We aren't exactly sure about the demographic crossover between the Biebster and those who purchase NBA 2K13, but here we are.<br /><br />It would appear that <em>NBA 2K13</em> executive producer Shawn "JAY Z" Carter-Knowles saw fit in his artistic vision to include the international sensation in the game, but not on the <a href="http://www.joystiq.com/2012/08/01/99-problems-jay-z-executive-producer-nba-2k13/">game's soundtrack</a>. Next week on July 17, Demi Lovato's "La La Land" will be available for download for 240 MS Points. The Biebster's lawyers feel the game infringes on the teen heartthrob's trademark and publicity rights, while RC3 claims the game is parody and protected under the First Amendment.<br /><br />"The parody app portrays a beaver floating on a log down a river. The beaver presents with bangs, a lance, and a purple sweater. The beaver knocks 'Phot-Hogs' that are attempting to take his photograph into the river with his lance," the developer claims in its suit, which can be read in its entirety on <a href="http://www.hollywoodreporter.com/thr-esq/justin-bieber-sued-joustin-beaver-video-game-295548">The Hollywood Reporter</a>. "The beaver also signs 'Otter-graphs.' The beaver also must dodge the 'whirlpool of success,' which will lead beaver out of control, while navigating the river."<br /><br /> With the <a href="http://www.joystiq.com/tag/ab-1179/">U.S. Supreme Court placing the same free speech protections</a> on games that exist in other media forms, it comes down to Bieber's attorneys showing that the game uses the, <em>ahem</em>, intellectual property of the star. According to a <a href="http://twitter.com/#!/jonmchu/status/26408114655858688">tweet from director John Chu</a>, Nintendo prohibited a 15-second clip of the <em>Super Mario Bros.</em> theme song from being used in an upcoming film adaptation of pop prince Justin Bieber's life, <strike><em>Crank 3</em></strike> <em>Never Say Never</em>. Chu seemed frustrated, but we understand why a company like Nintendo has to be so careful about how its flagship property is used. Also, our condolences to Justin Bieber, whom Nintendo apparently ranks just slightly below <a href="http://www.videogamemm.com/thehorde/main.php?g2_itemId=10569">shampoo</a>, <a href="http://www.youtube.com/watch?v=i6jMwrXm3lo">cereal</a>, <a href="http://www.amazon.com/gp/product/B000XXXZYW?ie=UTF8&amp;tag=streitseemlikeag&amp;linkCode=as2&amp;camp=1789&amp;creative=390957&amp;creativeASIN=B000XXXZYW">slippers</a>, <a href="http://www.amazon.com/Super-Mario-Pull-String-Pinata-Supplies/dp/B001TD3Q3U/ref=sr_1_6?s=hpc&amp;ie=UTF8&amp;qid=1295630819&amp;sr=1-6">pi&ntilde;atas</a>, and, of course, <a href="http://www.youtube.com/watch?v=wtMZKYnLg5c"><em>this</em></a>. The war for dominance over the motion-controlled gaming market escalated significantly earlier this week, when Microsoft's <a href="http://www.joystiq.com/tag/kinect">Kinect</a> gained an endorsement from one of the world's foremost cultural leaders: Teen sensation Justin Bieber.
