PSA: Got a Kinect game early? Don't stick it in!

Perhaps you've received Kinect and an early copy of Kinectimals? "Lucky me!" you might say to yourself, thinking of all the tiger petting you're about to get into. You plug in the Kinect, pop in the game tape, and the Xbox prompts you with an update. "Of course!" you say. "For this crazy camera thing I just got!"
Without thinking, you hit "Continue" -- and that's where everything goes wrong. You see, the update it pulls down isn't the most recent. After updating and upon signing into Xbox Live, your newly updated system will tell you that it needs to be updated again, but here's the catch: That update will fail (see above pic). Without that update, you won't be able to sign onto Xbox Live.
Since Kinect (nor its games) isn't officially available until next week, the latest Microsoft could publicly release the Kinect Dashboard update is November 4. This means you're stuck with an early version of the new Dashboard -- without Xbox Live functionality, not to mention Kinect -- until the update becomes available in the next week or so. Hopefully you like couch co-op!
Update: Microsoft sent over this statement regarding the situation: "Due to a retailer error, a very small number of customers were shipped copies of a Kinect game ahead of launch. Since Kinect does not launch until Nov. 4 in the United States, customers who insert the game into their console before then will be temporarily unable to access Xbox LIVE. The retailer is contacting affected individuals directly to warn them of this situation."[Thanks Ken!]

@psyXcho I would assume it works as it does now, since the beta has fully realized Kinect support. You wouldn't get Party functions or some of the other missing features, but the device would work fine.

@psyXcho Our console IDs are linked to the beta update. Of course, this also means we have to update every few days to the newest, still-prerelease version, and spend about 5 minutes doing so.

Damn! I'm in the Kinect Dashboard beta and even having SOME of the missing functionality of XBL (Prominently, party chat) is annoying as hell. Hope enough people see this. The new dashboard has a lot of improvements, but a lot of them are tied to live. Either way, I hope this leads them to push out the Live update a little earlier.

You can opt out of all those "every night" updates on PS3 - I did, now I only get patches in the same fashion as on 360
- on the beta.. all I will say is - avatar marketplace updating.. and then shake my head .. not figured out where to send feedback on the beta

@Mazrael I was just having a go there, its my fault really, honestly I only turn my PS3 on once or twice a month and thats being generous, as it stands right now I don't plan to use it again until the Ico/Shadow of The Colossus Collection. My Xbox on the other hand is on everyday.

Wait, so if this happens, does it mean you don't get the "Live" functionality, i.e. friends, MP games, etc. Or does it mean you can't use the xbox at all?

@A Burger They straight up told me that I would just not be able to use Live for a week. I have a huge Twitter convo going with @XboxSupport. They are now looking into it again. I've been on the phone with them or chatting through the site, or through twitter since about 2 PM.

I am currently on my 12th one with the RROD which shows they do not care at all otherwise they would have just replaced my pro with elite the works so much better.

you know you can clear the HDD Cache and it will get rid of the updates allowing you to play again
* Go to the Xbox Dashboard, select the System Blade, and select Memory.
* Highlight the HD symbol and press Y.
* Press X, X, Left Bumper, Right Bumper, X, X.
