Lambert admitted his appearance in a Bridgestone commercial playing a Wii may have confused some consumers, thinking the Kevin Butler character endorsed both Nintendo and Sony.<br /><br /><a href="http://www.joystiq.com/2012/10/07/sony-kevin-butler-actor-in-lawsuit-over-breach-of-contract/">Sony sued Lambert</a> in October based on violations of the Lanham Act, misappropriation, breach of contract and tortious interference with a contractual relationship. <a href="http://www.joystiq.com/2012/10/09/bridgestone-respond-to-sony-kevin-butler-wasnt-in-our-commerci/">Bridgestone denied</a> that the Kevin Butler character appeared in any of its commercials, but removed Lambert from its ads.<br /><br />As part of the settlement, Lambert agreed to not appear in any advertisements that feature or mention "any other video game or computer entertainment system or video game company" for two years. Following Sony's allegations over Butler actor Jerry Lambert's appearance in a Bridgestone commercial, the tire manufacturer made a statement via <a href="http://www.hollywoodreporter.com/thr-esq/sony-sues-kevin-butler-playstation-jerry-lambert-377151">The Hollywood Reporter</a> declaring its intention to fight the lawsuit. As far as Bridgestone is concerned, Lambert appeared in its commercial but wasn't starring as Kevin Butler in any way whatsoever.<br /><br />"Mr. Lambert is one of the actors who appeared in the commercial as a Bridgestone engineer," reads the statement, "Bridgestone denies that 'Kevin Butler' appears in the Bridgestone commercial discussed herein and thus denies that he speaks or does anything whatsoever in the commercial."<br /><br />It emerged last month Lambert appeared in a commercial as part of Bridgestone's "Game On" campaign, featuring him playing a Wii and acting in a similar exuberant manner to his PlayStation persona of <a href="http://www.joystiq.com/tag/kevin-butler">Kevin Butler</a>. Sony believes Bridgestone and Lambert's advertising agency Wildcat Creek  are guilty of violating the Lanham Act, misappropriation, breach of contract, and intentional interference with a contractual relationship. Sony filed the lawsuit on September 11, and Bridgstone has since removed Lambert from its most recent ads. Sony's claims are based on violations of the Lanham Act, misappropriation, breach of contract and tortious interference with a contractual relationship, senior director of corporate communications Dan Race writes in a statement to <a href="http://venturebeat.com/2012/10/06/sony-sues-kevin-butler/">VentureBeat</a>.<br /><br />Early in September, images and video of Lambert in Bridgestone Tires' "<a href="http://www.bridgestonetire.com/gameon/">Game On</a>" promotion gained traction online, wherein Lambert is playing a Wii and over-acting in a style similar to his Kevin Butler character. Lambert appeared in Bridgestone commercials <a href="http://www.youtube.com/watch?v=C_X3mVnuB10&amp;feature=player_embedded">as early as February</a>. On September 11, Sony filed a lawsuit against Bridgestone Tires and Wildcat Creek, an advertising agency for which Lambert <a href="http://www.corporationwiki.com/California/Sherman-Oaks/wildcat-creek-inc/44931717.aspx">is actually president</a>.<br /><br />Since the filing, Lambert has been removed from the most recent Bridgestone ads. The Game On promotion ended on September 30.<br /><br />"We invested significant resources in bringing the Kevin Butler character to life and he's become an iconic personality directly associated with PlayStation products over the years," Sony's statement says. "Use of the Kevin Butler character to sell products other than those from PlayStation misappropriates Sony's intellectual property, creates confusion in the market, and causes damage to Sony."<br /><br />Lambert and Sony reached an agreement on September 26, and Sony has until October 12 to officially withdraw the suit or announce it will continue forward. Listed in the voice cast are Nolan North as Uncharted's Nathan Drake, David Hayter as Snake, Eric Ladin as <em>Infamous's</em> Cole McGrath, and ... Jerry Lambert as fictional executive Kevin Butler.<br /><br />It's tempting to imagine Kevin Butler's in-game stint as the VP of Special Attacks, but these characters aren't necessarily playable. The game is full of cameos, like Captain Quark in the background of a <em>Ratchet &amp; Clank</em> level. We're asking Sony to clarify this information. Kevin Butler would tell us, if he existed.<br /><br /><strong>Update:</strong> For its part, Sony said it didn't set up the IMDB page. Four bleak days after Sony ad man Kevin Butler <a href="http://www.joystiq.com/2011/08/26/kevin-butler-quits-sony-via-twitter-sony-says-to-keep-followin/">publicly resigned</a>, Sony released a new video laying out its new ad campaign and reintroducing us to the VP of ... well, <em>everything</em>. "Long Live Play" is the new motto, replacing <a href="http://www.joystiq.com/2009/08/27/north-american-ps3-slim-ad-campaign-does-everything/">"It Only Does Everything"</a> as the phrase we hear interwoven into press conference speeches and sizzle reels for the next year or so.<br />

