Rumors have been circulating today that Kmart stores have been selling copies of <a href="http://joystiq.com/game/call-of-duty-modern-warfare-3"><em>Modern Warfare 3</em></a> prior to its official debut next week. It's clear that a handful of copies were definitely sold, as several eBay listings for the game have been popping up (and taken down) all day.<br />
<br />
At least one listing that is still active does indeed include a picture of a Kmart receipt. It seems the company got wise to the error, as all the locations we called reported the November 8 release. We suppose if you really want <em>MW3</em> five days early, you might be able to snag one. Of course, that's assuming you're willing to pay upwards of $100 <em>and</em> the listing survives underneath eBay's watchful gaze.<br />
<br />
Incidentally, if you find yourself with a legitimate retail Xbox copy, don't worry about playing it early. Stephen Toulouse, Microsoft's Xbox Live guru, has <a href="http://twitter.com/#!/Stepto/status/132174801291837440">given the all-clear</a> on Twitter.<br />

<strong>Update:</strong> Stephen Toulouse has posted a <a href="https://twitter.com/#!/stepto/status/132314235559624704">new update</a> on Twitter, stating that Activision has not authorized pre-release play of <em>Modern Warfare 3</em>. According to Toulouse, "Playing early may impact your account!" Seems a bit unfair to anyone who may have legitimately purchased the game from a retailer, but there you go.<br />
<br />
<strong>Update 2: </strong>Now Both I<a href="https://twitter.com/#!/fourzerotwo/statuses/132595781118066689">nfinity Ward Community Dude Robert Bowling</a> and <a href="https://twitter.com/#!/Stepto/statuses/132596355695788032">Mr. Toulouse</a> have clarified that players with early copies of Modern Warfare 3 will <em>not </em>be banned or otherwise punished for playing the game online. We think. Who can tell at this point?<br />

Most of you early adopters have likely already secured your copy of <a href="http://www.joystiq.com/game/la-noire"><em>LA Noire</em></a>, but if you've been holding back, Kmart's deal might just bring you down off the fence. From today through Saturday, May 21, any purchase of <em>LA Noire</em> will secure you a $20 credit good towards a future gaming purchase, good through July 2, the <a href="http://www.mykmart.com/mykmart_blog/LA-Noire-Launch-Offer">Kmart blog has announced</a>.<br />
<br />
If you head in-store, you also earn a free game (no accessories or points cards), valued at $19.99 or under. A nice little list is available <a href="http://www.cheapassgamer.com/forums/showthread.php?s=e83565faa14be25a90ac549bb24a1514&amp;t=290191">over on CAG</a>, showing off a wide variety of games to choose from including <em>Alpha Protocol</em>, <em>3D Dot Game Heroes</em>, <em>Mirror's Edge</em>, <em>No More Heroes</em> and a lot more.<br />

There is a catch: you need to be a <a href="http://www.shopyourwayrewards.com/">Shop Your Way Reward</a> member and head in-store in order to get the deal. But, honestly, it's not much of one since signing up is free and you don't need to be a detective to know people always want more for less.<br />

If you managed to delay purchasing Valve's gooey, robot-filled puzzler, <a href="http://www.joystiq.com/game/portal-2"><em>Portal 2</em></a>, your patience is about to be rewarded: Two major retailers are significantly cutting the price of the game this weekend. According to the <a href="http://www.facebook.com/kmartgamer/posts/126488980762712">Kmart Gamer Facebook page</a>, the title will be marked down to $34.99 on 360 and PS3 starting May 1 -- an offer that will be running for an undisclosed period of time.<br />
<br />
A tipster also sent in an unreleased GameStop circular, revealing that stores will have the 360 and PS3 versions of Portal 2 on sale for a slightly-less-discounted $39.99, but will also have the PC version on sale for $29.99 on April 30. No matter how you slice it, the value-to-science ratio here is simply unbelievable.<br />

<p>You were all set. You had cleared your schedule for the week of E3, you had sharpened your preview-writing pencils and even sprung for a fedora with a card that said "Press" in it. Everything was in place ... until you learned that the 27 rabid fans visiting your site daily weren't enough to get you into the show.<br />

Though your blog may have been too small to satisfy the ESA's now <a href="http://www.joystiq.com/2011/02/04/e3-expo-putting-caps-on-media-badges-based-on-site-traffic/">stricter requirements</a> for entry, you just might have one last shot at getting into E3, courtesy of an unlikely source: Kmart. The retailer's gaming blog KmartGamer is using its heft to bring three lucky writers to the event (including paying for airfare and hotel). Writers will cover the event for their own outlets, though their work will be reposted on KmartGamer.<br />

