Specifically, Escobedo owns the copyright to a tattoo present on the virtual version of MMA fighter Carlos Condit in UFC Undisputed 2010 and UFC Undisputed 3.

Escobedo's argument hinges on the idea that, despite being permanently affixed to a public figure, the tattoo's design still belongs to him, as he created it originally and never signed the rights to the design away to Condit. By digitally recreating that design without permission, THQ may have violated Escobedo's copyright on the work. The lawsuit also claims that THQ's usage of Condit's likeness on its website violates Escobedo's copyright as well.

The lawsuit seeks compensation for "actual damages" caused by THQ's usage of the artwork, as well as "an order directing THQ to account to Mr. Escobedo for all gains, profits and advantages derived by them by their wrongful conduct, and to disgorge all profits obtained by their wrongful conduct." Gross.

We've seen food trucks, and crazy shoes, and full-on jets, but we've yet to see a live tattoo application, not to mention one based on a video game.

Enter: Far Cry 3.

Ubisoft hired a local tattoo artist to pre-screen attendees for the tattoo you see being applied just above. Rather than a Far Cry 3 logo, tattooees (not tattooines) are getting a tribal tattoo ripped from the game. Maybe a game logo should have been the way to go -- to help you remember when you explain this art's origin by the time you're 80.

Xbox Live customers now have the opportunity to trade real money for virtual tattoos on fake people via the Marketplace. Available designs encompass the whole of "regrettable," from hot-rod flames and meaningless "tribal" scribbles to idealistic kanji symbols for "peace" and "love."

We should point out that the tattoos aren't actually accessories, but rather t-shirts and tank tops with transparent design "sleeves" that replace your existing clothing, meaning that it's impossible to have a tattoo with anything other than a blank shirt. Tattoos are also arm specific, just like in real life, so make sure you're really committed to the placement of your "Mom" heart before dropping the Microsoft points.

But a fellow who goes by the handle Cranberryzero decided to go for a more permanent solution -- he got a tattoo of the Mii AR card on his arm.

As you can see above and after the break, the tattoo actually works. Whenever the 3DS camera is looking at his arm, the Mii of his choosing appears to be standing just below his wrist. Cranberryzero says the tattoo works best in dim light; in bright light, the device seems to have trouble sussing out the card's border from his skin color.

It's pretty cool -- and clever -- but he'd better start preparing an explanation to give his future grandkids now.

In combining Halo's Master Chief and Nintendo's iconic mascot, Mario, he's created one super tattoo and blueprint for the future prosperity of all gaming peoples. This Master Mario Chief is able to squash Goombas at alarming speed and save not only the Mushroom Kingdom from despair, but all of humanity in the year 2553 -- he's a figure every console owner can love.

Frankly, we applaud this man's courage and dedication to acknowledge that there are good things on all consoles via this permanent tattoo. Instead of blindly trashing the opposition as inferior, he celebrates each console's merits. Except for anything on Sony platforms, though, because Sony totally sucks.

Somehow we totally missed Dirt 2's reinvention of digital "dirt" -- from dusty rally racing to busty Sally tracing. At least, that's what the ploy at Dirtytats.com (NSFW) would have us believe. The game's promotional site presents visitors with a pair of animated assets to put one's ink on. We decided to give our models a lace bra-like tattoo to cover up the ample skin real estate and express -- in a word -- what we thought about this type of marketing being tied into a racing game (after the break, fellow art lovers).

Now, if Saints Row 2 had done something like this ... brilliant! It's all about context.

The person above is just one of several in a collection of folks who, like others we've seen, found a place in their hearts, and skin, for Nintendo and its venerable icons. Pouring over the gallery, some of the ink is tasteful, or at least easily hidden, good advice for anyone mulling over branding their body in the name of their hobby, or company of choice.

Still, while tattooing invincibility stars on your neck may seem like a good idea at the time, the sprites are equally good at keeping you untouchable by gainful employment as they are from shells and animated fungus.

Remember that story we ran a few days ago about the PS3 tattoo? Well apparently, that wasn't the first. That honor goes to SCEE employee Omar Siu who said he got his "This is Living" art piece (as seen above) on Decemeber 22, 2007. Undoubtedly, both Omar's and Mobiletone's tattoos are equally fanboyish and are full of win. We salute you guys!