Always the showman, Butler kicks off the motto with a bang, as you'll see in the video above. Kevin Butler would be a wonderful Sony VP if he actually existed, and we would be upset to hear of his resignation if it were real. This makes us very emotionally confused about Sony's latest marketing ploy, which has <a href="http://twitter.com/#!/TheKevinButler">@TheKevinButler</a> tweeting that he's quit Sony to be president of the family flooring business. How do we react when a fake person fake-quits his fake position at a real company? We're not sure, but so far we've been eating a lot of chocolate and manically watching Desperate Housewives.<br />

@TheKevinButler posted two tweets today about the job switch and his profile now reads, "President, Economy Flooring. I'm a man of the people and the people need help. Carpets worn? Hardwoods warped? Linoleum non-linear? Rest Easy, KB's here to help." As legit as this may seem, Sony has hinted at a Twitter-tease, telling <a href="http://www.industrygamers.com/news/sonys-kevin-butler-still-promoting-playstation/">Industry Gamers</a> to "stay tuned. We'll have more info on KB's new upstart career shortly. Unfortunately, that code turned out to be the key once used to hack the PS3 through a USB dongle. In essence, the great KB helped to spread exactly the sort of information his company's been <a href="http://www.joystiq.com/2011/02/05/sony-looking-to-expand-jailbreak-lawsuit-to-more-defendants/">fighting to keep secret</a> in court.<br />

Of course, the tweet was quickly deleted. It wasn't that severe a leak anyway, since Sony's already fixed the exploit that it used and that key <a href="http://twitter.com/#!/Digital_Foundry/status/35267687189839872">isn't the one being contested</a> in the ongoing lawsuit. The real damage here is to KB's <em>reputation</em>. After deleting the tweet, whichever PR person runs the account quickly dived into a relatively harmless attempt to start a "#gamingis" trend. What, no snarky comeback or humorous braggadocio, KB? As co-CEO at ad company Deutsch LA, Eric Hirshberg was partially responsible for turning the PlayStation 3 from <a href="http://www.youtube.com/watch?v=gqkNPcUMffU">something that freaked us out</a> into a platform for <a href="http://www.joystiq.com/2010/02/02/kevin-butler-to-star-in-playstation-ads-for-rest-of-2010/">the VP of Awesome</a>. Now, HIrshberg is able to comment on a similar turnaround at Activision. As the <a href="http://www.joystiq.com/2010/07/13/activision-publishing-names-eric-hirshberg-as-new-ceo/">CEO of the publishing group</a>, he says that "some of Activision's reputational challenges are not based in the reality of the company that I've experienced here so far. ... What I can tell you is since I've been here there's not a day or an hour that goes by without a conversation or focus on creative excellence in delivering great gaming experiences to our fans. That's what this place is focused on and about."<br />