From Feb. 15 through 19, the retailer is offering its "<a href="http://www.shopyourwayrewards.com/sywr/home_do">Shop Your Way Rewards</a>" members $25 worth of points for in-store purchases of the game. Kmart is also giving away an exclusive poster (above) with <em>MvC3</em> purchases -- supplies are limited, of course.<br />
<br />
In addition, Kmart is throwing a pile of deals at people interested in <em><a href="http://joystiq.com/game/test-drive-unlimited-2">Test Drive Unlimited 2</a></em>. Through Feb. 12, the retailer is giving away a free code for a Ferrari 612 Sessanta. In-store purchases for 360 will come with free copies of the PC version of <em>Test Drive Unlimited 1</em>, and PS3 buyers get the first game on PSP thrown in. <em>And</em> if you're a member of that rewards program, you get $10 worth of points. Brand new games like <em><a href="http://www.joystiq.com/game/fable-iii">Fable 3</a></em> and <em><a href="http://www.joystiq.com/game/assassins-creed-brotherhood">Assassin's Creed: Brotherhood</a></em> are going for $40, while game of the year contender <em><a href="http://www.joystiq.com/game/mass-effect-2">Mass Effect 2</a></em> can be found for just $10. <br />

The deals apply to Xbox 360, PlayStation 3, Nintendo Wii (<em><a href="http://www.joystiq.com/game/nba-jam">NBA Jam</a></em> for $30, anyone?), and PSP. From August 8 through August 14, <a href="http://blogs.mykmart.com/2010/08/wii-console-sale.html">Kmart is offering</a> lowered -- and some <em>dramatically</em> lowered -- pricing on Nintendo Wii, Xbox 360 (the older, <em>less svelte</em> models) and Sony PSP. As this is an inventory clearance sale, we're not looking at discounts on PSP Gos and brand new black Wiis, so much as the original Wii with <em><a href="http://www.joystiq.com/game/wii-sports">Wii Sports</a></em> going for $149.99 (normally $200) and PSP "Entertainment Packs" (think Hannah Montana's purple PSP) going for $129.99 (normally $200).<br />

Remaining inventories of Xbox 360 Arcade systems will be discounted as low as $129.99 (normally $150), and 120GB Elite models will drop to $199.99 (normally $250). If you can find an <em><a href="http://www.joystiq.com/game/final-fantasy-xiii">FFXIII</a></em>, <em><a href="http://www.joystiq.com/game/splinter-cell-conviction">Splinter Cell: Conviction</a></em>, or <em><a href="http://www.joystiq.com/game/modern-warfare-2">Modern Warfare 2</a></em> "Super Elite" bundle (read: 250GB HDD), they'll be going for $279.99 (normally $350). A trusted tipster sent us this image, which appears to reveal that Kmart is knocking $20 off the usual $200 price of the Wii this week. According to the fine print in the image (<a href="http://www.joystiq.com/gallery/kmart-wii-sale-7-27-10-8-2-10#/0">full size</a>), the deal runs from today through August 2.<br />

At the time of this writing, both the white and black Wii bundles on Kmart's website were still listed at $200, so it's unclear if this is an in-store only promotion (or if it simply doesn't exist at all). Kmart would not confirm to Joystiq whether or not the deal is available, but it should be noted that our tipster has always been <em>right</em> <a href="http://www.joystiq.com/2008/06/27/full-page-kmart-ad-showing-299-xbox-360/">on</a> <a href="http://www.joystiq.com/2009/03/29/rumor-ps2-dropping-to-100-around-april-5/">the</a> <a href="http://www.joystiq.com/2008/08/20/sources-xbox-360-price-cut-week-of-sept-7-60gb-299-elite-3/">money</a>.<br />

The offer is just available for the dates of March 23-27, so just as soon as the game releases, you can just run on over to the store and just walk away with the game after paying just $45. The police can't even stop you -- your actions will be just.<br />

