Bethesda isn't suing them because the game is anything like Elder Scrolls. They just need to do it in case some one else DOES make a game like The Elder Scrolls, and then names it something similar to try and trick people into buying it. If Bethesda takes that imposter, who IS actually copying them, to court, the imposter can then say "Well, Mojang called their fantasy game Scrolls, and Bethesda didn't sue them, so we had reason to believe it would be alright for us to do the same." The judge would PROBABLY still declare Bethesda the winner, but it's still possible for them to lose, and they're just trying to head that of f.
The good news is that Bethesda doesn't have to win and get a ton of money from Mojang in order to show they care about their copyright to "The Elder Scrolls". They just have to file the suit, and if they settle out of court or whatever with Mojang, they can still say "We DID defend our copyright to "The Elder Scrolls"" when the imposter rolls around with their Elder Scrolls knockoff, without needing to run Mojang into the ground.
It is kind of stupid and ridiculous, but hey, that's copyright law.

This trailer actually makes it worse, using those unfinished hand drawn characters as either a nod, or a punch at Bethesda. They're all done in the style of Morrowind.

@TalkingBidoof That's probably the most accurate description of what is likely going on with the dispute over the "Scrolls" name.

Reminds me of Dungeon Fighter and other 2D brawlers. Coming from the Minecraft guy, that's not really impressive. I'm not ready to write it off yet, but Notch better have some tricks up his sleeve if he's planning on winning me over.

Where are the dragons? Disappointed by bethesda to have a trailer for Scrolls 5 with no mention of dragons :( (lol, my friends call it "skyrim" how are we meant to know its part of a series????)
