That's despite Silicon Knights <a href="http://www.joystiq.com/2012/11/09/silicon-knights-v-epic-games-judgment/">being ordered</a> by the US court to recall and destroy all unsold copies of its products using Unreal Engine 3, of which <em>X-Men: Destiny</em> is one. The company was also ordered to cease producing and distributing games using Epic's technology.<br /><br />So what exactly's going on here? Well, the <a href="http://docs.justia.com/cases/federal/district-courts/north-carolina/ncedce/5:2007cv00275/89570/862/0.pdf?ts=1352377322">ruling</a> in the Silicon Knights vs. Epic Games case dictates Silicon Knights notifies the US court by December 21 of its compliance with the injunctions ordered. This is presumably to give Silicon Knights adequate time to carry out the required actions; recalling and destroying every unsold copy of <em>X-Men: Destiny</em> and <em>Too Human</em>.<br /><br />So the game newly appearing on XBLM might not contravene the injunctions, at least for now. It should also be noted that <em>Too Human</em> is also currently available on <a href="http://marketplace.xbox.com/en-US/Product/Too-Human/66acd000-77fe-1000-9115-d8024d5307de">XBLM</a>, while <a href="http://www.gamestop.com/ps3/games/x-men-destiny/89177">GameStop</a>, <a href="http://www.target.com/p/x-men-destiny-xbox-360/-/A-13475879#prodSlot=medium_1_1&amp;term=x-men destiny">Target</a>, and <a href="http://www.bestbuy.com/site/X-Men%3A+Destiny+-+PlayStation+3/2670855.p?id=1218343210078&amp;skuId=2670855&amp;st=x-men%20destiny&amp;lp=2&amp;cp=1">Best Buy</a> all have new copies of <em>X-Men: Destiny</em> listed as available.<p style="padding:5px;background:#ffffcc;border:1px solid #ffff99;clear:both;"><a href="http://www.joystiq.com"><img src="http://www.joystiq.com/media/feedlogo.gif" alt="Joystiq" style="float:left;padding:0 5px 5px 0;" /></a><a href="http://www.joystiq.com/2012/11/13/x-men-destiny-games-on-de/">X-Men: Destiny destined for unsure lifespan on Games on Demand</a> originally appeared on <a href="http://www.joystiq.com">Joystiq</a> on Tue, 13 Nov 2012 11:00:00 EST. Software authors - or in the gaming world, publishers - can not stop customers from reselling their games, even if the publisher attaches an End User License Agreement prohibiting resale.<br /><br />"The exclusive right of distribution of a copy of a computer program covered by such a licence is exhausted on its first sale," the court has found.<br /><br />This ruling covers customers in European Union member states, and games bought through services such as Steam or Origin. The initial purchaser is now entitled to sell the license of a game and allow someone else to download it directly from the publisher's website. The tricky part now is selling the actual license, since there is no system in place for any such transaction. The initial buyer would need a code for a game's license and upon selling it, he would no longer be able to access that game on his account.<br /><br />The ruling applies to the broader scope of software, covering items such as Windows and Adobe downloads. After <a href="http://www.joystiq.com/2008/02/24/australia-may-receive-r-rating-for-games-less-bans/">years of debate and legal discussion</a> about <a href="http://www.joystiq.com/tag/R18/">an R18+ rating</a> for video games there (that would allow for the equivalent of the ESRB's M-rated games to be released without, you know, being illegal), the government has <a href="http://www.news.com.au/technology/gaming/ban-lifted-it-only-took-10-years-but-government-gives-r18-video-games-the-go-ahead/story-e6frfrt9-1226271652456">finally agreed to the new rating</a>, aiming to enact it as early as next year. A bill setting up the extra rating was introduced to the Federal Parliament this week, and is expected to pass easily through the House and Senate.<br /><br />The bill would go into effect sooner, but <a href="http://www.gamespot.com/news/aussie-r18-aiming-for-jan-2013-introduction-6350416">the Federal Minister for Home Affairs says</a> the government needs time to finish all of the paperwork on the new regulation, and to allow each state and territory to draft its own laws enforcing the rating. The bill wouldn't mandate a nationwide rating, but simply allow each territory to create its own.<br /><br />But that shouldn't be an issue, according to those in the know. Apparently, there's plenty of public support already. There were almost 60,000 submissions from the public responding to a discussion paper from 2010, and 98% of those were strongly in support of games rated R18+. The ruling comes after the judge viewed a demonstration of various parts of the game by a Take Two employee for two hours and determined "there's nothing in the game that you wouldn't see on TV every night." He added that he would not approve of the game for his children, but that fact alone "shouldn't mean that the game won't ship."<br /><br />While the case could still be appealed, Destructoid notes that Thompson expressed no interest in doing so because any appellate ruling would come after the game was already in stores.
