Levine performed motion capture to have his avatar used in the Band Hero song "She Will Be Loved," but didn't give Activision permission to use his likeness with other songs, which it totally did. Levine alleges that Activision asked other artists for expanded use of their avatars and paid them more in the process.

Activision is no stranger to lawsuits like Levine's, losing a similar case to No Doubt in 2010 (Talk about jumping on the Bandwagon late).
