Gametrailers, whom Beiswenger sued in the same case, settled with the author on May 18 under undisclosed terms.<br /><br />Beiswenger voluntarily dismissed all action against Ubisoft before any formal adjudication on the validity of his claims could begin - <a href="http://www.joystiq.com/2012/05/09/novelist-suing-over-assassins-creed-has-his-lawyer-respond-to-g/">the Internet</a> made up its mind about his claims a while ago. Beiswenger has dropped the case, citing the expense of federal litigation:<br /><br />"I filed the Complaint and Motion for Preliminary Injunction in federal court because I believe authors should vigorously defend their rights in their creative works; otherwise, the laws protecting them simply have no purpose," Beiswenger's official statement reads. "Regrettably, the resources required to defend those rights are unavailable to many individual creators. As a result, rampant infringement is occurring with impunity."<br /><br />Beiswenger was seeking $5.25 million in damages and the potential cessation of all Assassin's Creed endeavors, including the <a href="http://www.joystiq.com/game/assassins-creed-3">third game</a> currently due out in October. Beiswenger says his novel discusses "assassinations" and has "spiritual and biblical tones" also found in Assassin's Creed. And then there's the battle between good and evil that Beiswenger says Assassin's Creed stole right from the pages of <em>Link</em>.<br /><br />Beiswenger is suing Gametrailers for the Assassin's Creed trailers that he says infringe on the same <em>Link </em>copyright. There are 11 counts against Ubisoft and Gametrailers in total, and only most of them made us laugh.<br /><br />Beiswenger is seeking up to $5.25 million in damages and a cessation of further copyright infringement. <a href="http://www.eedar.com/">Electronic Entertainment Design and Research</a> (EEDAR) has released a report listing various attention metrics from gamers from two sites, GameTrailers and IGN.com, regarding the most "popular" titles from E3. We put "popular" in quotes there because these stats are for things like trailer streaming and page views rather than a scientific survey -- this is a general feel of the zeitgeist on these two specific sites rather than a comprehensive view of what gamers thought of E3.<br />
<br />
But there are interesting things to note even in this limited set of stats, especially when you compare it to our own anecdotal show floor and "chatter" data from you commenters. We heard from quite a few of you during the show that <a href="http://www.joystiq.com/2010/06/15/nintendo-e3-keynote-live-from-the-nokia-center/">Nintendo's press conference</a> was the most popular event, and this list agrees. Likewise, <a href="http://www.joystiq.com/tag/The-Legend-of-Zelda-Skyward-Sword/"><em>The Legend of Zelda: Skyward Sword</em></a> was one of the most popular titles on the show floor, and there's no shortage of Link representation here. <a href="http://joystiq.com/tag/kirbys-epic-yarn"><em>Kirby's Epic Yarn</em></a> is probably the biggest unannounced-before E3 title on the lists, and <a href="http://joystiq.com/tag/marvel-vs-capcom-3"><em>Marvel vs. Capcom 3</em></a> captured a lot of attention -- not much was revealed at the show itself, but it was placed front and center on <a href="http://www.joystiq.com/screenshots/e3-2010-show-floor#/40">the floor of the West Hall</a>.<br />

At the same time, there are some weird conclusions here. <a href="http://joystiq.com/tag/world-of-warcraft-cataclysm"><em>World of Warcraft: Cataclysm</em></a>, an expansion which didn't even make an appearance at E3, registered in the top 20 in the GameTrailers stats and <a href="http://joystiq.com/tag/red-dead-redemption"><em>Red Dead Redemption</em></a>, a game that's already out, picked up spot No. 8 on IGN's Page Views list of big E3 titles. EEDAR also notes that the <a href="http://joystiq.com/tag/nintendo-3ds">Nintendo 3DS</a> didn't rank on any of these lists, but given the lines at the Nintendo booth to see it, the new handheld garnered plenty of attention. So you can't really bank on these titles yet. Yes, a <a href="http://www.gametrailers.com/video/episode-i-pach-attack/61172">new video segment titled "Pach-Attack"</a> gives the technoprophet his own soapbox from which he can voice his opinions and <em>say his sooths</em>, all presented in crystal-clear HD video.<br />

