke Caribbean: Life's a Beach, Duke: Nuclear Winter, and Duke It Out in DC. <em>DN3D </em>supports both PC and Mac, and comes with "polished OpenGL visuals" and its own set of Steam achievements. Originally released in 1993 for MS-DOS, <em>Duke Nukem 2</em> will be available for $1.99 and will be compatible with iOS devices iPhone 4S and newer, including iPad Minis and last-generation's iPod Touch.<br /><br />As seen in the trailer above, Interceptor Entertainment's iOS port uses virtual button controls to navigate Duke through the game's 32 levels. We guess Duke's ride wasn't <em>too</em> shot up, as he's making his way over to Android. Tapjoy and MachineWorks NorthWest have teamed up to bring the original classic, <a href="http://www.joystiq.com/tag/duke-nukem-3d/"><em>Duke Nukem 3D</em></a>, to the Android Marketplace starting "very soon."<br />

It's difficult to imagine <em>The Shining</em> being any more terrifying than its original release, but<i> <a href="http://www.joystiq.com/game/duke-nukem-3d">Duke Nukem</a></i> has never cared much about <a href="http://www.joystiq.com/2011/06/13/metareview-duke-nukem-forever/">impossible odds</a>, and it's taken on the challenge like a champ. Film fanatic and analyst Rob Ager has compiled a video dissecting the spatial anomalies in <em>The Shining</em>'s Overlook Hotel, as discovered through a <em>Duke Nukem 3D</em> mod attempting to recreate the building. Ager describes the impossible hallways, windows, apartments and stairways littering the Overlook that lend Kubrick's movie a subconsciously eerie, <em>something's not quite right</em> vibe.<br />

Shareware pioneer Apogee Software has announced the launch of a <a href="http://store.digitalriver.com/store/apogee/list/CategoryID.55166100">new online store</a>, offering a handful of Apogee's most well-known games, specifically <a href="http://joystiq.com/game/duke-nukem-3d"><em>Duke Nukem 3D</em></a>, <em>Duke Nukem: Manhattan Project</em>, <em>Rise of the Triad</em> and both <em>Blake Stone</em> titles, all of which can be had for $5.99 each. Savvy readers may recognize that the same lineup has been available via GoG.com for <a href="http://www.joystiq.com/2009/02/27/gog-in-the-machine-duke-nukem-3d-more-apogee-on-the-way/">some time now</a>.<br />

The Apogee store manages to offer a better deal though, thanks to its "Legacy Pack" which bundles all five games for $20. The bundle also includes the "<em>Extreme Rise of the Triad</em>" expansion and ... the <a href="http://joystiq.com/game/duke-nukem-critical-mass"><em>Duke Nukem: Critical Mass</em></a> soundtrack. Also, until June 20, the store is running a Father's Day promotion, offering the Legacy Pack for only $15. Just use the promo code "Father" during checkout.<br />

The year was 1997, and I'd just begun writing about video games professionally. Like most of my fellow gamers, I was pretty excited when 3D Realms announced that it was working on a sequel to <em>Duke Nukem 3D</em>, the runaway PC hit that it had released just a year before. At my first E3, a year later, I saw the game running for the first time. Now, just as my 14th E3 has come and gone, I'm sitting at my computer having finally played the finished <a href="http://www.joystiq.com/game/duke-nukem-forever"><em>Duke Nukem Forever</em></a>. Yet it feels like I'm still in 1998.<br />
<br />
That's because <em>DNF</em> is, for better but <em>mostly</em> worse, perpetually stuck in the late 1990s. For all the delaying, the stalling, the drama surrounding the game, it's tough to say if any part of it has actually benefitted from the more than a decade of development. Normally, we wouldn't consider it news when a game "goes gold" in time for its appointed release date. But when the game in question is <a href="http://joystiq.com/game/duke-nukem-forever"><em>Duke Nukem Forever</em></a>, we feel compelled to report all evidence of an actual game -- with a modicum of skepticism, of course -- until the vulgar little adventure is in our very own hands.<br />

