Interplay, please, just stop. I know you are working developers, I do not wish you ill. But I care too deeply for the Fallout franchise for anyone with less than 100million dollars to produce an MMO within that IP.

Silly argument; its not about you, its about the freedom for developers to own their creative property. If Bethesda wins this case, much as I love them, its a dangerous precedent for any developer going forward in regards to their creative property.

No, other people created that IP, back when Interplay was a functioning game developer. Then those people quit or were fired, and the current owners of the company name and IP tried to make money off of both.

How does creating the IP equate with having 100million dollars to invest? They are not the same. Interplay did create the FO franchise and Interplay is bankrupt. I don't want a bankrupt company developing a franchise I care about.

Freedom of developers to develop someone else's intellectual property? As I understand it, Bethesda is the full own of the IP. If the above is accurate and Beth still has the legal authority to deny the FO MMO from ever being published, then why is Interplay bothering to develop the title? Like I said, I don't wish Interplay ill, but they are very broke and them trying to develop this game seems more like a desperate attempt to keep their studio afloat, rather than making the best possible Fallout MMO.

(far) More of the founding members of Interplay work for Obsidian than work for Interplay. I know that doesn't really impact Bethesda, but it certainly makes the controversy surrounding New Vegas seems absolutely hilarious. All the people complaining about how it still wasn't Van Buren.. apparently weren't aware that the lead members on Van Buren were the lead members on New Vegas.

In any case, they have like 1 or 2 big names from Fallout's past to rely on, but they are individuals who haven't stayed active (see Obsidian for those members). Besides this, Interplay has NO money, and, as far as I can tell, no real game plan for a Fallout MMO.

I generally think this is a dickish move on Bethesda's part, but Interplay isn't really a company at all anymore. As such, I have to take Bethesda's side on the whole thing.. they're the only ones who would do a Fallout MMO justice.

Because Bethesda did sooo well with New Vegas. Ugh, even with Fallout 3 being one of my favorite games, I can't even bear to finish playing New Vegas.

Obsidian developed New Vegas, Bethesda is the publisher. And while I think it is unfortunate that you did not enjoy FONV, I personally thought it was an excellent game.

They should just see if it looks good and roll with it. Take a cut of the profit or something. I don't understand this stuff to much but that seems easier. Interplay workers get to keep their jobs and Bethesda gets paid.

@Diet Kane Bethesda would make a great Fallout MMO with bad animations. Interplay would run out of money making their MMO before animations were even implemented into the game.

The change of ownership sees original IP-holder, Interplay, becoming a licensee to Bethesda and paying the Elder Scrolls developer a 12% royalty on net sales derived from an upcoming Fallout MMO. Interplay's license requires them to begin development within two years of the date of agreement, secure a minimum of 10,000 subscribers and offer a product that complies with "the quality standards of Bethesda."

Bethesda agreed to this when they bought the IP from Interplay

This is the part the I don't expect to happen. I don't say this because I am a Beth fanboy or anything, I just would rather FOMMO not happen than it happen and be a disappointing entry for the franchise.

Thanks for posting this info.

@DoctorFrank That's not a very high bar. Bethesda Quality standards ensure all products ship with game debilitating bugs and glitches, at least two of which will never, ever get patched. That clause almost seems to be in there to make sure they don't show Bethesda up as opposed to tarnish their reputation.

I jest from the heart!

I know I'm not gonna make too many friends saying this, but I'm pretty worried about FO because I think the continuity will be a mess. If you have one development team doing one thing, then another doing something else ... there's probably going to be some contradictions. And I don't want to have to pick sides, I just want one single and comprehensive universe for Fallout. :(

looking into the lawsuit, it is silly that Bethesda would allow Interplay to use the Fallout name but not any Fallout features or assets, then sue Mojang over "Scrolls"

Yes, Fallout 3 is such a GOOD GAME!

After all there is nothing quite like watching your avatar gliding on the map like an ice skater in third person mode.

I really love blowing the enemies into poorly animated polygonal chunks that scatter contrary to the laws of physics. Always good for a laugh.

Even better is when we get to walk around in a ship and get lost in first person mode. Getting lost on ships is fun!

I could always specialize my character in everything which is awesome. It doesn't really matter since I'm just wandering a bland landscape pounding the keys with broken shooter mechanics anyway.

Bethesda Sucks. Elder Scrolls Sucks. Fallout 3 Sucks.

Clearly the Interplay of today is not the creator of the legendary original games.

However , I wish them all the success in the world in their suit.

Please Jesus, take the fallout license from Bethesda so some company can make a real fallout game.

RIP FALLOUT

@UnknownVoice Your God Hand example is trash. According to Metacritic, of the 48 critics that reviewed it, only 11 gave it a rating lower than a 70, with a total aggregate of 73.

kevpwnsu brought up the whole picture for Fallout 3, using a few crappy outlets low scores for a game doesn't compare.