<div style="text-align: left;">Joining games the likes of <em><a href="http://www.joystiq.com/tag/halo-reach">Halo: Reach</a> </em>and 2K's new <em><a href="http://www.joystiq.com/2009/11/21/mystery-vga-teaser-revealed-as-spec-ops/">Spec Ops</a> </em>debuting at this year's <a href="http://www.joystiq.com/tag/Spike-VGA-2009">Spike Video Game Awards</a> is a new installment in the <em>Tron</em> franchise. It's not the first time we've heard of the game -- it was <a href="http://www.joystiq.com/2009/01/31/rumor-disney-interactive-begins-work-on-new-tron-game/">rumored</a> to be in development back in January of this year. Still, its existence is confirmed by an all-too-brief teaser at <a href="http://www.gametrailers.com/video/exclusive-tron-spike-tv/59382">GameTrailers</a>, which promises a proper unveiling at Spike's awards show on Saturday, December 12.<br />
<br />
Based on the teaser, the game may simply be titled <em>Tron</em> -- although the logo and art style found in the footage are very similar to that of the upcoming movie sequel, <a href="http://www.apple.com/trailers/disney/tronlegacy/"><em>Tron: Legacy</em></a>. We'll find out exactly what to expect on the Game Grid in just a little over two weeks' time. For now, check out the teaser after the break.<br />