Yes, Activision may have <a href="http://www.joystiq.com/2010/11/16/activision-reportedly-closing-bizarre-creations/">put a "for sale" sign on UK racing studio Bizarre</a>, <a href="http://www.joystiq.com/2010/03/31/report-activision-reshuffles-execs-in-us-uk-layoffs-result/">laid off staff</a> at <a href="http://www.joystiq.com/2010/02/11/luxoflux-shuttered-as-layoffs-hit-activision-dev-studios-publis/">Neversoft and Radical Entertainment</a> and elsewhere, and weakened <a href="http://www.joystiq.com/2009/10/06/report-activision-reduces-7-studios-by-half/">studio</a> <a href="http://www.joystiq.com/2010/11/16/activision-shuttering-budcat-downsizing-california-qa-team/">after</a> <a href="http://www.joystiq.com/2009/08/27/raven-software-confirms-layoffs-new-size-reflects-upcoming-wo/">studio</a>, but Hirshberg says all the cuts are indicative of just how tough this business can be. And even in a tough business, says Hirshberg, "we do everything we can to make the relationships with our developers work, and to find a commercially viable use of their talents, and it's only when we've exhausted every other opportunity that [shutdowns and layoffs] happen."<br />
<br />
The video game industry, he says, is "a high stakes game when everyone's trying to get into that upper echelon of performance and there's no middle class," which means, presumably, that Activision has to be judicious when choosing who gets to keep working. A Best Buy employee and Sony spokesperson Kevin Butler (both of which shall henceforth colloquially referred to as "Best Butler") recently appeared an <a href="http://blog.us.playstation.com/2010/11/30/it-only-does-unstoppable-deals/">a new PS3 ad</a> announcing a pretty sound deal for you 3D-seekers out there. The retailer is <a href="http://www.bestbuy.com/site/Electronics+Promotions/regularCat%3Apcmcat227100050017/pcmcat227100050017.c?id=pcmcat227100050017&amp;DCMP=rdr1430">currently offering</a> a trio of bundles featuring Bravia HDTVs and 160GB PlayStation 3s, equipped with <em>Gran Turismo 5</em> and <em>Grown Ups</em> on Blu-ray. Two of these bundles feature televisions that are 3D-ready, while all of the bundles knock over $1,100 off the combined prices of the products therein. That's not bad for a retailer that isn't, you know, Amazon.<br />

Both ads push the PS3's appeal for the "whole family" (meaning not just <em>you</em>): one highlighting its utility as a Blu-Ray player, and the other depicting PSN's ability to make the device a Facebooking, Netflixing multimedia set-top box.<br />
<br />
Despite the mainstream message, both ads also have some value to the PS3 "core gamer" -- because they're pretty funny, if just a <em>touch</em> (or sniff) creepy. Remember when motion-controlled games were simply for old people and children? (We kid!) However, Nintendo's marketing has rarely reached this level of aggression. Sony has launched a new website -- <a href="http://www.yaybuttons.com/">www.yaybuttons.com</a> -- that plays hardball against Microsoft's button-free Kinect experience. By clicking any of the buttons on the virtual PlayStation Move controller, you'll be able to read through a rant from fictional PlayStation VP <a href="http://www.joystiq.com/tag/kevin-butler">Kevin Butler</a>:<br />
<blockquote>"It turns out that buttons are pretty important. Not like "save the whales" important. More like 'not play games that suck' important. Cuz they help you ... control stuff. Controller. Control. Kinda makes sense. Some people don't think you need buttons. WHAT?! Craziness. Could you imagine gaming without buttons? Where would the control come from?"</blockquote>While there's some reason for concern, this kind of marketing can be interpreted not as playful, but a return to the "<a href="http://www.joystiq.com/2006/07/13/sonys-phil-harrison-i-dont-think-were-arrogant/">arrogant</a>" attitude Sony has been notorious for. Seriously, Sir Howard Stringer is a great guy and all, don't get us wrong -- we've been up plenty of nights bawling our eyes out while he cradled us in his big, burly arms, assuring us that the PS3 would in fact be okay -- but Kevin Butler has proven in his latest ad that he's more than capable for the job. <br />

Instead of suing TV3 into oblivion when it found out that the broadcaster had produced a <a href="http://www.joystiq.com/2010/07/20/kevin-butler-commercial-cloned-in-new-zealand/">commercial</a> directly copying the PlayStation 3's "Montage" ad, Sony used the <a href="http://joystiq.com/tag/kevin-butler">Kevin Butler</a> persona to publicly absolve (and mock) TV3. In a <a href="http://blog.us.playstation.com/2010/07/22/kevin-butler-and-new-zealand/">PlayStation Blog post</a>, Butler offered permission to copy all PS3 ads in exchange for "TV3's support in making the PS3 the OFFICIAL GAME CONSOLE OF NEW ZEALAND." And a <em>Flight of the Conchords</em> box set.<br />
<br />
As if this whole story weren't cute enough, TV3 sent Sony a package containing not only the <em>Conchords</em> set, but other local treats -- and a plaque proclaiming PS3 the "official game console of <a href="http://en.wikipedia.org/wiki/Aotearoa">Aotearoa</a>." We'd never have believed it if we hadn't seen it ourselves: two media companies settling a dispute in a friendly, joking manner instead of litigation. Whether you call it an homage or a rip-off, an ad produced by New Zealand's TV3 bears a striking similarity to one of Sony's US PlayStation 3 ads starring faux executive <a href="http://www.joystiq.com/tag/kevin-butler">Kevin Butler</a>. As noted by <a href="http://buttonmasher.co.nz/blog/2010/07/20/tv3-rips-off-kevin-butler/">Buttonmasher</a>, the two commercials include nearly the same dialogue, setting, reaction shots and ... well, everything except the same actors.<br />