"Today marks an amazing day in the annals of gaming lore, the day where the legend of Duke Nukem Forever is finally complete and it takes that final step towards becoming a reality," 2K president Christoph Hartmann said in the announcement, which boldly reiterates the June 10 and June 14 release dates worldwide and for North America, respectively.<br />

2K Games and Gearbox Software have just announced that members of the <a href="http://www.joystiq.com/game/duke-nukem-forever"><em>Duke Nukem Forever</em></a> "<a href="http://www.joystiq.com/2010/10/05/duke-nukem-forever-demo-access-included-with-borderlands-goty/">First Access Club</a>" -- those who purchased the <a href="http://www.joystiq.com/game/borderlands"><em>Borderlands</em></a> Game of the Year Edition or pre-ordered <em>DNF</em> -- will be able to download the first-person <strike>rauncher</strike> shooter's demo on June 3. You should have received an email asking you to confirm which platform you'd like it on.<br />

After a mysterious quiet period (which is totally uncharacteristic for a <em>Duke Nukem</em> game), Deep Silver and Apogee are planning to release <a href="http://www.joystiq.com/2011/03/24/duke-nukem-critical-mass-for-ds-is-apparently-still-happening/"><em>Duke Nukem: Critical Mass</em></a> for DS this week in Europe and next month in North America. You can see it in action in the trailer after the break, and, well ... it looks like a thoroughly humiliating experience, narrated by Jon St. John.<br />

Surprisingly, the press release accompanying the trailer says that the PSP version is coming out at the same time -- but Deep Silver informs us that it was actually canceled. It's not difficult to turn a game into a tasteful film. Case in point: <em>The Duke: Fate of Humanity</em>, a potent, made-in-a-day homage to our favorite guy with the shot-up ride. <em>Duke Nukem Forever</em> might actually be completed and released -- but like most everyone, I won't be convinced until the final product is in my hands. During a recent press event, I played through <a href="http://www.joystiq.com/2010/09/03/duke-nukem-forever-preview/">the same demo</a> we saw at PAX and spoke with 2K Games senior producer <a href="http://www.joystiq.com/tag/melissa-miller/">Melissa Miller</a>, who did her best to reassure me that the game might actually, maybe,<em> seriously</em> come out.<br />

"It's really amazing when you think about it, because these guys -- along with everybody else -- thought <em>Duke Nukem</em> was dead," Miller recalled of one of the current developers, Triptych Games, which was founded by nine ex-members of <a href="http://www.joystiq.com/tag/3d-realms/">3D Realms</a>. Project lead Frederik "Fresch" Schreiber has <a href="http://gbxforums.gearboxsoftware.com/showthread.php?t=112564">received</a> a non-commercial license to proceed with <em>Duke Nukem: Next-Gen,</em> his Unreal Engine 3-powered <em>Duke Nukem 3D</em> remake. Fresch secured the license in just under three weeks after his <a href="http://gbxforums.gearboxsoftware.com/showthread.php?t=111335">first announcement</a> -- a credit to <a href="http://www.joystiq.com/2010/09/05/we-bought-duke-nukem-franchise-rights-transferred-from-3d-rea/">rights holder</a> Gearbox's openness to share the franchise with the community -- and has aleady assembled a team of nine other contributors (though he is still "hiring" for a number of positions).<br />
<br />
Fresch, who abandoned similar "next-gen" remakes of <em>Daikatana</em> (too unpopular) and <em>SIN</em> (shut down by MumboJumbo), has plans to release a public multiplayer demo of <em>Duke Nukem: Next-Gen</em> "sooner than you think." Of course, the full version will be released "when it's done" -- and he notes that <em>"Duke Nukem: Next-Gen"</em> is, wisely, just a codename.<br />