Last night's <em>E3ified</em> <a href="http://www.gametrailers.com/gametrailerstv_player.php?ep=61&amp;starttime=575">GameTrailers TV</a> gave us our first glimpse at the gameplay featured in <a href="http://www.joystiq.com/tag/aliens-vs-predator/"><em>Aliens vs Predator</em></a>, one of three (<a href="http://nintendo.joystiq.com/2009/05/26/is-this-a-video-of-aliens-colonial-marines-for-the-ds/">four</a>?) Sega-published <em>Aliens</em>-based games currently in development. Of the many trailers shown on tonight's GameTrailers TV, <a href="http://www.joystiq.com/tag/split-second"><em>Split/Second</em></a> stands out as the only one where gameplay involves avoiding a plane landing in front of you at high speed. And that makes it all the more exciting! From Blackrock Studios, the company whose prez said this game would refresh the <a href="http://www.joystiq.com/2009/04/21/black-rock-dev-says-racing-genre-is-dying-split-second-will-s/">'dying' racing genre</a>, we were already wondering if the next racer after <a href="http://www.joystiq.com/tag/pure"><em>Pure</em></a> could be even better. <br /><br />Though the premise given through voice over in the trailer (after the break) comes off a bit hammy, we'll forgive it for the range of spectacle drizzled throughout the gameplay. Fresh off the announcement of <em><a href="http://www.joystiq.com/2009/03/25/gdc09-train-your-eyes-on-the-legend-of-zelda-spirit-tracks/">The Legend of Zelda: Spirit Tracks</a> </em>at <a href="http://www.joystiq.com/tag/gdc-09">GDC 2009</a>, Nintendo of America head honcho Reggie Fils-Aime had some interesting things to say about Nintendo's plans for this year's E3. "From Nintendo's perspective, we always go into E3 with a very high bar wanting to satisfy not only the core fans but also ourselves," he told <a href="http://www.gametrailers.com/gametrailerstv_player.php">GameTrailers TV</a>, teasing the reveal of a release date for the upcoming Zelda. "We haven't announced a launch date -- maybe we'll do that at E3."<br /><br />So, conclusive evidence of a brand new <em>Kid Icarus</em> game? Not quite. Though Keighley hammered "<a href="http://www.joystiq.com/tag/reggie-fils-aime">the Regginator</a>" for details on what exactly Nintendo would be bringing to the "<a href="http://www.joystiq.com/2009/02/17/esa-exec-e3-2009-to-bring-back-glamour-and-sizzle/">glamour and sizzle</a>" fest of this year's E3, the exec kept mum, saying, "Everyone wants to know what we're going to announce at E3 and my answer is, come to E3 and you'll see." Nintendo has officially announced (via <a href="http://www.gametrailers.com/player/47808.html?type=flv">GameTrailers</a>) an ... interesting looking ... multiplayer mode for upcoming Wii game, <em>Punch-Out!!</em> Hidden after a full minute of the <a href="http://nintendo.joystiq.com/2009/03/23/this-week-on-the-nintendo-channel-punch-out/"><em>Punch-Out!!</em> trailer</a> we've already seen is the <em>entirely new</em> minute, containing news of not only the modestly named "Head-to-Head" mode but also "Giga Mac" (pictured above).<br /><br />Gleaning what we can from the trailer, we're wont to believe that the large version of Little Mac is a direct product of well-placed punches filling up a "super" meter next to each players respective health bars. Nintendo clearly wants us to know the appearance of "Giga Mac" isn't a game ender for multiplayer, though, as even in the video (after the break) Little Mac prevails against his gargantuan twin. Light on gameplay but heavy on <em>murder</em> the first trailer for <a href="http://www.joystiq.com/tag/battlefield-bad-company-2/"><em>Battlefield: Bad Company 2</em></a> got "world exclusive" status on this week's <a href="http://www.gametrailers.com/game/5927.html">GameTrailers TV</a> (after the break).<br /><br />Showcasing the cycle of "smoke a cigarette, kill a dude, get killed yourself" in a <em>MadWorld</em>-esque aesthetic, we can't help but wish for actual gameplay footage from the game -- the <a href="http://www.joystiq.com/2009/02/03/ea-confirms-mass-effect-2-and-battlefield-bad-company-sequel/">first <em>Bad Company 2</em> screen</a> was madness! GameTrailers' excellent retrospective series is back this week with two new installments for different game franchises. The first new series its premiering is the Warcraft Retrospective, which has its debut episode (in the four-part series) covering the original two installments in the <em>Warcraft</em> RTS series. It's hard to recall <em>Warcraft</em> ever being a humble RTS series considering the behemoth <em><a href="http://www.wowinsider.com">World of Warcraft</a></em> has become.<br /><br />GT will also premiere a one-part <em>Fallout</em> retrospective this Saturday, Oct. 25. GameTrailers has three videos, each showing one of the game's weapons in action. Our favorite? The Line Gun. Using it to slice through enemies looks extremely visceral and satisfying. There's an old adage that goes, "if it ain't broke, don't fix it." GameTrailers user <a href="http://www.gametrailers.com/player/usermovies/244701.html">WiiSixty</a> has compiled a video featuring segments of<em> Resident Evil 4</em> and <em><a href="http://www.joystiq.com/tag/Resident-Evil-5/">Resident Evil 5</a></em> gameplay to showcase the similarities between everything from reload animations to enemies spinning like a top from a well-placed bullet from both titles. The question lighting up message boards is whether or not <em>Resident Evil 5's</em> continuation of "the same thing" is well advised or not. Is it possible we're jumping to conclusions and calling the <em>Resident Evil 5</em> gameplay mechanics old because of the substantial changes <em>RE4</em> made to the series? Maybe with games like <em>Gears of War </em>and <em>Army of Two</em> borrowing those mechanics we're all a little burnt out on them. If you're looking for new gameplay videos and information on the sequel to the PS3's well-received launch title, you'll have to watch <a href="http://www.gametrailers.com/gametrailerstv_player.php?ep=19&amp;ch=1&amp;sd=1">the <em>entirety </em>of last night's episode of GameTrailers TV</a>, as the individual nuggets of new information about the game have yet to be compartmentalized into easily digestible clips.<br /><br />There's some interesting gameplay footage spliced throughout the episode, but for those of you who don't have 22 minutes to kill, you can check out <a href="http://www.gametrailers.com/gametrailerstv_player.php?ep=19&amp;ch=1&amp;sd=1">chapters one</a> <a href="http://www.gametrailers.com/gametrailerstv_player.php?ep=19&amp;ch=2&amp;sd=1">and two</a> for details about the single player campaign, <a href="http://www.gametrailers.com/gametrailerstv_player.php?ep=19&amp;ch=3&amp;sd=1">chapter three</a> for new info about mutliplayer, and <a href="http://www.gametrailers.com/gametrailerstv_player.php?ep=19&amp;ch=4&amp;sd=1">chapter four</a> for new characters and weapons. If you surfed GameTrailers over the weekend, it's possible you came across a (now pulled) <a href="http://www.joystiq.com/2008/05/12/gametrailers-compares-ps3-grid-to-ps3-grid/">video comparison</a> of the Xbox 360 and PS3 versions of <a href="http://www.joystiq.com/tag/grid"><em>Race Driver GRID</em></a>. There were multiple segments edited together, some of them labeled as PS3 footage while others were labeled as 360 footage. The problem and, hence, fiasco surfaced when sharp-eyed viewers realized that <em>all</em> of the footage appearing in the video was from the Playstation 3 version. Adding fuel to the fire, many denizens of the net concluded that the video painted a better picture of the "Xbox 360" footage (though no specific declarations were actually made in the video).<br />