When ad agency <a href="http://www.joystiq.com/2007/11/30/sony-hires-deutsch-for-playstation-advertising/">Deutsch won the $150 million Sony account</a> back in 2007, it had an uphill battle to change Sony's image following its, err, <a href="http://www.joystiq.com/2006/10/27/new-world-series-ps3-ad-is-weak-sauce/"><em>avant-garde</em></a> advertisements under <a href="http://ps3.joystiq.com/2007/11/29/sony-america-drops-ad-agency-of-13-years-now/">TBWA</a>. The new agency succeeded with Butler, who has gone on to become a sensation -- and that's where this copy gets unique.<br />
<br />
"It's rare to see a carbon copy of a U.S. commercial or campaign created by smaller players overseas," explains Tim Nudd, editor of AdFreak.com. "I think there's a healthy fear of getting caught and sued by the big guys. More common is the reverse -- a big U.S. marketer/agency ripping off unknown work from smaller players."<br />

It's true, the towheaded adman sprung fully formed from Hirshberg's loins while he was still with marketing firm Deutsch LA. However, he says in a <a href="http://kotaku.com/5586114/the-man-behind-sonys-fake-exec-hero-moves-to-activision">Kotaku</a> interview that he's not interested in plopping out a clone for Activision, saying "Kevin Butler was the right solution for Sony." Hirshberg doesn't take the job until September, so he says he hasn't settled on how he'll be attacking Activision's image problems. <br />

He's kind of like <a href="http://www.joystiq.com/tag/kevin-butler">Kevin Butler</a>, but he's a lot younger and he's <em>all about</em> the PSP. His name is Marcus, Marcus 'PSP' Rivers (we're not confident that's his Christian name) and he's the face of a new ad campaign that Sony's running to promote the PSP and PSP Go: "Step Your Game Up." We saw a glimpse of the little scamp during <a href="http://www.joystiq.com/2010/06/15/sony-e3-2010-keynote-live-from-the-shrine-auditorium/">Sony's E3 presser</a>, but apparently Marcus will be branching off on his own in the coming months.<br />

A <a href="http://blog.us.playstation.com/2010/07/02/step-up-your-game-with-psp-and-pspgo/">PlayStation blog</a> post details the campaign and points out <a href="http://www.youtube.com/marcuspsp">Marcus' YouTube channel</a> which is full of clips from pieces currently running "on over 19 networks." It's been a while since we last posted about a <a href="http://www.joystiq.com/tag/littlebigplanet"><em>LittleBigPlanet</em></a> creation that really knocked our socks off, but maybe that's because we were simply waiting for that <em>super</em> <em>special </em>level. You know, a platforming masterpiece that combines Sony spokesperson extraordinaire Kevin Butler with the fast-paced micro-games of <em>WarioWare</em> into a single, functional package. We weren't aware science had progressed far enough to make this fusion possible -- but the very existence of "<a href="http://www.youtube.com/watch?v=p8U-bp3Ifko">Kevin Butler Ware</a>" seems to indicate that it has.<br />

<a href="http://blog.us.playstation.com/2010/05/17/modnation-racers-artist-spotlight-kevin-butler-nuff-said/">The latest video</a> from Sony's fictional Vice President of <em>a whole bunch of things</em> has everything you could ever ask for: Tons of Kevin Butler <em>bon mots</em>, some clips of gameplay footage from <a href="http://www.joystiq.com/tag/modnation-racers"><em>ModNation Racers</em></a>, and an appearance by real-life Sony president and CEO Jack Tretton. Unless, of course -- what if Tretton's actually just a highly paid actor as well? Come to think of it, we've never seen him in any context except for ... <a href="http://www.joystiq.com/2008/07/15/engadget-and-joystiq-live-from-sonys-e3-2008-keynote/">on the stage</a>! <br />