Omar isn't the only one who sent in pictures of PS-themed tattoos, Marc Blair also shared his tattoo of a wired Dualshock controller. Technically not PS3, but still awesome nonetheless. While we love these PS3 inspired artworks, won't someone please send in a Blu-ray inspired tattoo?! You know, to commemorate Blu-ray winning over HD DVD. Anyway we might not get those Blu-ray tats, so just have a look at Marc's skin art and another pic of Omar's tattoo after the break.

Man. There's a lot we could say about this Duck Hunt tribute tattoo. We could say it's just awesome; after all, it's pretty well done, artistically, and we approve of the subject, as far as video game ink goes. But the placement is somewhat questionable. If you're the owner, you have to wonder just what sort of message this sends. Is it an "aim here" sort of deal? Is that really what you want to convey with your body art, considering? We all want to shoot that damned dog. And if you're, uh, in an intimate situation with the owner of this patch of skin, that's got to be pretty demeaning. That dog haunted gamers around the world with his laughter.

Yep, we can't help but wonder if this isn't going to be something the "lucky" tattooed individual is going to regret one day. Let's hope it's not a permanent inking and just happens to be drawn on.

How much do you love your PS3? Do you love it enough to tattoo it on your body? Mobiletone, a friend of Sony Europe's "semi-official" blog, Threespeech, loves his PS3 so much that he decided to get it tattooed on his arm. In fact, he even made a video. (Presented after the cut.)

"How much do I love my console? I guess this video says it all. It's been nearly a year since the PAL UK launch of the console and I decided to get this tattoo done in honour of what I consider the best console ever made. Love gaming, love women and love life."

This is Living, right? Congrats on your new tattoo, but we're not ready to get our skin inked for the PS3 quite yet. Imagine how much more awesome the PS4 is going to be!

Even on our best day of being totally hilarious and witty (we're still waiting for one day where we can at least be witty), we couldn't make up something like this. A combination of two things that just don't need to be combined like this hasn't been seen since someone decided to combine eggs and oil (we're not a fan of the mayonnaise, to be honest). We're not saying its a bad tattoo (well, maybe we are), but we like our Star Wars without plumbers (unless it's a funny skit about Mario cleaning the stalls in the Death Star bathrooms or something) and we like our Goomba-stomping Mario without the epic conflict of good and evil (man against beast goes down so much smoother for us).

Actually, to tell the truth, we're surprised our minds haven't been blown so much that we forgot how to even post this to the blog.

Aeropause's Stephen Munn is either a fan of Metroid or of spherical game characters. We have yet to hear of any Kirby or Lolo tattoos, so we'll assume the former. This tattoo featuring Samus Aran curled up into a Morph Ball, based on Metroid Prime concept art, is worth at least five incomprehensible kanji tattoos and three or four skulls. It's that good.
To (total weenies like) us, the most impressive thing about tattoos is that each one represents so much physical pain. For example, Stephen here loves Metroid so much that he was willing to be burned continuously with a needle for three hours. We haven't even committed to buying fabric for a plush Metroid yet.

Pokemaniac couple Andy and Jess decided to memorialize their devotion to each other recently by having a water-based Pokemon tattooed onto their girlish frames. According to Wikipedia, the matching Luvdiscs inked onto their stomachs promise "a loving relationship that never ends." Good luck on that, kids.

We'll see how much Andy loves that Luvdisc tattoo when he's 38 years old, Jess has been long forgotten, and dudes keep winking at him every time he brings his kids to the neighborhood swimming pool. I think we can all agree that there's only one Pokemon worth permanently etching into your skin -- Meowth.

We're guessing he's getting ready to *groan* finish the fight. Originally reported on by X3F near the holidays last year, this Halo tattoo features the "legendary level" symbol taking up much of one man's back. The tattoo is slowly coming along as "GothicSlayer" gathers the cash to finish it. The latest installment fills in and gives shading to the Elite skull. Maybe Santa will bring him the cash to finish it before the end of the year.

We think if there is anybody who deserves a Halo 3 Xbox 360 from Microsoft it's this guy. The man is a walking advertisement/conversation piece on any beach. Although you probably can't best him, if you've got Xbox related tattoos to show off, X3F is taking submissions. You won't win anything but the glory of internet fame, and isn't that all anyone needs?