So you <em>weren't</em> at PAX last weekend, and <em>didn't</em> play <em><a href="http://joystiq.com/games/duke-nukem-forever">Duke Nukem Forever</a>?</em> Well, then you probably agree with Gearbox's <a href="http://joystiq.com/tag/randy-pitchford">Randy Pitchford</a> when he says that <a href="http://www.vg247.com/2010/09/06/gearboxs-pitchford-dnf-demo-an-important-thing-to-do/">a playable demo for the mythical title</a> is probably "an important thing to do." That's not a confirmation but, now that the cat's out of the bag, the company will start investigating ways to effectively market the game. Putting a demo in the hands of a skeptical audience is a good start, if PAX is any indication. <br />
<br />
If you missed it, you might still think of <em>Duke Nukem Forever</em> as vaporware, and remain convinced that Gearbox told PAX attendees that "it would be really funny" if they all pretended the game <a href="http://www.joystiq.com/2010/09/03/duke-nukem-forever-preview/">was playable</a>. Just two days after revealing its stewardship of the <em><a href="http://www.joystiq.com/game/duke-nukem-forever">Duke Nukem Forever</a></em> title at PAX, Gearbox Software just revealed that it has actually purchased the <em>Duke Nukem</em> brand. Gearbox president Randy Pitchford told an audience at PAX this afternoon that they're not just making sure <em>Duke Nukem Forever</em> makes it to store shelves, but they've actually purchased the entire <em>Duke Nukem</em> IP. "We actually bought the brand," Pitchford told fans. "We bought <em>Duke Nukem</em>."<br />
<br />
A press release timed to go out with the announcement has some more information. Here's the big picture quote: "Gearbox Software announced today that it has acquired the full intellectual property rights of the 'Duke Nukem' brand including <em>Duke Nukem Forever</em> and all future projects in a cooperative deal made with 3D Realms." Even more interesting: "The first product to be available under the <em>Duke Nukem</em> brand will be the long awaited <em>Duke Nukem Forever</em>." Naturally, if they're buying the brand you can imagine <em>DNF</em> won't be the last game to feature the Duke.<br />

Pitchford made a point to say that Alan Blum, the creator of the Duke Nukem franchise, is now with Gearbox. "He's on the 10th floor with his team," he said. He also wanted to explain that this franchise couldn't simply have been purchased by anyone. "I didn't buy it from [3D Realms]," Pitchford said. "They sold it to me." In the press release, 3D Realms' Scott Miller said, "Gearbox was handpicked as the new home for <em>Duke Nukem</em> because of their continued passion, commitment and long-time heritage with the brand and 3D Realms."<br />

It's finally, really, actually ... maybe going to happen at this point. The <a href="http://www.joystiq.com/2010/08/11/rumor-duke-nukem-forever-being-completed-by-gearbox/">rumors</a> are true: Gearbox Software and 2K Games have taken on the Herculean task of completing and <em>releasing</em> 3D Realms' unfinished <em>Duke Nukem Forever</em>. The project was officially unveiled today at PAX during a <a href="http://www.ustream.tv/2kgameslive">livestreamed</a> presentation at the 2K Games booth and announced for Xbox 360, PS3 and PC. "It's coming out in 2011," Gearbox president Randy Pitchford said during the presentation. (Of course, we're skeptical about <em>any</em> release date associated with this particular title.)<br />

Gearbox began finishing <a href="http://www.joystiq.com/game/duke-nukem-forever"><em>Duke Nukem Forever</em></a> in late 2009, according to <a href="http://blogs.wsj.com/speakeasy/2010/09/03/controversial-long-awaited-duke-nukem-forever-will-finally-be-released/">The Wall Street Journal</a>. "Clearly the game hadn't been finished at 3D Realms but a lot of content had been created," Pitchford told WSJ.<br />
<br />
"We're in the polishing phase now. This is a game where we can not make a promise we can not fulfill," Pitchford added. "We need to get past the shock and awe, and then we can go to all the retailers and first parties and work out a launch plan."<br />
<br />
<em>Duke Nukem Forever </em>is a sequel to <em>Duke Nukem 3D</em> and will feature both a single-player campaign and multiplayer. "Aliens come and say they're going to be our friends, and Duke knows this isn't going to work out," Pitchford revealed of the plot. "Duke once again is in the pivotal spot and it's up to him to save the world."<br />