Just saying -- it's just a really good deal. Even if you pick the game up just for kicks, a price like that is just wonderful. We're not sure why Kmart is selling the game so cheap, but why question it? <br />A banner <a href="http://c.kmart.com/081320/ue/home/Kmart-HP_081809_liq_SL1.jpg">ad</a> on KMart's website has reportedly promoted a "new exciting Playstation 3," along with a price cut for old and boring models (see: millions of concurring <a href="http://www.joystiq.com/2009/08/17/slim-pickings-the-story-of-the-fabled-ps3-slim-so-far/">rumors</a>). The Kmart ad is sure to contribute to the ongoing frenzy of speculation surrounding Sony's upcoming press conference at GamesCom -- well, probably. That's just speculation on our part.<br /><br />In addition, <a href="http://kotaku.com/5339547/ps3-slimpocalypse-countdown-fye-price+cuts">Kotaku</a> claims to have received a promotional poster meant for retailer FYE. <br />Following up on yesterday's <a href="http://www.joystiq.com/2008/06/26/rumor-xbox-360-dropping-to-299/">rumor</a> that the Xbox 360 Premium model will soon fall to $299, Joystiq has received (from a separate source) what we believe may be the full-page Kmart ad confirming the price drop . However, our new source says that the flyer is actually for the week of July 13 (E3 week!) and not the originally reported week of July 6. <span style="text-decoration: line-through;">We're attempting to get a better quality scan (this latest image is courtesy of another cell phone) and hope to update by this evening.</span><br /><br /><span style="font-weight: bold;">Update</span>: We now have a very good quality scan of the page. A High-Def Digest forum member by the mysterious name of Master X has captured <a href="http://forums.highdefdigest.com/showthread.php?p=1040328#post1040328">images</a> that appear to reveal an upcoming price drop for the 20GB Xbox 360 Pro console. The images reportedly come from a Kmart flier for the week of July 6. According to the image, the price of the Pro will be reduced to $299, knocking the price down by a hefty $50. There is no word on how this will affect the prices of the Xbox 360 Arcade and Elite models, which currently sit at $280 and $450 respectively. The price cut makes the difference between the Pro and the Arcade (which contains no hard drive at all) a mere $20 though, so we imagine price cuts are forthcoming for all models. <br /><br />Expect updates when we have more information.<br /><br />[Thanks to everyone who sent this in. Gibson seems to be poking its straw into any hole it can find these days, trying to desperately suck up some of that gooey <em>Guitar Hero</em> money before it's all gone. On Monday, the guitar maker filed a federal lawsuit against major retailers that sell <em><a href="http://www.joystiq.com/tag/guitar-hero/">Guitar Hero</a></em> games, including GameStop, Wal-Mart, Target, Kmart, Amazon, and Toys "R" Us, seeking to prohibit sales of the games. In a statement released Thursday, the company claimed it took "this action reluctantly, but is required to protect its intellectual property."<br /><br />Though Gibson has yet to file suit against <em>Guitar Hero </em>owner Activision, the guitar company has made a legal claim alleging that the games (when played with the guitar controllers) violate Gibson's patent for a type of virtual music performance. Subsequently, Activision <a href="http://www.joystiq.com/2008/03/12/activision-files-lawsuit-after-gibson-claims-guitar-hero-patent/">filed</a> a preemptive lawsuit against Gibson last week, and then publicly <a href="http://www.joystiq.com/2008/03/20/activision-believes-gibsons-patent-has-no-merit/">dismissed</a> Gibson's patent infringement claim. Most recently, Gibson <a href="http://www.joystiq.com/2008/03/21/gibson-sues-harmonix-viacom-ea-over-guitar-hero/">targeted</a> <em>Guitar Hero</em> creator and former developer Harmonix, its daddy's daddy Viacom and <em>Rock Band</em> co-publisher Electronic Arts for allegedly violating the same patent ... And we're sure it was a simple mistake on Kmart's behalf (or a calculated ploy at foiling BioWare's launch plans), but it's one that benefits us so we're fine with it. <em>Mass Effect</em> fanboys run, no sprint to your nearest Kmart and demand an early release copy of <em>Mass Effect</em>. Or from <a href="http://youtube.com/watch?v=96jFtzVa80A">Ace of Base</a>! Well, you've tormented us for the last time! Well, actually, you tormented a <em>different </em>blogger for the last time, but all for one and one for all, y'know?<br /><br />See, a blogger, who is still without a Wii (poor lad), has been checking on a daily basis to see if he could snag one of those <a href="http://www.joystiq.com/2007/03/01/wii-warm-up-wii-remains-elusive/">elusive</a> Wii. And he isn't about to pay for one of them rip-off bundles, either.
