For good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged, and intending to be legally bound, the undersigned (“I,” “me,” “my”) warrants and represent that he/she is 18 years of age or older, has read the Official Rules and this Release and agrees to the following in connection with the Weblogs, Inc. (“Weblogs”) “Dead Space™ Costume Contest” (“Contest”):

1. Electronic Arts, Inc. is the creator and owner of all rights including trademark and copyright in and to Dead Space™, and this fan-based Contest is not affiliated in any way with Electronic Arts, Inc., their agents, employees, affiliates or assignees.

2. I understand and agree that I shall not be eligible for any consideration or remuneration, financial or otherwise, with respect to any character designs I create and submit to the Contest. I further understand and agree that neither Weblogs, Inc. nor its parent company, affiliates, agents or employees shall be responsible for any causes of actions that may arise from Weblogs’ use or display of any character designs based on Electronic Arts, Inc.’s intellectual property, which are submitted as an entry in this Contest.

3. I understand and agree that it is possible that other people may submit costume photos that are similar in appearance, name, character, “look and feel,” or in other ways appear to resemble the costume photo that I submit, and that such duplication or similarity between my costume photo and anyone else’s costume photo shall in no way entitle me to any compensation from AOL or from any third party, including in the event a costume photo similar to mine is selected as a winner in this Contest.

4. I understand and agree that Weblogs may, in their sole discretion, post my costume photo in a gallery of submissions, may use my costume photo in promotions and announcements about the Contest, and may, if my costume photo is selected as finalist or winner in the Contest, feature my costume photo on the Weblogs website.

I understand that Weblogs is not obligated to include the Submission in the Program/ Contest and is not obligated to produce the Program/ Contest.

I have read and agree to be bound by the Official Rules listed on the Contest website regarding participation in this Contest, and those terms and conditions are made part of this Agreement and are incorporated herein by this reference.