According to unnamed sources speaking with <a href="http://kotaku.com/5609770/rumor-borderlands-studio-reviving-duke-nukem-forever">Kotaku</a> and "claiming to have knowledge of the situation," development on <em><a href="http://www.joystiq.com/game/duke-nukem-forever">Duke Nukem Forever</a></em> is continuing -- until completion -- with <em><a href="http://www.joystiq.com/game/borderlands">Borderlands</a></em> developer Gearbox Software. Stranger still, the sources also claim that a "playable demo" will be distributed at some point "later this year." While Take-Two confirmed that it retains the rights to <em>DNF</em>, it didn't offer any comment on the matter.<br />

Gearbox head Randy Pitchford couldn't say anything either, but did note that he might be able to "better clarify the situation" at this year's PAX Prime. <em>Duke Nukem</em> creator George Broussard declined to comment as well. We heard a while ago that <em>Defense of the Ancients</em> creator Icefrog had <a href="http://www.playdota.com/forums/blogs/icefrog/264/great-news--dota-fans/">been hired by Valve</a> to work on something that <a href="http://www.playdota.com/forums/blogs/icefrog/892/q-session-4/">would make <em>DotA</em> fans excited</a>, and now voiceover artist Jon St. John - better known as <a href="http://en.wikipedia.org/wiki/Jon_St._John">the voice of Duke Nukem</a> - has tweeted that he visited Valve in Seattle to do <a href="http://twitter.com/JSJakaDukeNukem/status/20491803584">some "recording for <em>DotA</em>."</a> Interesting. There have been a few <em>DotA</em>-style games released already, including the popular <a href="http://joystiq.com/game/league-of-legends"><em>League of Legends</em></a> and <a href="http://joystiq.com/tag/heroes-of-newerth"><em>Heroes of Newerth</em></a>, but if Valve's collaboration with Icefrog is actually called <em>Defense of the Ancients</em>, it could be even closer to the classic game than any of the full-scale competitors.<br />
<br />
Of course, the original <a href="http://en.wikipedia.org/wiki/Defense_of_the_Ancients"><em>DotA</em></a> was a <em>WarCraft 3</em> mod based on an original <em>StarCraft</em> map, but with Valve on board, this would presumably be a standalone title with plenty of Icefrog insight. We've contacted Valve to see what's up and just how close that announcement might be, and we'll let you know if and when we hear back.<br />

After being outed by a handful of ratings organizations, <a href="http://www.joystiq.com/tag/duke-nukem-manhattan-project"><em>Duke Nukem: Manhattan Project</em></a> has finally been confirmed for release on Xbox Live Arcade. A listing for the game recently appeared on the <a href="http://www.xbox.com/en-US/games/d/dukenukemmpxbla/default.htm">official Xbox website</a>, bringing with it no pricing or release date details -- though it does confirm that it falls under the "Action" genre. Oh, thank goodness. We were afraid it might have become a casual puzzler during its transition to consoles.<br />

We've contacted Microsoft to see if anyone can fill in the blanks in regards to the game's price and due date. We're betting it launches sometime in August, which would be appropriate, since we all know August is Stripper and Rocket Launcher Appreciation Month.<br />

It would appear the side-scrolling shoot-em-up PC Gamer called "<a href="http://upload.wikimedia.org/wikipedia/en/7/79/Duke_Nukem_-_Manhattan_Project_Coverart.png">a blast</a>" back in 2002, <em><a href="http://www.joystiq.com/tag/duke-nukem-manhattan-project">Duke Nukem: Manhattan Project</a>,</em> will eventually find its way onto Xbox Live Arcade. It's happening, right? Like, we've seen a <a href="http://www.joystiq.com/2010/04/06/duke-nukem-manhattan-project-rated-for-xbox-360-by-oflc/">couple</a> <a href="http://www.joystiq.com/2010/03/24/duke-nukem-manhattan-project-rated-in-korea/">ratings</a> pop up for the game, so it's gotta be a done deal -- come on, will somebody just officially announce this already? The latest indication (and hopefully precursor to a <em>real</em> announcement) comes from the <a href="http://www.esrb.org/ratings/search.jsp">ESRB</a>, which offers the listing you see above. <br />

