If anything, this just proves that NEITHER side is really innocent. Is the example of IW purposely crushing Treyarch's dlc with their own video true? To be honest, I wouldn't doubt it. I had several friends who were testers and other jobs at IW, and I often heard stories of a lot of the people at IW being arrogant, ego-driven, and a bit shady. Maybe success does that to you..? Or maybe they were like that from the beginning? Who knows. I may not have any great love for Activision as a publisher, but I've always felt something a little off about Infinity Ward, particularly after their MW1 success. Maybe it was just a matter of time before this happened.

I can kind of see where IW is coming from though. It's like when you do a group project at school and everyone has a part and you do an amazing job and put in a lot of hard work and then some guy in your group doesn't do as much work and just kind of coasts by on the strength of your presentation.

I'm pretty sure that that's the entire point of group projects: to show you that there are people out there who don't give a shit who you will have to work around to get anything done. It may seem unfair when you're in school, but it's actually an unfortunately valuable life lesson.

@A Sandwich - you obvioulsy haven't been in the work place too long. There's a common "rule" called the 80-20 Rule. It means that in any given work environment, 20% of the people there do 80% of the work, while 80% of the remaining people do 20% of the work. And guess what? Usually all involved get the same amount of credit or are at least seen as working equally.

Bottom line, I can't wait for West and Zampella (now Respawn?) to work with EA to create another hit.

This way the consumer gets Call of Duty, and whatever game Respawn has cooking with EA. Basically, despite the result of this lawsuit, the gaming community is gonna win.

Oh yeah, and what lost income? The last two Call of duty games are amoungst the most profitable of all time. wasn't there Just a story about Black Op's making a billion dollars.

I have to agree with you. I like the idea of the consumer getting the best of both worlds. But at the same time i feel it's a shame that half of the studio is gone cause now it feels like the IW name doesn't mean anything anymore. I remember when COD4 was released and i felt IW was the shit and no one could hold a candle to. But now when i say the name it feels like an empty shell of once was. Shame, just a damn shame.

@InDurdenWeTrust - Honestly, there really isn't a chance of them proving a conspiracy unless there is some sort of a paper trail (money changing hands, for instance) and I have a hard time believing that there would be. In seventy pages, all I'm seeing are a few e-mails between a third party and the IW guys, setting up a meeting with the CEO of EA, and then the third party (Blackley) talking about "causing chaos" (his words, not anyone at IW or EA), and talking about representation for the IW guys if they wanted to go independent (with no time frame given). Granted, there are plenty of redaction's to this document, but from what I'm reading, they don't have much. Still, they are making the claim that a lot of documents haven't been handed over, and there could be something in them that sheds some light on exactly what went on (or there could be nothing).

We shall see. I don't think anyone would say that it is ethical for an employee of one company to meet with the CEO of a competing company, but is that alone conspiracy? I'm not so sure.

EA in recent years is a bad publisher and a bad company in general, by the very definition of the term: they can't stop losing money.

The "truth" defense would exonerate any such foolish slander suit. Its only slander when its a lie, of course.

Either way, people have to remember that this is still "alleged". We don't know if any of this is true. But to be honest it sounds like this whole thing came right out of an espionage film.

@Evin Just like every divorce case my office ever did, if we want to see the other sides emails, texts, other things we think may be incriminating; we submit a request. There is no conspiracy or anything at work. This is routine in cases like this.

It's one side of the story. Lawyers are paid to make it sound very good. Rushing to conclusions is naive.

West/Zampella aren't amateurs. They created the highest grossing video game series of all time. It takes savvy and intelligence to do that, and Activision is claiming they are a couple of bumbling corporate spies.

It's easy to believe that West/Zampella had an alliance with EA, based on Activision's heavy handed policies, but hard to believe they could be as dumb as Activision is claiming. Don't forget, Kotick helped his colleague sue a flight attendant on their private jet, because the woman wouldn't succumb to Kotick's colleague's advances. Kotick said, we'll ruin her.

The article was in the LA Times. Kotick is an unscrupulous businessman, and I'd believe just about anyone before I'd believe 1% of what he says.

So what, all of those emails were just magically fabricated by faeries who planted them on West's computer? Or did Activision send some Special Ops commandos from Call of Duty to secretly plant the incriminating evidence on West?

This is pretty obvious sabotage, and it makes it blatantly clear that they should not only have been fired, but also are liable for damages they caused to the company through intentional sabotage.

Of course, the fanboy fools of the internet will thumbs this down because it doesnt shout ACTIVISION IS SATAN.

Even if the video thing is true, so what? There isn't room for healthy competition between studios? Treyarch should accept that as motivation and make a better game. MW2 DID Crush and Destroy World at War, and it was superior to Black Ops also.

@Haywire They didn't 'derail Tryarch's marketing'. They released a preview video for their game on the same day as preview video for DLC, not even the game itself. World at War stunk, and Infinity Ward knew it. They reminded us that a good Call of Duty was still on the way.

You've got to be shitting me.

Do we remember what this lawsuit is about? West and Zampella delivered a title for Activision, on time, under contract, that grossed over a BILLION dollars.

(It's worth noting that the work they did was a big reason why the next year Black Ops was able to make another billion dollars).

West/Zampella and Activision bosses didn't like each other, so they got fired. Fine, that's Activision's prerogative, it happens.

But Activision decided to wait until AFTER they released MW2, THEN fire the guys, and then announce that they would be paid ZERO dollars of their contracted bonuses on a title that grossed Activision over a BILLION dollars.

But even paying them zero dollars for making a billion dollar game isn't enough. On top of that, they are now suing West/Zampella for tens of millions of dollars because they weren't perfect little angels while they were making a billion-dollar software product for Activision.

You can't get any worse than that.

Oh, wait, you can. Activision repeatedly refers to OTHER HUMAN BEINGS as "greedy" and "obsessed by jealousy" in the documents, because they won't pay Activision tens of millions of dollars for the crime of making Activision a billion dollars.