Way back in December of aught-six we ran a story about a man known only as GothicSlayer, a man who decided to adorn his back with a legendary tattoo ... literally. Yes, as you can see above, he chose to have the Legendary difficulty icon from Halo -- with its (appropriately) iconic shield, swords, and Elite skull -- permanently etched into his back. It looks like he's gotten the cash to complete the second phase of his tattoo, as the Elite skull is now fully shaded, and looking much more impressive if we do say so. GothicSlayer informs us that the redness of the tattoo is the result of irritation, so it will most likely fade to a more artsy black and white affair over time.

If anyone else out their has an Xbox related tattoo, please don't hesitate to share it with us.

A Kotaku reader, and prison guard extraordinaire, recently wrote in to talk about prisoners and their love of video games. Turns out, some U.S. prisons provide inmates with money to acquire video game systems as a reward for their hard work. This made the prison guards' jobs that much more difficult, though, as inmates would use the video game systems and various components to create things that weren't intended with their design.

For example, inmates would take the motor out of the N64 Rumble Pak and in combining it with some ink and a needle, could fashion it into a makeshift tattoo gun. We imagine many of the convicts on the receiving end of such a tattoo weren't getting Mario's face put on their body.

So, we started wondering who of you out there have gaming ink on their body somewhere. Personally, we're big crybabies when it comes to needles (seriously, stay away with those things), so a tattoo is out of the question for us, but we can imagine what it might look like; a large Samus graces our chest, firing at a Metroid.

Do you have one? Are you waiting to get one when you come of age? Afraid of needles as we are?

Reader Jason wrote in to show us a pair of tattoos he has gracing his body, on each of his ankle's to be precise. He told us he had read another story showcasing another sweet gaming tattoo and felt his would be appreciated. Oh, they are! We've never seen such sweet Mario and Bowser tattoos before. They're so sweet, in fact, we were sure they were photochopped fakes.

Hello, I'm not sure if we met. I'm Joystiq writer Justin McElroy, and that's my calf. A couple of years ago my two brothers and dad and I started thinking about getting a shared tattoo after my mom passed away. Since we had just been through some bad stuff, it seemed like a good idea at the time. Grief's funny like that. We were all gamers, there were three brothers, so the Triforce seemed a natural fit. We made the decision to do it, then promptly didn't for two years, because I was a wimp.

Okay, so, we're fanboys. That's a given. We love the Xbox, the Xbox 360, and whatever other wünderbox Microsoft has in store for us next. Halo runs in our veins. We played hours and hours and hours of it back in the day. Yes, we love all things Xbox, but we're not sure we love them as much as this guy. Known only as GothicSlayer*, he has decided not to waste the valuable real estate on his back, opting instead to cover it with the Legendary crest found in the Halo series. As it stands it's only an outline, but he plans to get more of the detail filled in as he gets the money to do so (you can get tattoos in installments?). We've seen our share of gaming tattoos, but so far this one takes the cake, kills it, and then eats the cake's children. Let us know how it turns out, GothicSlayer.

Anybody else have any game tattoos they'd like to share with the rest of the class?

The Last Boss has continued pinning up a collection of games-inspired tattoos, ranging from a simple Triforce logo to a leg-coating medley. Some of these new entries certainly deserve to be ranked among the best -- and word has it, a 'best of the best' gallery will go up next year. How much body space would you devote to your inked idols?

Elsewhere, bits bytes pixels & sprites highlights a striking Vincent Valentine. Too bad Dirge of Cerberus diminishes all street cred...

You really love a console once it has been inked under your skin permanently. PlayStation lover Christopher C. Webb tattooed his arm with the circle square triangle x button images, upping his throwdown skillz on the street and providing fodder for incessant questions from future grandchildren.

"Gramps, what are those marks on your arm?"

"Well RidgeRacer, those are buttons *wheeze* from a console I used to game on. My beloved PlayStation."

Metroid tat'Over on Live Journal, 'Mad Mel' has whipped out her Metroid hatchling tat'. Nice. Apparently, she ain't the only one feelin' the 'troid ink.