<em>Duke Nukem 3D</em> creator 3D Realms, whose last project was <a href="http://itunes.apple.com/app/prey-invasion/id318267734?mt=8"><em>Prey Invasion</em></a> for the iPhone and iPod Touch back in June of 2009, is listed as the publisher on the potential XBLA title. <em>Duke Nukem: Manhattan Project</em> continues its silent march toward a possible Xbox Live Arcade release, with the title <a href="http://www.oflc.gov.au/www/cob/find.nsf/5b6ebdff7f5b9a24ca2575ca00062226/4b1e750ae77c031aca2576f70057fa8c!OpenDocument">rated M by Australia's rating board</a> for Xbox 360. The game was previously classified by <a href="http://www.joystiq.com/2010/03/24/duke-nukem-manhattan-project-rated-in-korea/">Korea's Game Rating Board</a> and has yet to be accompanied by an announcement by Microsoft. As in Korea, the Australian classification request was submitted by Microsoft. Take-Two Interactive, the go-to publisher for <em>Duke Nukem</em>-related info, tells Joystiq it is not "publishing this title and [doesn't] have any info." <br />

We've followed up with Microsoft for a nuke of knowledge on what their plans are. It's <a href="http://joystiq.com/tag/april-fools-day-2010">April Fools' Day</a>, a day on which we take absolutely <em>everything</em> with a grain of salt. Imagine our surprise, then, when we learned that today, April 1, 2010, was the day that <a href="http://joystiq.com/tag/duke-nukem-forever"><em>Duke Nukem Forever</em></a> was <em>supposed</em> to go gold. In other words, the game would have been officially complete and ready for manufacturing. The news comes via former Take-Two producer Jason Bergman's Twitter account which he states <a href="http://twitter.com/loonyboi/status/11421407135">today was the gold date</a> according to 3D Realms' internal schedule. <a href="http://weblogs.variety.com/the_cut_scene/2010/04/today-was-the-day-duke-nukem-forever-was-scheduled-to-go-gold-really.html"><em>Variety</em></a> followed up with Bergman and confirmed that, no, it's not a joke. Bergman <a href="http://twitter.com/loonyboi/status/11424831511">adds</a> that the date was "totally intentional," and that "it was going to be hilarious."<br />
<br />
Considering the long and storied (and <em>long</em>) development history of <em>Duke Nukem Forever</em>, we're inclined to agree. In fact, it's hard to imagine a more appropriate date for the game to reach the gold milestone. Alas, now that the game is kaput and its corpse <a href="http://www.joystiq.com/2009/05/15/forever-gate-take-two-demands-duke-nukem-forever-source-code-in/">trapped in legal limbo</a>, Bergman's revelation is more than a little sad. If you've got any heart left, pour one more out for the Duke and dream of <a href="http://www.joystiq.com/2010/02/03/leaked-duke-nukem-forever-footage-tugs-at-familiar-heartstrings/">what might have been</a>.<br />

That's 39 levels, online multiplayer and the nifty rewind feature, which lets you rewind to a safe point in the level upon death,for just $5. Not bad. <br />

The latest video remains to be found (resting -- in one <em>piece</em> -- after the break) seem unmistakably to be those of our beloved Duke. Maybe it's the familiar dark, underground environments we've gotten to know in other gameplay videos -- like <a href="http://www.joystiq.com/2009/05/10/duke-nukem-forever-gameplay-surfaces-requests-we-come-get-some/">the Jace Hall Show clip</a> and <a href="http://www.joystiq.com/2009/05/10/duke-nukem-forever-gameplay-surfaces-requests-we-come-get-some/">that leaked animator's video</a> -- that send chills down our spine. Or maybe it's just Duke himself, still out of bubble gum and <em>still kicking ass</em>. (Yeah, it's probably that.)<br />

Sure, this movie may not actually be developed by 3D Realms<em> --</em> but neither are those <a href="http://www.joystiq.com/2009/03/25/gdc09-actual-duke-nukem-games-on-psp-ds/">DS and PSP games</a>, and <em>those</em> aren't out yet either. It seems that Duke Nukem may just be <em>cursed</em>.<br />
<br />
Which is a shame, because this trailer (after the break) is entertaining in the same way a real <em>Duke</em> game is. It's got a girl and a monster and a cigar-chomping jerk who shoots the monster whilst spouting one-liners. We hope this thing continues production -- and we hope the producers find a voice actor for the title character.<br />

