Devoted fans know the nuances of some of the biggest moments in the business' history well, from the formation of the Brothers of Destruction to Stone Cold Steve Austin soaking Vince McMahon in beer. A video game that dives into the rich history of the WWE is forced to reconcile all the details of the entertainment product. <a href="http://www.joystiq.com/game/wwe-13"><em>WWE 13</em></a> often meets those expectations, but is not the best there is, was, or ever will be.<br /><br />Much like past games, <em>WWE 13</em> continues to push the illusion of wrestling, which is perfectly acceptable. It's a combat game with fighting mechanics, and some of those mechanics have been cleaned up since last year. One-button reversals now have an added indicator to tell you if your trigger finger is too fast or too slow (based on the small window to execute reversals, it often is). The "OMG" moments addition provide spectacular, albeit circumstantial events that can turn the tide of matches - things like trucking an opponent through the outside barrier by the crowd or heavier opponents actually causing the ring to collapse. Aside from these improvements, the in-ring action hasn't seen much change; players seem to transition a little more smoothly between moves, and most of the buggy, "jarring" animations in <a href="http://joystiq.com/game/wwe-12"><em>WWE 12</em></a> were cleaned up. Legal battles, while academically interesting, are <em>totes boring</em>, even when they carry heavy implications for the future of a franchise, or even the industry as a whole. The monotony can turn something interesting into something no one cares about, so we're thankful that the Honorable John F. Walter has delivered an atomic buster's worth of smackdown to the ongoing case of <em>Bethesda v. Everyone Else</em>.<br />
<br />
Bethesda had sought a temporary restraining order against <a href="http://www.joystiq.com/game/fallout-online"><em>Fallout Online</em></a> co-developer <a href="http://www.joystiq.com/tag/Masthead-Studios/">Masthead Studios</a>, claiming that the company had illegally sublicensed Bethesda's intellectual property from Interplay. The court disagrees, however, and has denied Bethesda's ex-parte application, with Judge Walter essentially telling Bethesda that it's made its bed, and now it's going to lie in it:<br />

	"Plaintiff has not demonstrated that it will be irreparably prejudiced if the requested ex parte relief is not granted, or that it is without fault in creating the crisis that requires ex parte relief. Indeed, Plaintiff was aware as early as February 2011 that Masthead was potentially infringing its copyrights. ... Yet, Plaintiff waited seven months to apply for ex parte relief. The Court finds that Plaintiff unreasonably delayed in seeking relief, and that the emergency that allegedly justifies a TRO is self-created."</blockquote>
<em>Yowch</em>. Considering that this is the second injunction request <a href="http://www.gamasutra.com/view/news/26491/Court_Denies_Bethesdas_Motion_To_Block_Interplay_Fallout_Activity.php">denied of Bethesda</a> since this whole thing began, things are starting to look pretty good for <em>Fallout Online</em>. Is anyone else weirded out by the United States Government actively defending a series based on its complete and total destruction? Just us? In addition to announcing a DS extension of the tournament, publisher Playlogic released a batch of screenshots (hit the gallery below) and an online demo (browser plugin required).<br /><br />Despite the game's questionable art direction and insipid dialogue -- in one of the custcenes, a faceless challenger yells out, "<a href="http://www.youtube.com/watch?v=yQbhlf5fjjI">Chiggidy check yourself before you wreck yourself</a>," I kid you not -- the demo is fun and easy to pick up. Players connect groups of like-colored dots with the touchscreen, racing to form geometrical shapes against a time limit to execute moves. If you watched <em><a href="http://youtube.com/watch?v=_K0Pl-1CEZE">Step Up 2</a></em> and have felt compelled to "bust a move" while T-Pain croons a song about girls wearing "boots with the fur" ever since, this title is for you!