The victims of the fire were compensated according to their insurance coverage. Chalk this one up to "we saw this coming," but the troubled waters that <a href="http://www.joystiq.com/2008/05/20/ds-fanboys-semi-ultimate-homebrew-guide/">flash carts</a> have found themselves in has led to an increase in R4 sales.<br /><br />Nintendo and fifty-three other companies <a href="http://www.joystiq.com/2008/07/29/nintendo-and-others-file-suit-against-flash-cart-sellers/">are filing a suit against retailers</a> selling flash carts, demanding that they stop the sales and imports of said cards. According to <a href="http://kotaku.com/5030798/is-nintendos-legal-suit-helping-r4-sales">Kotaku</a>, Japanese retailers in Akihabara are noticing a difference in demand for flash cards already. Regarding <a href="http://www.joystiq.com/2008/05/20/homebrew-solution-r4ds/">the R4</a>, one staffer noted, "The rush in demand has been amazing. These devices always sell well. But this weekend should be staggering, don't you think?" Amazon.jp has also seen a rise in cart sales, which is to be expected.<br /><br />We're sure Nintendo foresaw the immediate panic following the company's announcement, and that's the risk they decided to take -- watching things get worse before they get better. When it comes to controller design, there truly is <a href="http://www.biblegateway.com/passage/?book_id=25&amp;chapter=1&amp;verse=9&amp;version=31&amp;context=verse">nothing new under the sun</a>. You don't have to tell that to Nintendo -- the company has been sued (with varying success) over existing patents allegedly relating to <a href="http://www.joystiq.com/2006/12/08/nintendo-gets-sued-over-wiimote/2">the Wii Remote</a>, <a href="http://www.joystiq.com/2008/05/15/nintendo-ordered-to-pay-21-million-for-patent-infringment/">the Gamecube controller</a> and, uh, <a href="http://www.joystiq.com/2008/01/11/nintendo-sony-sued-for-alleged-patent-infringement/">the Wii Remote</a> again. Now, <a href="http://www.gamepolitics.com/2008/07/07/nintendo-faces-patent-lawsuit-apparently-over-ds-touch-screen">GamePolitics is reporting</a> Nintendo is facing another lawsuit over the DS touchscreen.<br /><br />In his complaint, John R. Martin alleges that the Nintendo DS infringes on his 2003-filed patent for a "<a href="http://www.google.com/patents?vid=USPAT6926609">Method for Operating an Electronic Machine Using a Pointing Device</a>," (pictured above) which describes, among other things, a touchscreen input system. Nintendo, for its part, <a href="http://www.gamepolitics.com/images/pdf/Nintendo-martin-response.pdf">formally responded to the charges</a> (PDF link) by saying it does not infringe on the patents, that Martin's ideas are unpatentable, and that the company is protected by something called the "doctrine of prosecution history estoppel." So there!<br /><br />We're not patent lawyers, but Martin's patent doesn't seem to offer much improvement over the <a href="http://www.google.com/patents?vid=USPAT5266931">1993 touchscreen patents</a> he himself references. Two gamers have filed a lawsuit against Electronic Arts, alleging that the publisher's exclusivity agreements with the NFL, NCAA and Arena Football have led to anti-competitive practices. The focus of the suit, according to <a href="http://www.gamespot.com/news/6192409.html">Gamespot</a>, stems from EA's actions after sales of Take-Two's <em>NFL 2K5</em> pushed the publisher to drop <em>Madden 2005 </em>from $50 to $30. Instead of competing with Take-Two, according to the suit, EA entered into multiple exclusivity agreements and was able to raise the price of <em>Madden 2006 </em>back to $50.<br /><br />Additionally, the suit notes that should the <a href="http://www.joystiq.com/2008/06/07/pachter-ea-will-raise-take-two-bid-itll-get-rejected-merger/">EA-Take-Two acquisition</a> come to fruition, it would "remove one of the few companies with the ability and expertise to compete in the market for interactive football software." Apparently, Thompson "failed to follow the proper federal court procedure for amending a complaint." Thompson says he'll try it again though, so please, read on.]<br /><br />The smoldering battle between Florida lawyer <a href="http://www.joystiq.com/tag/jackthompson">Jack Thompson</a> and the gaming press has been taken to a new level. In a <a href="http://kotaku.com/gaming/legal/jack-sues-kotaku-255321.php">tersely worded post</a> yesterday on Kotaku, Brian Crecente revealed that Thompson has added a complaint against Kotaku owner Gawker Media to a March 13 suit against the <a href="http://www.joystiq.com/2007/04/04/jack-thompsons-further-florida-bar-issues/">Florida Bar</a>.<br /><br />The <a href="http://kotaku.com/assets/resources/2007/04/Thompson%20v.%20Bar%2C%20Third%20Amended%20Complaint%2C%20April%2025%2C%202007.pdf">childishly-worded complaint</a> (He actually makes a <a href="http://movies.clevver.com/video/19755/borat-film-clip-not-joke-300.php">"NOT!" joke</a> on page 27) focuses on a few <a href="http://kotaku.com/gaming/virginia-tech/breaking-idiot-thompson-blames-va-shooting-on-games-252702.php">Kotaku commenters</a> (which Thompson mistakenly refers to as "bloggers") that allegedly said Thompson "should be shot ... struck with a baseball bat, shot in the face by an irate gamer, [and] castrated and his testicles stuffed down his throat," among other things. To be fair, those are some strong, hateful words, and threats like these are not necessarily protected by the first amendment. Still, Gawker or Kotaku probably can't be held liable for them -- a federal judge <a href="http://www.law.com/jsp/article.jsp?id=1149152717145">ruled</a> in June 2006 that "bloggers cannot be hit with libel suits on the basis of anonymous postings on their Web sites."<br /><br />Perhaps knowing this, Thompson goes a different route in his complaint by alleging Kotaku is part of a "civil conspiracy ... to deprive Thompson of his various basic constitutional rights" and that the site is "attempt[ing] to intimidate a citizen for the exercise of his constitutional rights."