The reports of <a href="http://www.joystiq.com/2009/12/22/wired-examines-the-death-of-duke-nukem-forever/">Duke Nukem's demise</a> have been <em>greatly</em> exaggerated. Though <em>Forever</em> has been jettisoned into the inky blackness of the vaporware realm, leading to <a href="http://www.joystiq.com/2009/05/18/3d-realms-still-alive-claims-take-two-accusations-without-meri/">a court struggle</a> over the <em>Nukem</em> IP, 3D Realms CEO Scott Miller still <a href="http://www.shacknews.com/onearticle.x/61747">sees a future</a> for the foul-mouthed hero. "The next few years should see a strong resurgence in Duke," Miller mentioned in a recent interview with new gaming mag Gamesauce. "There are numerous other Duke games in various stages of development, several due out this year."<br />

Miller later added, "We are definitely looking to bring Duke into casual gaming spaces, plus there are other major Duke games in production." Wait, <em>casual</em> Duke games? Like ... <em>FarmDuke</em>? <em>BeDuked Twist</em>? <em>Diner Duke</em>? The possibilities are endless! <a href="http://www.wired.com/magazine/2009/12/fail_duke_nukem/all/1">Wired</a>'s piece on the events leading up to the end of <a href="http://joystiq.com/tag/duke-nukem-forever"><em>Duke Nukem Forever</em></a>'s 12 year development cycle may not give the full story, thanks to the <a href="http://www.joystiq.com/2009/05/18/3d-realms-still-alive-claims-take-two-accusations-without-meri/">continuing legal issues</a> between publisher Take-Two and developer 3D Realms, but it does a solid job of putting together the fragmented anecdotes of anonymous employees and people close to the events.<br />
<br />
The feature is a cautionary tale of ego, ambition and failure. <em>DNF</em>'s drama is a yarn that publishers, developers and the press will turn to for years (decades?) to come as the quintessential example of game development gone terribly wrong, terribly publicly. Definitely check it out if you've never gone down the rabbit hole of <em>Duke Nukem Forever</em>'s distracted development.<br />