<br /><br /><em>Red Bull BC One</em> promises a plethora of customization options, 100+ dance animations, and "WFi multiplayer levels." The PSP version of the upcoming <em>WWE Smackdown Vs. Raw</em> features a few classic wrestlers you won't find in the console versions of the game. The three included for Sony's handheld are: Jim Neidhart, Sgt. Slaughter and Eddie Guerrero. IGN has the <a href="http://psp.ign.com/articles/834/834060p1.html">profiles</a> of these wrestling legends, and a few <a href="http://media.psp.ign.com/media/882/882476/vids_1.html">videos</a> too. Attorney <a href="http://www.joystiq.com/tag/jack%20thompson/">Jack Thompson</a> has sent a complaint letter to the Federal Trade Commission for <em>BioShock</em> advertisements aired during Friday night's WWE Smackdown. GamePolitics has the <a href="http://gamepolitics.com/2007/08/19/jack-thompson-shocked-by-bioshock/">full complaint</a> from Thompson, a portion of it states: "Take-Two... is aggressively marketing its newest Mature-rated video game to kids under 17 years of age... On this Friday's night's 8 pm Eastern time airing of WWE's wrestling program "Smackdown," there were repeated ads for Take-Two/Rockstar Game's Mature-rated, incredibly violent <em>BioShock</em> ... This rampant fraudulent trade practice is precisely what 'Big Tobacco' did with its 'Joe Camel' and other teen-targeting ads, while at the same time lying to Congress that it was not marketing its adult product to kids."<br /><br />Hey, we had no idea Rockstar had anything to do with <em>BioShock</em> ... oh wait, that's right, they didn't. The FTC has already stated they think the industry is doing a <a href="http://www.joystiq.com/2007/04/12/ftc-report-mixed-reviews-on-industrys-ability-to-self-regulate/">relatively fine job</a> handling itself; however, the FTC does say the movie and video game industry are both guilty of marketing R and M rated content during shows with inappropriate demographics. Sony has unveiled more details on its ambitious "<a href="http://www.joystiq.com/2007/04/04/sony-tells-teens-dude-get-your-own-psp/">Dude, Get Your Own</a>" advertising campaign for PSP. The promotion will focus on PSP's ability to play games and multimedia and should proudly showcase PSP's <a href="http://www.joystiq.com/2007/04/03/sony-makes-price-drop-official-adds-daxter-and-syphon-filter-to/">new, lower price</a>. According to Sony, a television commercial will be airing now through the end of May on a variety of shows targeted specifically to teens. PSP fans will want to tune in to shows such as King of the Hill (FOX), South Park (Comedy Central), Adult Swim (Cartoon Network), the NBA Playoffs (TNT), Saturday Night Live (NBC), and WWE Smackdown (CW) to catch the new ads.<br /><br />Online ads can also be found on IGN.com, Gamespot.com, ESPN.com and Maxim.com. Additionally, Sony plans to send promotional materials through direct mail. Later this week, Sony will be launching a new "Dude, Get Your Own" website, which will go into further detail about PSP's capabilities. (Hopefully, they'll create a new educational video, unlike the one featured <a href="http://www.joystiq.com/2007/04/10/get-like-totally-educated-about-psps-features/">here</a>.)<br /><br />This aggressive stance from Sony is certainly appreciated. When traveling on his cross-country flights, the celebrity can be often seen playing a match of <em>WWE Smackdown</em> on Sony's portable. "The PSP is a pretty popular system because it doesn't take up a lot of room," said Kane. "It has the Wi-Fi connections so the guys can play each other. We've had some long trips overseas and the guys will actually get some games going on the PSPs. One of the best time-passes I've ever had on a transatlantic flight was a three-way tables, ladders and chairs match with me playing as myself and then the other two guys were playing as Shelton Benjamin and the 80s Hulk Hogan. We had like an hour-long match. With the portability, you don't lose much in gameplay and graphics because it's such an awesome little machine."<br /><br />The wrestler admits that he has a bias for wrestling games, but that's not all he likes in the PSP library. "I've played the PSP version of the game and it's probably the best game on the PSP, and that's saying a lot because the PSP has a lot of good games on it," he notes. Now we know, although this clip raises more questions than it answers.<br /><br />After some wooden back-and-forth dialogue, the scene takes a surprise twist into gender bending. What? A disturbingly compelling game along with a pimped out Mario, that's what. Watch as Mario and chums perform maneuvers from head slams to full frontal kicks <span style="font-style: italic;">in the face. </span>There's even a Solid Snake cameo<span style="font-style: italic;">! </span>Just don't show this thing to your kids, they'll never want to play a Mario game again. And yes, that pink fat dude is Kirby. Weiiird.<br /><br />Who's gonna be the next victim of <span style="font-style: italic;">pimp my video game?<br /></span><br /><strong>Update:</strong> the video has been removed from YouTube. Apparently it violated their copyright rules.