Many shouted conspiracy, while more levelheaded viewers assumed it was simply a mistake. To find out exactly what happened, Joystiq went directly to the source, GameTrailers. The verdict, according to GT Editor in Chief Shane Satterfield: "It was a mistake in our post-production process." For those of you who have no idea what we're talking about, here are the cliffs notes: GameTrailers released a comparison video showcasing the difference between the Xbox 360 and PS3 versions. Strangely the video only showed PS3 footage and, as a result, people made a lot of noise about GameTrailers being <a href="http://www.joystiq.com/2008/05/12/gametrailers-compares-ps3-grid-to-ps3-grid/">biased towards the 360</a>.<br />

Shane Satterfield has participated in an interview with Joystiq to set things straight. He states that the video showing PS3 footage as Xbox 360 footage was "a mistake" and that "some of the footage of the PlayStation 3 version of the game was incorrectly placed in the bin for the Xbox 360 footage." Satterfield states that there is no bias and that they haven't had any advertising from Microsoft for two years. Is the site horrifically biased? On Microsoft's payroll? We spoke with GameTrailers Editor In Chief, Shane Satterfield, to clear up the matter.<br />

<strong>How did this mistake happen?<br />
</strong><br />
It was a mistake in our post-production process. After we captured the footage from both versions, some of the footage of the PlayStation 3 version of the game was incorrectly placed in the bin for the Xbox 360 footage. Our video editor on this particular project is not a games person and completely overlooked the fact that he had the wrong footage in the wrong place. We normally have multiple checks from games editorial on every segment that is published, but there was some confusion on who did/did not look at it before it was sent out for compression. Thus, the mistake. <br />

The space flight-sims <em>X-Wing</em> and <em>Tie Fighter </em>-- two games which used the <em>Star Wars</em> universe for all it was worth -- probably still hold a special place in gamer's hearts who had something better than a 386 computer at the time. By now, we've seen all the teasers released by Rockstar, and <a href="http://www.joystiq.com/2008/04/27/metareview-grand-theft-auto-iv-xbox-360-ps3/">read the write-ups which were hidden behind the floodgates</a> just a few hours ago. The video will feature everyone's favorite lead designer Cliffy B doing a special (and we're sure very badass) video introduction which is said to include Marcus Fenix who will probably, no doubt, be tearing apart hordes and hordes of Locust scum. It's worth noting that as the second trilogy went on, fewer and fewer licensed games were based on the films (9 for <em>Episode I</em>, 7 for <em>Episode II</em> and 2 for the finale). After the first episode's focus on the primitive origins of the franchise, it's nice to see some games that we've actually played -- including JVC's punishing SNES adaptations of the original trilogy, a LEGO title, and the legendary <em>Star Wars Trilogy Arcade</em> from Sega.