You know what? Driving around is <em>boring</em>. <em>Duke Nukem 3D</em> has found another revenue stream, this time on the iPhone as the seminal FPS shoots onto the App Store for $2.99 -- as part of a "one day special launch sale." We're not sure what the normal price would be, but with <em>Civilization Revolution</em> <a href="http://www.joystiq.com/2009/08/10/impressions-civilization-revolution-on-iphone/">launching yesterday at $4.99</a>, Duke's adventure from 13 years ago had better not ask for much more.<br />
<br />
<a href="http://appgamer.net/news/2009/aug/11/duke-nukem-3d-out-and-cheap-24-hours/">AppGamer</a> notes that initial feedback on the title has been positive, though there's no "lite" version to test out. The game has the "thumb-stick style controls," but also comes with "slider-style controls." A new development in the never-ending saga that is <a href="http://joystiq.com/tag/duke-nukem-forever"><em>Duke Nukem Forever</em></a> -- or, as we like to call it, <em>Duke Nukem <a href="http://www.youtube.com/watch?v=umU8vKRNnRw">The Ever ... Living!</a></em> -- has now revealed itself on Facebook. Specifically, <a href="http://www.facebook.com/RealDukeNukem?__a=1">Duke Nukem's Facebook page</a> -- we totally friended him -- has been posting screenshots that appear to be from the ill-fated <em>Duke Nukem Forever</em>. As <a href="http://news.bigdownload.com/2009/07/14/new-duke-nukem-forever-screenshots-appearing-on-facebook/">Big Download</a> notes, the shots focus on one <em>giant</em> boss monster stalking what looks like Hoover Dam. We also get a nice render of one of the series floating squid-monster-things and another cybernetic monstrosity.<br /><br />For its part, 3D Realms claims that work on <em>Duke Nukem Forever</em> continues, despite the <a href="http://www.joystiq.com/2009/05/15/forever-gate-take-two-demands-duke-nukem-forever-source-code-in/">ongoing legal battle </a>surrounding it. Shacknews <a href="http://www.shacknews.com/onearticle.x/59522">reports</a> that the developer of <a href="http://www.joystiq.com/2009/06/22/court-filing-reveals-2k-games-was-developing-duke-begins/"><em>Duke Begins</em></a> -- the <em>Duke Nukem</em> prequel project being developed not by 3D Realms, but rather by publisher Take-Two and a "well-known videogame developer" -- was, in fact, Gearbox Software. If that name sounds familiar that's because - like coffee shops and mysterious rashes - the Texas-based developer pops up all over the place, whether in reference to the long-overdue <em><a href="http://www.joystiq.com/tag/Aliens-Colonial-Marines/">Aliens: Colonial Marines</a></em>; the recently re-skinned <em><a href="http://www.joystiq.com/tag/Borderlands/">Borderlands</a></em>; or the oft-rumored <em><a href="http://www.joystiq.com/tag/halo-4,gearbox">Halo 4</a></em>. <br /><br />As revealed by recent court documents, Gearbox was brought on to develop <em>Duke Begins</em> following a 2007 agreement between 3D Realms and Take-Two. In exchange for the rights to make another Duke game, 3D Realms received a cool $2.5 million advance to help fund the <em>ongoing </em>development of <em>Duke Nukem Forever </em>(and, in turn, extend the practice of wondering aloud, "How on Earth can 3D Realms afford to keep making this game?"). <br /><br />3D Realms claims that the "halted" development of <em>Duke Begins</em> in April 2009 "materially harmed Apogee and/or will necessarily delay the commercial release of the <em>Duke Begins</em> game." They claimed that any such delay in release would "delay any royalty payments ... from sales of the <em>Duke Begins</em> game and prevent Apogee from being able to repay the [$2.5 million] advance when it becomes due in 2012." And now you begin to see where all this talk of lawsuits came from. That's right, everyone's favorite ass kicker and bubble gum enthusiast is making a new home on the <a href="http://www.joystiq.com/tag/@iphone">iPhone</a>, as <a href="http://uk.wireless.ign.com/articles/100/1001274p1.html">IGN</a> reports 3D Realms' superb FPS, <a href="http://www.joystiq.com/tag/duke-nukem-3d"><em>Duke Nukem 3D</em></a>, will be available on the iPhone App store soon. Ported by Machineworks Northwest, this direct PC port will feature the entire original game, so you'll be able to tip those working girls and relieve yourself in the game's many bathrooms soon enough. <br /><br />After spending some time with a preview build, IGN had nothing but good things to say, especially about the improved graphics. IGN didn't knock the controls, either, and said there will be two options: tap-to-shoot and a classic scheme. Did you seriously think he'd just roll over and die? He's <a href="http://www.joystiq.com/tag/duke-nukem"><em>Duke Nukem</em></a>, guys. We're pretty sure he can't be killed by conventional weapons (such as bankruptcy).<br /><br />This news came in response to <a href="http://www.joystiq.com/2009/05/15/take-two-suing-apogee-over-unfinished-duke-nukem-forever/">last month's Take-Two court filing</a> against <em>Duke Nukem Forever</em> developer Apogee Software, which attempted to recoup loans the publisher had distributed to Apogee -- loans which would have ostensibly been repaid by <em>DNF </em>royalties. <a href="http://www.gamepolitics.com/2009/06/22/court-filing-2kgames-developing-quotduke-beginsquot">Apogee's attorneys responded Friday</a> with a shocking revelation -- in exchange for their support, Apogee gave Take-Two the rights to simultaneously develop <em>another Duke Nukem</em> game. Take-Two tasked 2K Games with said development under the working title <em>Duke Begins</em>.<br /><br />Apogee's defense states that 2K "halted or otherwise canceled all development work by the third-party game developer on the <em>Duke Begins</em> game in April 2009," an action Apogee sees as Take-Two's attempt at, "pressuring Apogee to sell the <em>Duke Nukem</em> franchise rights to Take-Two for less than their true value."
