Actually, this is good evidence that an arbitration clause isn't there to screw people. There are many reasons why arbitration would be preferable to a civil trial.

@Janitor Nope, that's straight-out fifty dollars. The company that invested in Harmonix also had to take over responsibility of other things, such as music licensing fees and responsibility for unsold games, etc. Also, it netted Viacom a $150 million tax reduction.

So, when everything comes to an end, Viacom more or less got $150 million dollars (in the sense that they didn't have to pay that to the state) and avoided losing any more money.

If I remember correctly, the $50 amount is correct, but the unwritten piece of that is that the transfer also included the massive licensing liabilities for all of the music included in the games and as DLC. So, I think that some amount of financial backing was needed to support the music library (without which Rock Band would have been useless, not to mention a royal legal mess). Perhaps someone with a stronger grasp of the legalities can explain it better.

Oh yeah all the people who say the no sue clauses in things like the PSN and XBLA are no big issue ..... take a look at what happens when that binding arbitration doesn't go in favor of the company. They take legal action to have it overturned.

So its apparently only "binding" if it goes in their favor otherwise its legal chicanery and undoubtedly stalling until the cows come home.

As the article notes, you would also have assumed a huge amount of the fiscal responsibilities of Harmonix too; fifty bucks is just a formality as at least some amount of money must change hands in a sale. Though they could have gone with a cent, or something a little higher to make it a competitive bid. My theory? Paid the representatives' cab fares home.

Wow, first time I heard something turning in Company-sponsored Arbitration turning out GOOD for someone other than the company!

Viacom sues for $131 million and that turns into a $383 million reward for former Harmonix shareholders??? Wow!

I'm wondering how Viacom is able to get around the arbitration clause that they themselves triggered upon filing their lawsuit. Only thing that seems to make sense is if the arbitration clause was non-binding, in which case I dunno why either side would entertain arbitration to begin with. I suppose if it takes care of most of the work and courts would simply review and decide if the verdict is valid or has questionable merits. But honestly, sounds like Viacom should just cough it up.

Arbitration is great when it works in your favor, but when it doesn't, it's because of "improperly excluded" evidence. I wonder if that will work when I have to go to arbitration with Microsoft in the future...