Like all responsible journalists worth their salt, we're inherently distrustful of advertising and the incredible power it wields over us -- err, rather <em>consumers</em>. But we feel like you deserve to know that there's a special place in our coldly detached hearts for pretend PS3 pitchman <a href="http://www.joystiq.com/tag/kevin-butler">Kevin Butler</a>. And we're apparently not alone. <br />

According to what SCEA marketing boss Peter Dille told the MI6 marketing conference in San Francisco last week, purchasing intent for the PS3 is up 36 percent since the "It Only Does Everything" campaign started last year. Now, does <a href="http://www.joystiq.com/2009/08/18/its-official-playstation-3-price-drops-to-299/">the price drop</a> that accompanied the campaign figure into that? Of course. But according to <a href="http://ps3.ign.com/articles/108/1081778p1.html">IGN</a>, Dille added, "we know from research that consumers are more educated as well." <br />

We didn't hear about <em>that</em> at any press conference! But there's Kevin Butler, addressing us from November 2010 about advances in nutrition and the success of the PlayStation Move. That means, according to Sony's time travel technology, the Move should be out sometime in November at the latest.<br />
<br />
This commercial features plenty of footage of some guy completely battering air in <em>Motion Fighter</em>, along with some not-so-subtle callouts of the motion-based competition, and even a little bit of reverent <a href="http://joystiq.com/tag/jack-tretton">Tretton</a> worship. Kevin Butler, you need not worry: Your job as Sony's VP of First Person Shooter Relations is in <a href="http://www.joystiq.com/2010/01/22/mag-dev-calls-xbox-live-more-juvenile-than-psn/">no threat of ending</a>. Neither is your job as <a href="http://www.joystiq.com/2009/10/23/scea-ad-campaign-continues-with-ratchet-and-clank-with-bonus-mont/">Chief Weaponologist</a>, VP of Epic Footage, <a href="http://www.joystiq.com/2009/10/03/uncharted-2s-cinematic-properties-parodied-in-ps3-commercial/">VP of Big Action Moments</a> and -- our favorite -- <a href="http://www.joystiq.com/2009/09/10/latest-ps3-ad-promotes-littlebigplanet-and-extramarital-affairs/">Family Activities Director</a>. In an interview with <a href="http://ps3.ign.com/articles/106/1065686p1.html">IGN</a>, SCEA senior vice president Peter Dille talked about the company's new "It Only Does Everything" slogan and marketing campaign. "It's been tremendously successful. Consumers love it. It's great to hear people like you guys love it. And the results are really in the sales because it's really been flying since this coincided in September with the launch of the new PS3."<br />

The tremendous success of the ad campaign has guaranteed its continuation through 2010. "You can expect to see Kevin Butler inject a lot of life into the PlayStation brand between now and the rest of the year," Dille commented, and promised we'd see the tagline quite a bit "when motion control comes onto the scene." Zipper Interactive's Ben Jones has some fighting words against Xbox Live users. At a recent European press event for <a href="http://www.joystiq.com/tag/mag"><em>MAG</em></a>, he told <a href="http://www.gamerzines.com/ps3/news/xbox-live-juvenile-zipper.html">Gamerzines</a> that "Xbox Live [is] the more juvenile of the two," blaming "the things that are being said over Xbox Live." Certainly, anyone that's played a match of <em>Halo 3 </em>or <em>Modern Warfare 2</em> on Xbox has had to endure trash-talking bigoted 12 year olds, like <a href="http://img706.imageshack.us/img706/6813/lolxboxlivemsg.jpg">this one</a>.<br />
<br />
But, we'd disagree with Jones. <em>Uncharted 2</em> and <em>Modern Warfare 2</em> on PS3 play home to players that are just as foul-mouthed as the ones on Xbox. Here are just a <a href="http://www.youtube.com/watch?v=GD9ZFfL73zQ">few</a> <a href="http://www.youtube.com/watch?v=uur9pZ9chcU">examples</a>. Imagine how terribly offensive the service would be if more players used headsets!<br />
<br />
If only there were more people like PlayStation VP Kevin Butler playing games online. At the very least, the online world would be a funnier place. Check out his new ad after the break.<br />
